AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE
OF TEQUESTA, FLORIDA, AMENDING CHAPTER 66.
SUBDIVISIONS. OF THE VILLAGE CODE OF ORDINANCES TO
REFLECT CHANGES IN THE ADMINISTRATION AND
COMPOSITION OF THE DEPARTMENT OF COMMUNITY
DEVELOPMENT; SHIFTING RESPONSIBILITY FOR
PROCESSING SUBDIVISION APPLICATIONS FROM THE
HUILDING OFFICIAL TO THE DIRECTOR OF COMMUNITY
DEVELOPMENT AND REVISING THE TERMINOLOC�Y
THROU(3HOUT THIS CHAPTER ACCORDINGLY; PROVIDING
THAT EACH AND EVERY OTHER SECTION AND SUBSECTION
OF CHAPTER 66. SUBDIVISIONS. SHALL REA�IAIN IN FULL
FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING
A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND
AUTHORITY TO CODIFY; PROVIDING AA1 EFFECTIVE DATE,
AND FOR OTHER PURPOSES.
WHEREAS, the V'illage of T� De�rto�ent of Commimity Development is curre�tly
admini� by a Di�ctaR of Commumty Development, �d is se�rate �nd dis�inct &om the
Building De�rtm� and
WHEREAS, Chapter 66. Sul�rlivisions. of the Code of Ordina�s currently plac�s
su�ivision application pmo�sing r�nsibility with the Building Official inst�d of the
Director of Commimity I�velapme� and
WHEREAS, the V'illage Coimcil d�ires to desig�te the Director of Community Devel-
opment as the appropriate �n to � subdivision applic�tions p�n�a� to Chepter �, and
to replece die teim "building officiel" wit� "di�ctor of comm�► develop�' as.it app�rs
ttmoughout Chap�ter 66. Subdivisions�, to reflec:t the duti� of th�e departme�, a� to provide
for intemal consist�ncy; and
WHEREAS, the Village Co�il believes these revisions to its subdivision c�de are in the
best i� of the V'illa�e of Tequesta.
ATOW, THEREFORE, BE IT ORDAINED BY THE YILLAGE COUNCIL OF
THE VILLAGE OF TEQUESTA, PALM BEACH, COUNTY, FLORIDA, THAT:

other e�atq repre�ves deem� a�ppropriate, prior to submittal of an applic�tion for
su�ivision skebch plen rr�vview, to ensure p�oper coordination, intention and understand-
ing in the development of land an�d buildings and ta consider compliance �vvith applic�able
village reguiations.
(c) An applic�tion in pmpea fomi must be filed with the �1� d�rector nf cons�zu-

lar meeting of the vills,ge council along with a filing fee in an amowrt as detemnined by
ordinance of the village, which may 1� amended from time to time by the village cotmciL
(d) The subdivider shall submit to the de�tment of caommumty d�velopment, at least two
w�ks prior to a regular me�eting of � villa�e cotmcil, the original and ten capies of a
s�etch plaa of t�ve pro� subdivision for preliminar.K dixussi,on to. examine the scope
of development cairtempl�, and its nat�u�e, and t� explain how it will fit i�o the devel-
opment pa�ern of the village. T� skeLch plan shall show the following f�:
(1) The lar�tion of t� land or site to l� subdivided �1 the �ppro�mate �r+aa. ffi�£
(2) An i�dic�tion of snch nat�u�al f�tu�ses as unusual t�aphy low or swsmpy arws,

rivers, lakes or wat,�rways, mangroves, aad �nviro�lly �sitive lend oF �

(3) An indication of the proximity of such utilities as wate� sewers, d�ge, � electiric
light and �wer, and how the subdivision will be served by each.

(� The relatianship of the proposed subdivision to existin� commimity �aciliti� which
serve or influence it such as main t�c �rterie�, railways, watervvays, ahopping or
c�mmercial centiers, schools, parks and playg�oimds or any other physic�l f�
that will enable the village council to determine how the subdivision will fit into the
pattem of the commut►ttj► ag a whole.

tcact of l�nd will be cr� or may remain dwe to the develapme� of a propos� sub-
division, the village council may r�uire tbat a precticat plan for the d�velopment of

(e) Af�er r�vie�v by the village st� copies of the sketch plan will � forwarded to tl� village
coimcil for consideration. If the sketch plan is disapproved, the village shall retain one
copy and instivct the subdivider �t to pro�d with the subdivisian �mless and �mtil a
plan l�s b�n approved by the village council.

(d) Upon completion of the e� d�r_ector of con�umtv develoamerlt's review, tea
copies of the Preli�' Plat s�ll be filed wrth the � of commuai�,y develop-
ment at 1� two weeks prior to the village c��mcil meeting at which it is to be cmnsiid-
ere�.
(e) The village staff sh�ll examine and check the Pr+eliminary' Plat for general en�ing end
the reqtrit�m� of �ction 6fr52. The village staff shall che�ck fhe preliminary plat for
s�t numbering and naming and confo�nce with t� de�elopmeat pat�. of the vil-
lage. The village staff shall fo�ard to the village manager nine copi� of the plet with
their approval or recommend� changes.

ation of the Prelim� P1at, t1�e village coimcil may csll upon an enginee� r�p�
tives of the various ut�ty c�m�i�, Pla�ing consul�ts, and other � ag�

drainage facilitie,s p�rks, schools and other ap�propriate infi�astructure.

(b) Where the propo� plax covers only a portion of the subdivider's �ntir+ee holding, a sketch
shall be submitted showing the prospective str�t layout and proposed use for the ra-
m�inder
(c) The exte� and boundari� of the pl� area sh�ll be graphically indicated in a cl�r sud
uaderstandable ma�nez
(c� Ten cmpies of the d�d r�trictions end/or prot�ctive coven�nts, whereby the sn�ivider
intends to r+egvlate the land use other than �mugh chapter 78, shall be attached to the

(e) If the pmposed l�d to 1� subdivid� does not lie within the corporate limits but is pro-

Sec. 66-102.-Fin�l plat
(a) The final plat sh�llll l� cl�rly and legi'bly dtawn in ink or tracing cloth to a scale of nat
more th�n 200 feet to one inch. Individual sheeb shall not be l�rger � 24 inches by 36
inches overall, as appmved by � county for purposes of recordiag. Where the final plat
of a propos�i subdivision requires more t�an one sh�t, �ch sh�t sball. be keye,d to a
master map with appmpriate m�rks of identification.
(b) The fmal plat shall include die following information:

names, b�rings, angle9 of i�ersection and widths ('including �vidths along the lines

the following ceartifi� on plats: "The mortgage,e(s) consants and agr� to the plat-
