ORDINANCE N0. 118
AN ORDINANCE PROVIDING FOR THE QUALIFICATION OF ELECTORS,
VOTER REGISTRATION; THE DUTIES OF THE 1tk~ISTRAR FOK
VOTING; PURGING OF THE REGISTRATION BOOKS; ABSENTEE
BALIATS; AND VOTING PROCEDURE FOR ABSENTEE ELECTORS.
BE IT ORDAINED BY THE VIIZ~E COUNCIL OF THE VILLAGE OF
TEQUESTA, PAIM BEACH COUNTY, FIARSDA, as follows:
Section 1. In order for any individual to be eligible to
vote in any general or special election held hereafter in the Village
of Tequesta he must have the qualifications prescribed by Section 14,
Article III, of the Charter of the Village and said individual must
be registered in the manner hereinafter provided.
Section 2. (a) The Village Clerk shall be the registrar
for voting registration, and shall be the custodian of the registra-
tion books. He shall keep the registration books of the Village at
his office or at such other place or places as the Council shall from
time to time designate.
(b) The registration books of the Village shall
be open for registering voters during the regular business hours of
the office of the Vil]a.ge Clerk, provided however, said book shall
be closed during the ten (10) days immediately preceding any election.
(c) The Village Clerk shall have the authority
to demand such proof of qualification to vote as shall be reasonably
necessary to satisfy him that the person attempting to register is
in fact qualified to vote in the Vi1la.ge elections.
Section 3. Every person applying for registration shall
subscribe to the following oath or affirmation:
"I do solemnly swear (or affirm) that I will protect
and defend the Constitution of the United States and
of the State of Florida; that I am 21 years of age;
that I am a citizen of the United States and of the
State of Florida; and that I have been, or at the time
of holding the next election will have been, a resident
of the Village of Tequesta, Florida, fora period of
six months. That I am qualified to vote in such Village
elections under the Charter of the Village of Tequesta,
constitution and laws of the State of Florida."
The Clerk or any Deputy Clerk is hereby authorized and
required to administer this oath. '4~en a person has been registered
as herein required, the Village Clerk shall furnish such person a
certificate of registration.
Section 4. (a) The Village Council may, at its discretion
but not less than ninety (90) days prior to any regular or special
election, authorize the Village Clerk to revise the registration
books of the Village. Upon receiving said authorization the Village
Clerk shall mail to each elector in the Village ~y~o did not vote in
any election in the Village during the past two years, a notice to
be filled in, signed and returned by mail within thirty (30) days
after the notice is postmarked. The form to be returned shall advise
the Village Clerk whether or not the elector still meets the qualifi-
cations to vote prescribed by the Village Charter. The names of those
electors who are deceased or who no longer meet said qualifications
and the names of electors failing to return said notice within the
thirty (30) day period shall be stricken from the registration books.
The Village Council shall so purge the registration books at least
once within two years of the adoption of this Ordinance and at least
once every two years thereafter.
(b) A list of the electors so stricken from the
registration books shall be published once in a newspaper of general
circulation in the Village of Tequesta. Any person whose name has
been stricken shall have the right to re-register upon satisfactory
proof to the Village Clerk of his eligibility to vote.
Section 5. (a) Any elector who will be absent from the
County on the day of election or who is physically incapable of
appearing at the polling place on the day of election may make applica-
tion for absentee voting with the Village Clerk either in person or
by mail, at any time during the fifteen (I5) day period preceding
any election but not later than the fifth day preceding such election.
(b) Upon receiving said application the Village
Clerk shall issue to the absentee elector an official ballot of the
Village, printed envelopes and an affidavit in the fo nn provided
herein. Such elector shall mark such ballot in the manner provided

for, designating the candidate of his choice, and shall thereupon
place the ballot in a plain envelope upon which there shall be no
mark of identification, and securely seal the same. Such elector
shall thereupon make affidavit to the effect that his absence from
the Village is temporary, or that he is prevented by sickness from
casting his ballot in a regularly designated voting place, as the
case may he, and that he is a qualified elector of the Village.
Said affidavit shall be i.n the form set out herein. Such elector
shall thereupon place the envelope containing his ballot together
with the affidavit executed as aforesaid in a second envelope upon
which the words "Absentee Ballot" shall be printed. Said outer
envelope shall be signed by the elector in the space provided, sealed
and addressed to the Village Clerk of the Village and delivered to
the Village Clerk in person or sent to the Village Clerk by United
States mail.

(c) Prior to the day of election the Village
Clerk shall keep unopened in his office all envelopes received
containing marked ballots for absentee electors. All marked absentee

electors ballots to be counted must be received by the Yillage Clerk
by 5:00 o~clock P.M. on the day preceding any election.
(d) The Village Clerk shall keep a list showing
the names of all applicants for absentee ballots, the date of mailing
or delivering the ballot to the elector, and the date of receiving
the ballot from the elector.
(e) 'lhe absentee be,llots shall be counted on the
day of election as provided by ordinance.
Section 6. Ordinance No. 23 and all ordinances or parts
of ordinances in conflict herewith, be and the same are hereby
repealed.
Section 7. This Ordinance shall take effect immediately
upon its passage and approval as provided by la.w.
