HomeMy WebLinkAboutOrdinance_597_05/12/2005ORDINANCE N0.597 • • AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING THE OFFICIAL ZONING ORDINANCE OF THE VILLAGE, AT ARTICLE V OF CHAPTER 78 OF TEQUESTA CODE OF ORDINANCES, ESTABLISHMENT OF DISTRICTS AND OFFICAL ZONING MAP, BY AMENDING THE ZONING MAP TO APPLY A ZONING DESIGNATION OF C-2 COMMUNITY COMMERCIAL TO A PORTION OF REAL PROPERTY LOCATED ON THE EAST SIDE OF U.S. HIGHWAY ONE, NORTH OF CANAL COURT CONTAINING APPROXIMATELY 1.33 ACRES; PROVIDING FOR REVISION OF THE VILLAGE ZONING MAP; PROVIDING FOR A LEGAL DESCRII'TION OF THE PROPERTY; PROVIDING FOR SEVERABILITY, AND PROVIDING AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY .THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The Village Council of the Village of Tequesta, Florida, does hereby amend the official zoning ordinance of the Village, at Article V of Chapter 78 of the Village of Tequesta Code of Ordinances, Establishment of Districts and Official Zoning Map, by amending the zoning map to apply a zoning designation to a portion of the real property located on the east side of U.S. Highway One, north of Canal Court containing approximate 1.33 acres to C-2 Community Commercial District as legally described on Exhibit "A" and as set forth in Exhibit "B". Section 2. The Village Council hereby directs Village staff to reflect a C-2 Community Commercial District to the property herein described on the official Village Zoning Map. Section 3. Severability. If any provision of this Ordinance or the application therefore is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance, which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance, are hereby declared severable. Section 4. Repeal of Ordinances in Conflict. All other ordinances of the Village of Tequesta, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 5. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances to the Village of Tequesta. Section 6. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. U T~-IE FOREGING ORDINANCE was offered by Council Member Vice Mayor Watkins, who moved its adoption.
