CLIFFORD GILBERT AND DANA GILBERT (Vk/a DANA SHEERAN), Respondents. RE: Violation of Chapter 30 Article 11 Section 30 -33 of the Code of Ordinances of the Village of Tequesta. Address: 109 Beechwood Trail Tequesta, Florida 33469 Legal Description: TEQUESTA PINES LOT 134 PCN: 60- 42- 40- 25 -25- 000 -1340 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Hearing held on the I P day of December, 2014, and based on the evidence and testimony presented, entered an Order Reducing Fine. The following Findings of Fact, Conclusions of Law, and Order are hereby entered: FINDINGS OF FACT 1. The Respondent, Dana Gilbert, was present at the hearing; there was a finding that proper notice was given. 2. The original Fine was assessed in the amount of One Thousand Fifty Dollars ($1,050.00). The Village also incurred administrative costs in the amount of $398.96 from bringing this case. 3. The Respondent appeared and presented testimony seeking reduction of the fine amount previously assessed Page 1 of 2 4. The Village objected to any reduction since this was a repeat violation. CONCLUSIONS OF LAW AND ORDER It is the Order of the Village of Tequesta Special Magistrate that the request for a fine reduction is GRANTED The fine amount of $1,050.00 shall be reduced to $500.00. The Respondents shall also pay the Village's administrative costs in the amount $398.96. The reduced fine plus administrative costs shall be paid in full no later than January 26, 2015, or the original, full lien amount shall be reinstated. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property upon which the violation exits and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes.
