Address: 4480 County Line Road Tequesta, Florida 33469 Legal Description: 25- 40 -42, W' /2 OF E' /4 OF NW' /4 OF NE ' / (LESS S 30 FT OF N 63 FT OF W 20 FT & PB52 P40) PCN: 60- 42- 40- 25 -00- 000 -1130 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Hearing held on the 23r day of April, 2015, and based on evidence and testimony presented, entered an Order Setting Fine Assessment Hearing. The following Findings of Fact, Conclusions of Law and Order are hereby entered: FINDINGS OF FACT 1. Respondent is the owner of the property described above. 2. Respondent was present at the hearing; there was a finding of proper notice. 3. Based upon evidence, pictures and testimony presented at the hearing on April 23, 2015, the Special Magistrate found that the property remains in violation of Chapter 14 Article VI Section 14- Page ] of 2 152; and Chapter 14 Article VI Section 14 -157 of the Code of Ordinances of the Village of Tequesta. The inspection of the property previously ordered has not occurred; however, Respondent agreed to coordinate with the Village's building official to do so. CONCLUSIONS OF LAW The facts stated above provide sufficient evidence that Respondent remains in violation of Chapter 14 Article VI Section 14 -152; and Chapter 14 Article VI Section 14 -157 of the Code of Ordinances of the Village of Tequesta. ORDER Respondent is hereby ordered to allow the Village of Tequesta's Building Official or the Designee of the Building Official to enter and inspect the property within ten days of the date of this order and inspect same for compliance with building codes. Said inspection to occur prior to May 28, 2015. If Respondent fails to allow the Village Building Official or the Designee of the Village Building Official to enter and inspect the property as stated in this order, a fine of up to $250.00 per day may be assessed for each day the Village Building Official or the Designee of the Village Building Official is prohibited from entering and inspecting the property. Please take notice that you must appear at the Fine Assessment Hearing which will be held on the 28 day of May, 2015 at 10:00 a.m. at Village Hall Council Chambers, 345 Tequesta Drive, Tequesta, Florida 33469 unless the Code Enforcement Officer certifies that you have timely brought your property into compliance. Upon complying in any code compliance matter, it is always the responsibility of the Respondent to contact the Code Compliance Division at (561) 768 -0506 to request a re- inspection of the property.
