This Work Autkorization authorizes ARCADIS G&M, Inc. to perform the work set forth herein
and is issued pursuant to the "Professional En�ineeriug Consulting Services Agreement for Water
System and General Utility/Civil Projects", dated November 17, 2005, All terms and conditions
of said agreement shall be applicable to this VVork Authorization.
SCOPT;
The Village of Tequesta has requested ARCADIS to pzovide engineering design and permitting
for the project known as Tequesta Park Li£t Statian Itnprovements. Refer to Attachment "l" for
project limits.
`f'he following speeific tasks will be performcd by the Engineer:
1. Prepare a topographic survey for the project,
Z. Prepare and submit preliminary site eivil plans and specifications to tbe Village for
review £or the planned improvements. Note that any electrical connections/upgrades for
the two lift stations will be made with notes on tlie plans.
3. Prepare final plans and specifications. Pi•epare permitting documents for submittal to the
Mai�tin Count� Building Depai�ment for review and act as the Village's liaison with the
Building Departlxient during the review process. The Village will be responsible for
re�ilatory permit fees directly to the agency.
4. Prepare an estimate of construction costs.
COMI'EAISA'I'IOlV
For Scope Items 1 thni 4, the Engineer shall be paid a lump sum fee of eight thousand four
hundred dollars ($8,4�0).

The Engineer will compiete Scope Itenns 1 thru 4 within 75 days of receipt of an executed
authorization, exclnsive of delays beyond the control of the Engineer.
This authorization can be cancelled �yith or wit}.�out cause by the Village with 30 days written
notice. Should said cancellation occur, the Engineer will be paid for all services performed
through the cancellation date.

ADDENDUM
Public Records: In accordance with Sec. 119.0701, Florida Statutes, the Contractor
must keep and maintain this Agreement and any other records associated therewith and that are
associated with the performance of the work described in the Scope of Services. Upon request,
the Contractor must provide the public with access to such records in accordance with access and
cost requirements of Chapter 119, Florida Statutes. Further, the Contractor shall ensure that any
exempt or confidential records associated with this Agreement or associated with the
performance of the work described in the Scope of Services are not disclosed except as
authorized by law. Finally, the Contractor shall retain the records described in this paragraph
throughout the performance of the work described in the Scope of Services, and at the conclusion
of said work, transfer to the Village, at no cost to the Village, all such records in the possession
of the Contractor and destroy any duplicates thereof. Records that are stored electronically must
be transferred to the Village in a format that is compatible with the Village's information
technology systems.

SCOPE
The Village hss requested ARCADIS G&M, Inc. to provide e�gineering design glaas for the
P�J� identified as South Cypress Drive Alley Way and Budget A11ey Way Drai.nage
Improvements. The South C;ypress Drive I3rainage Improvements will include exfiltration
tsenohes, swales and road regrading/pavement restoraxion to assist in flooding t�iat has occutred in
this area. Tbe Budget Alley Way Drainage Improvements will inolude swales and road
regrading/gravel road re�toration. Refer to Exhibit 1 and 2 attached In additian, the project will
include an area along Bayview Raad at Bayview Terrace far replacement/lining of aged drainage
InPe•
The following specific tasks will be performed by the Engineer:

Re: Real Estate Lease (File#281-1-2b) dated 7/11/2006 by and between FDG Flagler Station II LLC,
as Lessor ("Lessor") and Village of Tequesta, as Lessee ("Lessee")
Dear Sir or Madam:
We are writing to inform you that the terms of the referenced Lease provide you the option to renew the Lease for an
additional 12-month period (the "Renewal Term"), provided you notify the Lessor prior to the end of the current term.
To expedite your exercise of this option, we have provided below a place for you to acknowledge exercising this option
by returning a signed copy of this letter.
If you choose to exercise your option, your Lease will be renewed effective July 11, 2015 and extend through July 10,
2016. Also, in accordance with Section 2, the rental rate for the term immediately preceding the Renewal Term will be
increased by 5%; therefore your new annual rental rate for the Renewal Term will be $10,132.00, plus all sales or use
taxes levied by any governmental body for the use or occupancy of the Leased Premises. All other terms and conditions
of the Lease shall continue to be in effect during the Renewal Term. In anticipation of your renewal, you will be receiving
an invoice for the Renewal Term.
If you do not intend to exercise your option to renew this Lease, please do not return a copy of this letter and instead
please refer to the provisions of Paragraphs 13 and 14 of your Lease which advise you of your obligations and
requirements for cancellation.
Please return a copy of this letter signed and dated below, acknowledging and exercising your option to renew the
Lease, to my attention at the address written below.

