ORDINANCE N0. 116 ~~
AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA,
AMENDING THE OFFICIAL ZONING ORDINANCE OF THE
VILLAGE OF TEQUESTA TO CREATE AN ADDITIONAL DISTRICT,
AND TO REGULATE AND RESTRICT THE LOCATION AND USE OF
BUILDINGS, THEIR HEIGHT AND SIZE, IN SAID DISTRICT
FOR MULTIPLE FAMILY (HIGH RISE) DWELLINGS.
WHEREAS, the official 'Coning Ordinance of the Village of
Tequesta, being Ordinance No. 43, may be amended from time to time on
its own motion or on petition after public hearing by the Village
Council of the Village of Tequesta; and
WHEREAS, upon motion of the Village Council, a public hearing
was duly held on April 29, 1966 for the purpose of considering and acting
upon an additional classification of zoned areas to permit the con-
struction of high rise apartments;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA:
Section 1. That Section 3 of the Official Zoning Ordinance
of the Village of Tequesta, being Ordinance No. 43, be, and the same is
hereby, amended to include a sixth district designated as follows:
R-3-Multiple Family (high rise) dwelling district.
Section 2. The construction or improvement of buildings
or structures in said district R-3 shall be governed by the following:
A. USES PERMITTED
Within any R-3 Multiple Family Dwelling District the following
uses will be permitted:
1. Any use permitted in the R-2 Multiple Family Dwelling
District.
B. BUILDING HEIGHT REGULATIONS
(a) For one and two family dwellings the height shall not
exceed thirty (30) feet.
(b) For other multiple family dwellings, the height shall
not exceed 100 feet.
C. BUILDING SITE AREA REGULATIONS
Every dwelling structure erected or structurally altered
shall have a site area per family of not less than the following:

(a) For single family dwellings, the same as for the
R-1 Single Family District.
(b) For two family dwellings, the same as for the R-2,
Multiple Dwelling District.
(c) For structures that exceed two stories, there shall
be added to the minimum area of ten thousand (10,000)
square feet, one thousand (1000) square feet of site
area for each dwelling unit.
D. YARD OR OPEN SPACE REQUIREMENTS
1. There shall be a front yard of not less than twenty
(20) feet measured from the street line to the front
wall of the building.
2. There shall be a rear yard of not less than twenty
(20) feet measured from the rear wall of the main
building to the rear lot line.
3. There shall be a side yard on each side of the main
building of not less than twenty (20) feet.
E. OFF-STREET PARKING REGULATIONS
There shall be provided on the site or within the structure
one and one half (12) parking spaces per dwelling unit for
Multiple Family structure. For single family and two family
dwellings there shall be provided on the site two (2) parking
spaces per dwelling unit.
Section 3. No lands lying West of The Intracoastal Waterway
shall be classified R-3.
Section 4. Any lands placed under R-3 District classification
shall be subject to the terms and conditions of Sections 1, 2, 3, 4, 9,
10, 11, 12, 13, 14 and 15 of said Ordinance No. 43.
Section 5. That all ordinances and parts of ordinances in conflict
herewith be, and the same are hereby, repealed.
Section 6. This ordinance shall take effect immediately upon its
passage and approval as provided by law.
