Ordinance 26-14 is a small Scale amendment to the Village Zoning Map. The Village of Tequesta received a Voluntary Annexation petition for three parcels located on County Line Road. The subject amendment changes the Village's Zoning Map by designating R-2 (Multiple Family Dwelling) zoning district to the three annexed parcels. Multiple Family Dwelling District Commercial Specialized (CS) The Village of Tequesta received written petitions signed by the owners of Parcel 1, 2 and 3 to be annexed into the Village. Pursuant to Florida Statutes 171.044(1) "The owner or owners of real property in an unincorporated area of a county which is contiguous to a municipality and reasonably compact may petition the governing body of said municipality that said property be annexed to the municipality". The subject applications are contiguous to the Village of Tequesta boundaries. It consists of three (3) parcels located on County Line Road totaling 1.5316. The proposed annexation was processed through the County's Annexation Review Process. County staff has not identified any inconsistencies with Chapter 171 F. S. Once the subiect parcels are part of the Villa�e of Tequesta a process for Future Land Use map amendment and rezonin� will be initiated. The Council adoption hearing of Ordinance 19-14 to annex the subject properties was held on November 13, 2014. On December 11, 2014 Council adopted Ordinance 21-14 to amend the Future Land Use Map and heard the first reading of Ordinance 26-14 to amend the Zoning Map. Above Table presents current Palm Beach County Zoning districts and proposed Village of Tequesta Zoning districts. WHEREAS, after duly noticed public hearings, held pursuant to Florida Statutes, the Village Council of the Village of Tequesta does hereby find, determine and declare that the public health, safety and general welfare of the citizens of the Village of Tequesta are best served by assigning that real property described herein below, located within the Village, the zoning designation of "R-2 — Multiple Family Dwelling District". NOW, THEREFORE, BE IT ORDAlNED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, THAT: Section 1: That certain real property recently annexed into the corporate limits of the Village of Tequesta consisting of a total of approximately one point five three one six (1.5316) acres more or less, located at 3774, 3764 and 3754 County Line Road, is hereby zoned "R-2 — Multiple Family Dwelling District", and is legally described as follows: (See Exhibit 1 attached hereto for legal description- PCN # 00-43-40-30-00-000-3050, 00-43-40-30- 00-000-3040 and 00-43-40-30-00-001-0030) Section 2: The Village of Tequesta Zoning Map is hereby amended to conform to this Ordinance, and the appropriate officials of the Village are instructed to make the necessary changes to the official Village Zoning Map. Section 3: All Ordinances or parts of Ordinances in conflict be and the same are hereby -1- repealed. S'ection 4: Should any section or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision sha11 not affect the validity of the remainder of this Ordinance. Section 5: This Ordinance shall take effect immediately upon adoption. FIRST READING this day of December, 2014. SECOND AND FINAL READING this day of January, 2015.
