AN ORDINANCE AMENDING ORDINANCE N0. 41 TO EXTEND
THE SEWERAGE FRANCHISE TO INCLUDE ADDITIONAL.
STREETS AND AREAS WITHIN THE VILLAGE OF TEQUESTA
AND PROVIDING THAT IN ALL OTHER RESPECTS ORDINANCE
N0. 41 SHALL REMAIN AS ORIGINALLY ADOPTED.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA,
PALM BEACH COUNTY, FLORIDA, A S FOLLOWS:
Section 1. WHEREAS, by Ordinance No. 41, the Village of
Tequesta, Florida, granted unto William E. Schlusemeyer, his successors
and assigns, a thirty-year franchise to construct and operate a
sewerage and disposal plant and system within certain areas of the
Village; and
WHEREAS, PLANTREAT, INC., has succeeded by assignment to the
interests of said William E. Schlusemeyer; and
WHEREAS, PLANTREAT, INC. has requested an extension of its
area of service; and
WHEREAS, the Village Councilmen deem it to the best interests
of the Village to grant said extension;
NOW, THEREFORE, Section 1 of Ordinance No. 41 be, and the same
is hereby, amended to read as follows:
Section 1. That there is hereby granted to WILLIAM
E. SCHLUSEMEYER, herein called the "Grantee", his
successors and assigns, the exclusive right, privilege
or franchise to construct, maintain and operate in,
under, upon, over and across the present and future
streets, alleys, bridges, easements and other public
places of the Village of Tequesta, Florida, herein
called the "Grantor", and its successors, in accord-
ance with established practice with respect to a
sewerage collection and disposal plant, for the
period of thirty (30) years from the date of accept-
ance hereof, to construct, operate and maintain a
sewerage plant, collection, distribution or disposal
system, as well as, pipes, mains, pumps and other
facilities for the purpose of supplying sewerage
disposal to Grantor and its successors, the inhabi-
tants thereof and persons and corporations within
the subdivision of Jupiter-in-the-Pines and Jupiter-
in-the-Pines, Sections B, C, and D, according to the
plats thereof on file in the office of the Clerk of
the Circuit Court of Palm Beach County, Florida,
recorded in Plat Book 25, pages 145 and 146; Plat
Book 26, page 18, and Plat Book 26, page 215; Plat
Book 26, page 19, and Plat Book 26, 137, respectively;

and the said grantee, his successors and assigns,
shall have the exclusive right, privilege or franchise
to construct, maintain and operate in, under, upon,
over and across Tequesta Drive from its intersection
with the East right-of-way line of Sevilla Road
easterly to its intersection with the right-of-way
of U. S. Highway No. 1 (State Road No. 5), and that
part of Waterway Road lying East of the right-of-way
of said U. S. Highway No. 1 and belonging to the
Village of Tequesta, Florida, such pipes, mains,
pumps and other facilities as may be necessary for the
purpose of supplying sewerage disposal to grantor and
its successors, the inhabitants thereof, and persons
and corporations being adjacent to said Tequesta
Drive and Waterway Road.
Section 2. That this ordinance shall not be construed to
extend the thirty-year period of the original franchise granted in and
under Ordinance No. 41, nor to amend any other of the terms and provisions
of said Ordinance No. 41 except as provided in Section 1 hereof.
Section 3. That all ordinances and parts of ordinances in
conflict herewith be, and the same are hereby, repealed.
Section 4. This ordinance shall take effect immediately upon
its passage and approval as provided by law.

Gentlemen:
Pernu.ssion is hereby requested to include in our
sewer franchise the following extension which will
be turned over to our corporation as soon as completed.
An eight inch line from the Village Shopping Center
along the north side of Tequesta Drive to our man-
hole at the junction of Tequesta Drive and Willow
Road. T~ construction of same is being made by
the owners of the Village Shopping Center and
Tequesta Plaza. Plans of same have been previous]y
presented to the Village of Tequesta.
