The Special Magistrate appointed by the Village Council to hear code coinpliance cases for the
Village of Tequesta, in accordance with Chapter 162, Flor�ida Stat�istes, has heai•d testimony at the Code
Compliance Hearing held on the 22"d clay of Januaiy, 2015, and based on the evidence and testimony
presented, entered au Order Finding Repeat Violation and Assessing Fine. The following Findings of
Fact, Conclusions of Law, and Order are hereby entered.
FINDINGS OF FACT
1. The Respondent is the owner of the above-described properry.
2. The Respondent was present at the hearing; there was a finding of proper notice.
3. Code Enfoi•cement Officer Joe Petricic testified to the existence of the repeat violation
which was fiist obseived October 30, 2014 and continues to date.
4. The Respondent was previously found to be in violation of this same code section in 2014.
CONCLUSIONS OF LAW
Based on the above-stated facts, Respo��dent is in repeat violation of Chapter 78, Article IX
Section 78-612 of the Code of Ordinances of the Village of Tequesta.
ORDER
It is tl�e Order of the Special Magistrate that a Fine of One Hundred Dollais ($100.00) per day is
hereby assessed beginning on October 30, 2014, for a total fine of Eight Thousand Four Hundred Dolla}
($8,400.00). Said �ne shall continue to accnie at the rate of $100.00 per day iultil compliance is achieved.
Respondent is also assessed the Village's administrative costs in the a�r�ount of $l 94.96.
Should you violate the same Section of the Code again, you may be subject to additional fines of
up to five lrundred dollars ($500.00) per day for such repeat violation. Additionally, t}ie Code Inspector is
not i•equired to give a reasonable time to cot the repeat violation and the case may be presented to the
Special Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing.
Should a dispute arise concerning compliance, either parry may request a hearing before the Code
Enfoi•ceinent Special Magistrate on the issue of compliance only.
Upon co�nplying in any code complia�ice matter, it is always the responsibility of the
Respondent to contact the Code Compliance Division at (561) 768-0506 to request a re-inspection of
�h� property.
A cej•tified copy of this Order may Ue recorded in the Public Records of Palm Beach County,
Flarida, and, once recorded, shall constitute a lien against the property upon which the violation exits and
upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida
StaZi�tes.