Be It Enacted by the Legislature of the State of Florida:
Section 1. Section 119.0701, Florida Statutes, is created to read:
119.0701 Contracts; public records.—
(1) For purposes of this section, the term:
(a) "Contractor" means an individual.�partnership, corporation, or
business entity that enters into a contract for services with a public agencv
and is acting on behalf of the public agenc�provided under s. 119.011(2).
(b) "Public agency" means a state, county, district, authoritY, or muni-
cipal officer, or department, division, board�bureau commission, or other
se�arate unit of government created or established bv iaw•
(2) In addition to other contract requirements provided bv law, each
public agencv contract for services must include a�rovision that requires the
contractor to complv with �ublic records laws, specificall�
(a) Keep and maintain �ublic records that ordinarilv and necessarily
would be required by the public agencv in order to perf'orm the service.
(b) Provide the public with access to public records on the same terms and
conditions that the public agency would provide the records and at a cost that
does not exceed the cost �rovided in this cha�ter or as otherwise provided bv
law.
(c) Ensure that �ublic records that are exem�t or confidential and exempt
from public records disclosure requirements are not disclosed except as
authorized bv law.
(d) Meet all rec�uirements for retaining �ublic records and transfer, at no
cost� to the public agency all �ublic records in possession of the contractor
upon termination of the contract and destroy any du�licate �ublic records
that are exempt or confidential and exem�t from public records disclosure
rec�uirements All records stored electronically must be �rovided to the �ublic
a�ency in a format that _ is compatible with the information technoloQv

(3) If a contractor does not com�lv with a�ublic records request, the
public a ency shall enforce the contract provisions in accordance with the
contract.
Section 2. Section 215.971, Florida Statutes, is amended to read:
215.971 Agreements funded with federal or � state assistance.—
�� An agency agreement that provides state financial assistance to a
recipient or subrecipient, as those terms are defined in s. 215.97, or that
provides federal financial assistance to a subrecipient, as defined by
applicable United States Office of Management and Budget circulars,
must +'�� ������r+ �'��" include all of the followin�
�(�} A provision specifying a scope of work that clearly establishes the
tasks that the recipient or subrecipient is required to perform_��
�(� A provision dividing the agreement into quantifiable units of
deliverables that must be received and accepted in writing by the agency
before payment. Each deliverable must be directly related to the scope of
work and mxs� specify the required minimum level of service to be performed
and the criteria for evaluating the successful completion of each deliverable.
(c) A provision specifying the financial consequences that applv if the
recipient or subreci�ient fails to perform the minimum level of service
required by the agreement. The �rovision can be excluded from the
a�reement onlv if financial consequences are prohibited bv the federal
a�encv awardin the grant. Funds refunded to a state agencv from a
reci�ient or subrecipient for failure to perform as required under the
a�reement may be ex�ended onlv in direct support of the program from
which the agreement originated.
(d) A provision specifying that a recipient or subreci�ient of federal or
state financial assistance may expend funds only for allowable costs
resulting from obligations incurred during the specified agreement �eriod.
(e) A�rovision specifving that any balance of unobligated funds which
has been advanced or �aid must be refunded to the state agency.
(f� A provision specifying that an,y funds Aaid in excess of the amount to
which the recipient or subreci�ient is entitled under the terms and conditions
of the a�reement must be refunded to the state agency.
(�) Any additional information rec�uired pursuant to s. 215.97.
(2) For each agreement funded with federal or state financial assistance
the state agencv shall designate an em�loyee to function as a grant manager
who shall be responsible for enforcing performance of the a�;reement's terms
and conditions and who shall serve as a liaison with the recipient or
subrecipient.
