AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING THE
COMPREHENSIVE PLAN OF THE VILLAGE OF TEQUESTA, FLORIDA IN
ACCORDANCE WITH CHAPTER 163, FLORIDA STATUTES "THE LOCAL
GOVERNMENT COMPREHENSIVE PLANNING AND LAND
DEVELOPMENT REGULATION ACT", AS AMENDED, AND CHAPTERS
9J-5 AND 9J-11, FLORIDA ADMINISTRATIVE CODE, ADOPTING A
SMALL SCALE DEVELOPMENT AMENDMENT TO THE FUTURE LAND
USE MAP IN THE AREA DESIGNATED; APPLYING A COMMERCIAL
LAND USE CLASSIFICATION TO A PORTION OF REAL PROPERTY
LOCATED ON THE EAST SIDE OF U.S. HIGHWAY ONE NORTH OF
CANAL COURT, CONTAINING APPROXIMATELY 1.33 ACRES;
PROVIDING A LEGAL DESCRIPTION OF THE PROPERTY; PROVIDING
REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR
CODIFICATION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to Section 163.3161 et seq., Florida Statues, being the Local
Government Comprehensive Planning and Land Development Regulation Act, the
Village of Tequesta may adopt amendments to the Comprehensive Plan; and
WHEREAS, pursuant to Section 163.3179, Florida Statues, the Village may make small
scale development amendments pursuant to the provisions of said statute; and
WHEREAS, the Planning and Zoning Advisory Board sitting as the Local Planning
Agency of the Village of Tequesta has held a public hearing to make recommendation to
the Village Council and has recommended the adoption of the amendments to the
Comprehensive Plan contained herein; and
WHEREAS; the Village Council wishes to approve and adopt a small scale amendment
to the Future Land Use Map of the Village as legally described on Exhibit "A" and as set
forth on Exhibit "B" attached hereto.
NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1. The Village Council of the Village of Tequesta, Florida, does hereby
amend the Comprehensive Plan of the Village in accordance with the Local Government
Comprehensive Planning and Land Development Regulation Act, as amended, adopting a
small scale amendment to the Future Land Use Map in the area designated on the
attached exhibit, applying a commercial land use classification to a portion of the real
property located on the east side of U.S. Highway One, north of Canal Court containing
approximate 1.33 acres.
Section 2. Severability. If any provision of this Ordinance or the application
therefore is held invalid, such invalidity shall not affect the other provisions or
applications of this Ordinance, which can be given effect without the invalid provisions
or applications, and to this end, the provisions of this Ordinance, are hereby declared
severable.
Section 3. Repeal of Ordinances in Conflict. All other ordinances of the Village of
• Tequesta, Florida, or parts thereof which conflict with this or any part of this Ordinance
i are hereby repealed.
Section 4. Codification. This Ordinance shall be codified and made a part of the
official Code of Ordinances to the Village of Tequesta.
Section 5. Effective Date. This Ordinance shall take effect immediately upon its
passage and approval, as provided by law.
's FOREGING ORDINANCE was offered by vice Mayor Watkins, who moved its adoption.
Ordinance was seconded by Council Member Genco, and upon being put to a vote, the vote
as follows:
