HomeMy WebLinkAboutOrdinance_575_10/10/2002 ORDINANCE NO. 575 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING THE COMPREHENSIVE PLAN OF THE VILLAGE OF TEQUESTA, FLORIDA IN ACCORDANCE WITH THE LOCAL GOVERNMENT COMPREHENSIVE PLANNING AND LAND DEVELOPMENT REGULATION ACT, AS AMENDED, ADOPTING A SMALL SCALE DEVELOPMENT AMENDMENT TO THE FUTURE LAND USE MAP IN THE AREA DESIGNATED ON THE ATTACHED EXHIBIT, APPLYING A COMMERCIAL LAND USE CLASSIFICATION TO A PORTION OF REAL PROPERTY LOCATED AT 801 U. S. HIGHWAY ONE, CONTAINING APPROXIMATELY 0.66 ACRES; PROVIDING FOR SEVERABII.ITY; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING ANEFFECTIVE DATE. • • WHEREAS, pursuant to Section 163.3161 et seq., Florida Statutes, being the Local Government Comprehensive Planning and Land Development Regulation Act, the Village of Tequesta may adopt amendments to the Comprehensive Plan; and WHEREAS, pursuant to Section 163.3179, Florida Statutes, the Village may make small scale development amendments pursuant to the provisions of said statute; and WHEREAS, the Local Planning Agency of the Village of Tequesta has held a public hearing to make recommendation to the Village Council and has recommended the adoption of the amendments to the Comprehensive Plan contained herein; and WHEREAS, the Village Council wishes to approve and adopt a small scale amendment to the Land Use Map of the Village as set forth on Exhibit "A" attached hereto. NOW THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Village Council of the Village of Tequesta, Florida, does hereby amend the Comprehensive Plan of the Village in accordance with the Local Government Comprehensive Planning and Land Development Regulation Act, as amended, adopting a small scale amendment to the Future Land Use Map in the • area designated on the attached exhibit, applying a commercial land use classification to a portion of real property located at 801 U. S. Highway One, containing approximately 0.66 acres. Section 2. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance, which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance, are hereby declared severable. Section 3. Repeal of Ordinances in Conflict. All other ordinances of the Village of Tequesta, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 4. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 5 Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE was offered by Councilmember V aY~ f'YaM (L ,who moved its adoption.
