HomeMy WebLinkAboutOrdinance_110_06/08/1965r ORDINANCE NO. 110 AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, VACATING AND ANNULLING ORDINANCE NO. 107; PROVIDING FOR THE ISSUANCE OF CERTIFICATES OF OCCUPANCY, AND FOR A PENALTY FOR VIOLATION THEREOF, AND REPEALING OF ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. WHEREAS, the Village Council of the Village of Tequesta, by Ordinance No. 19 has adopted the Building Code of Palm Beach County, Florida; and WHEREAS, by Ordinance No. 107, the Village Council did pre- scribe certain prerequisites to the issuance of certificates of occupancy; and WHEREAS, the Village Council deems it to the best interests of the health and welfare of the Village to require the issuance of such certificates of occupancy and to set forth the prerequisites in more detail; NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALT~I BEACH COUNTY, FLORIDA, A5 FOLLOWS: SECTION 1. That Ordinance No. 107 of the Village of Tequesta be, and the same is hereby, vacated, annulled and cancelled. SECTION 2. That no change in the use or occupancy of land, nor any change of use or occupancy in an existing building, shall be made, nor shall any new building be occupied for any purpose until a valid certificate of occupancy has been issued by the Village Clerk or such other officer as may be designated by the Village Council. SECTION 3. No certificate of occupancy shall be issued with- out compliance with the following prerequisites, to-wit: (a) That the applicant shall have first received a building permit from the Village Clerk for the construc- tion of the building or residence on the property, or the improvement or alteration of an existing building or residence thereon. . Y • • (b) That the applicant shall first have complied with Ordinance No. 105 relating to the numbering of houses and buildings within the Village and shall have placed a number on such house or building. (c) That all trash and debris that has accumulated on the property during the construction of the building or residence or the improvement or alteration of such building or residence shall have been removed. (d) That all trash and debris that has accumulated as aforesaid on adjacent property shall have been removed and any damage thereto repaired. SECTION 4. That a record of all certificates of occupancy shall be kept on file in the Village Hall, and copies shall be furnished on request to any person having a proprietary or tenancy interest in the land or in a building affected by such certificate. SECTION 5. Any person convicted of violation of this Ordinance shall be punished as provided in Section 10 of Ordinance No. 1. SECTION 6. That all ordinances or parts of ordinances in conflict herewith be, and the same are hereby, repealed. SECTION 7. That this ordinance shall take effect immediately upon its passage and approval as provided by law. PASSED AND ADOPTED ON ~J READING this day of %~.1~°' , 1965 .
