HomeMy WebLinkAboutResolution_33-15_05/14/2015 RESOLUTION NO 33 -15 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING ITS ADOPTED PROCEDURE FOR DISPOSING OF SURPLUS VILLAGE PROPERTY FOR THE VILLAGE OF TEQUESTA; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, Resolution 15 -11 of the Village Council of the Village of Tequesta, Florida established and adopted procedures for disposing of surplus Village property; and WHEREAS, the Village Council of the Village of Tequesta now desires to amend its adopted procedures, as authorized by Sec. 3.03(8) of the Village Charter, by delegating to the Village Manager the duty and authority to declare items of Village owned personal property with original purchase value of $1,000.00 or less, to be surplus based on the definition of "surplus property" as contained in the Village's adopted procedures for disposing of surplus Village property, and leaving with the Village Council the duty and authority to declare items of Village owned personal property with original purchase value in excess of $1,000.00 to be surplus based on the definition of "surplus property" contained in the Village's adopted procedures for disposing of surplus Village property; and WHEREAS, based upon recommendations from the Village Manager, the Village Council believes that this revision to its surplus property disposal procedures will promote efficiency without impairing proper control and accounting of the disposal of Village owned personal property. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1: The Village Council of the Village of Tequesta, Florida hereby amends the Village's Procedures for Disposing of Surplus Village Property by amending Paragraph 2. Authority. And Paragraph 7. as follows: 2. AUTHORITY As established in the Village Charter Section 3.03 (8), the Village Manager shall conduct all sales of personal property with an original purchase value of $1,000.00 or more which the Council may authorize to be sold as having become unnecessary or unfit for Village useLq personal property with an original nurchase value of less than $1,000.00, that the Village Manager determines is surplus pursuant to the definition of " sumlus properly" herein below All purchases and sales shall conform to such regulations as the Village Council may from time to time prescribe. 7. PROCEDURES FOR DISPOSING OF SURPLUS PROPERTY Once a determination is made by a department head/director to purge surplus property, a "Request to Transfer/Retire Surplus Property" form is to be completed and forwarded to the finance department. The finance department will prepare a resolution requesting the Village Council to approve the surplus of property . or will submit the request to the Village Manager. to the limits of authority set forth in Paragraph 2 above After approval of the Vill CetmH, the surplus property will be disposed of by the Village Manager in accordance with the above procedures. The finance department shall be advised in writing by the initi ating epartment head/dir , r of the final We of sumlus properly in order to account for the dispo sal of all Village capital items. Section 2 : The Village Manager is directed to incorporate this revision into the Village's administrative policy for disposing of surplus property originally adopted by the Village Council with Resolution 15 -11 on July 14, 2011. Section 3 : This Resolution shall become effective immediately upon adoption.
