The subject property is located in the C -2 Zoning District in the Village of Tequesta. 2. The applicant has submitted all documents required by the Village's Code of Ordinances for Village Council site plan modification review and final action. 3. According to Village Code Section 78 -331, approval by the Village Council is required. 5. Under the provisions of the Village Code of Ordinances, the Village Council has the right, power and authority to act upon the request herein made. BACKGROUND: Per Section 78-177 (d) (14) of the Village Code, a shopping center is permitted as a special exception use in the C-2 zoning district upon approval by Council. At their April 9, 2015 public hearing, Village Council approved an application from Pet Supermarket for a Special Exception Use modification to an existing Shopping Plaza pursuant to Section 78-362 (3): "Large scale modification - any expansion, enlargement or revision to the site of an existing special exception use that does not qualify as either small scale interior or small scale exterior. The development order issued allows "the modification of an existing shopping center to raise the front elevation wall parapet from 17 to 23 feet for this tenant site." On May 21, 2015, the Planning & Zoning Board heard the subject site plan modification, and recommended approval continpent upon the following: to create consistency and aesthetic harmony across the front elevation, the existing wall sign for the adjacent occupant, Helix Urqent Care, must be relocated to the elevated parapet wall. IV. STAFF ANALYSIS: The subject application is requesting a Minor Site Plan Modification to an existing Shopping Plaza. Village Square Shoppes is located in the C-2 zoning district. The proposed application does not increase the square footage of the building footprint but does increase the height by raising the building's front elevation parapet wall from 17 ft. to 23 ft. to allow better visibility for signage (the proposed trademarked signage for Pet Supermarket has an overall area of 59.81 sf). The C-2 zoning district allows for a building height of up to 4 stories or 50 ft. The parapet wall would be raised only on the front elevation occupied by Pet Supermarket and by Helix Urgent Care to create continuity. The rest of the plaza will remain as existing. The application also proposes to remove the existing front entry swing door and side storefront windows of the Pet Supermarket tenant space and replace with a large automatic sliding entry door. FINAL REMARKS: The Applicant has provided existing and proposed elevations, proof of logo trademark registration and graphics for proposed signage, a statement of use and approval letters, as well as paint color samples for the parapet wall and a manufacturer's cut sheet for the automatic doors. The Applicant has also provided an Adjacent Occupant Consent Agreement in which Helix Urgent Care is the adjacent occupant. The agreement states that "in the event that the [Village] of Tequesta requires the relocation of the adjacent occupant's front entrance sign onto the renovated front fa�ade as a condition to issuing permits and/or approvals...Pet Supermarket shall be responsible for relocating the adjacent occupant's signage to the renovated fa�ade at Pet Supermarket's sole expense". The Planning & Zoning Board heard the subject site plan modification and recommended approval continpent upon the following: to create consistency and aesthetic harmony across the front elevation, the existing wall sign for the adjacent occupant, Helix Urgent Care, must be relocated to the elevated parapet wall.
