REQUEST: Application from Pet Supermarket Inc. for a minor site plan modification of an
existing shopping center to raise the building front elevation parapet wall from
17ft to 23ft for this tenant site allowing better visibility for their signage, and to
modify entrance doors and windows. The plaza owner is Tequesta Investors, LP.
The address of the proposed application is 229 North US Highway 1, Tequesta,
Florida, 33469.

III. BACKGROUND:
Per Section 78-177 (d) (14) of the Village Code, a shopping center is permitted as a special
exception use in the C-2 zoning district upon approval by Council. At their April 9, 2015 public
hearing, Village Council approved an application from Pet Supermarket for a Special Exception
Use modification to an existing Shopping Plaza pursuant to Section 78-362 (3) "Large scale- any
expansion, enlargement or revision to the site of an existing special exception use that does not
qualify as either small scale interior or small scale exterior. Such expansion, enlargement or

revision is subject to the requirements of this division". The development order allows "the
modification of an existing shopping center to raise the front elevation wall parapet from 17 to
23 feet for this tenant site."
IV. STAFF ANALYSIS:
Per Sec. 22-53, the Planning & Zoning Advisory Board must review and approve any aesthetic
modifications to exterior building color or finish when not accompanied by any other site plan
modification. The subject application is requesting a Minor Site Plan Modification to an existing
Shopping Plaza.
Village Square Shoppes is located in the C-2 zoning district. The proposed application does not
increase the square footage of the building footprint but does increase the height by raising the
building's front elevation parapet wall from 17 ft. to 23 ft. to allow better visibility for signage
(the proposed trademarked signage has an overall area of 59.81 sf). The C-2 zoning district
allows for a building height of up to 4 stories or 50 ft. The parapet wall would be raised only on
the front elevation occupied by Pet Supermarket and by Helix Urgent Care to create continuity
(see attached consent from Helix Urgent Care). The rest of the plaza will remain as existing. The
application also proposes to remove the existing front entry swing door and side storefront
windows of the Pet Supermarket tenant space and replace with a large automatic sliding entry
door.

V. FINAL REMARKS:
The Applicant has provided existing and proposed elevations, proof of logo trademark
registration and graphics for proposed signage, a statement of use and approval letters, as well
as paint color samples for the parapet wall and a manufacturer's cut sheet for the automatic
doors.
Following review and recommendation by the Planning & Zoning Advisory Board, this Minor Site
Plan Modification will be heard by Village Council for final approval.
This development application met the requirements set on Section 78-368 notice of hearing.
The notice of hearing was advertised on May 10, 2015.

tlaird Thursday of every month at 5:30 p.m., as needed in the Village Hall Council Chambers, 345 Tequesta

Dear [ADJACENT OCCUPANT]:
As part of a leasing transaction with Tequesta. Investors, LP ("Landlord") for certain space
located in the Village Squaze of Tequesta (the "Shopping Center") identified as Bay 229, located
adjacent to the space occupied by [ADJACENT OCCUPANT], Pet Supermarket, Ine. ("Pet
Supermarket") is considering the renavation of the front fa�ade of Bay 229, and, as part of the
pernuC requirements for the renovation of the front farade af Bay 229, the City of Tequesta may
require that such a renovation of the front fa�ade include that portion of the building occupied by
[ADJACENT OCCUPANT] (collectively, such work is referred to herein as the "Front Farade
Renovation").
If Pet Supermarket proceeds with the Front Fa�ade Renovation, Pet Supermarket will bear the
cost of the construction work. �.irthermore, if the front farade of [ADJACENT OCCUPANT]'s
space is renovated by Pet Supermarket as part of the Front Fa�ade Renovation, [ADJACENT
OCCUPANT] shall have the right, bnt not the obligation, to relocate its front entrance signage
from its elcisting location (currently located under the xoof overhang beneath the front fa�ade) to
the renovated front farade upon its completion, at [ADJACENT OCCUPANT]'s sole cost and
expense. However, in the event that th.e City of Tequesta requires the relocation of [ADJACENT
�CCUPANT]'s front entra.nce signage onto the ranovated front fa�ade as a candition to issuing
permits andJor approvals for the Front Fa�ade Renovation and Pet Supermarket elects to proceed
with the Front Farade Renovation, Pet Supermaxket shall be responsible for relocating
[ADJACENT OCCUPANT]'s signage to the renovated front facade, at Pet SupermarkeYs sole
cost and expense. The Front Farade Renovation shall be conducted i.n such a manner as to not
unreasonably interfere with the quiet enjoyment of ADJACENT OCCUPANT]'s business
operations eonducted in [AD3ACENT OCCUPANT]'s space. However, [ADJACENT
OCCUPANTJ understands and agrees that the construction activities may inconvenience or
interfere with its business operation, particularly during that phase of the renovation of the front
fa�ade of [ADJACENT OCCUPANT]'s space, and that Pet Supermarlcet sha11 not be responsible
for any disruption that may occur in connectian with the Front Fa�ade Renovation.
By executing this Agreement, [ADJACENT OCCUPANT] hereby grants to Pet Supermaxket and
its contractars a Temporary Construction Easement on [.A.DJACENT OCCUPANT]'s space for
the purpose of performing the Front Fa�ade Renovation. The following constitutes Pet
Snpermarket's exclusive warranty with respect to the renovation of [ADJACENT
