DATE: February 3, 2015 RE; Fareclosure of Code Gompliance Lien; 414 Cypress Drive #D, Case No. 2012-79 On December 18, 2014, the Code Compliance Special Magistrate entered an Order , Authc�rizing Foreclosure of the code cornpliance lien recorded against the above referenced � property in the Village. The entry of this Order is a ministerial act and a statutvey eondition precedent ta the Village filing suit to foreclose its existing code compliance lien. The Village's lien amounts to $6,244.22. The Village previously abated the health, safety, welfare violations � which brought the property into technical eompliance with minimum property standard code regulations. The owners of the property do not reside in the unit {or even in Florida, to our knowledge). The urut has neither electricity nor runr�ing water. From time to time, there have , been occupants in the unit despite its condition. The occupants have claimed to be in the unit ; with the owners' permission, however, this cannot be verified. The fact that there has be�n � occupancy despite the presence 4f electricity and running water has been reported to the health ; department, whieh has declined to act. There have been complaints from residents of ; neighboring units regarding the presence of the occupants. { � The presence of superior liens on the praperty is in question. A cursory review af the ? public records reveals two mortgages an the subject property, both of wluch appear to have been ( � � 1 � � t I sa#isfied. If it turns out that there is a superior mortgage, foreclosure would be subj�ct to that ` i superior debt. There also appear to be outstanding POA dues. This all will need to be verifzed ; through a formal title search prior to filing any foreclosure actian, should that be the direction the , Council desires tt� move in. , Outward appearances are that the owners have abandoned their interest in the property. ; If this is the case, they may not challenge a fQrectosure action, in which case tl�e process will be relatively brief and will be much Iess costly than a challenged foreclosure. In the event that the ° Council directs fareclosure to be commenced, and the Village is suceessfut in its lawsuit, we � would be entitled to recover the full value of our lien, plus fees and costs associated with the foreclosure itself. Recovery wcrutd oceur via judicial sale of the property.
