This cause came on to be heard upon the above application and the Village Council of the
Village of Tequesta having considered the evidence presented by the applicant and other interested
persons at a hearing called and properly noticed, and the Village Council of the Village of Tequesta
being otherwise duly advised,
THEREUPON, THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA FINDS
AS FOLLOWS:
1. The subject property is located in the C -2 Zoning District in the Village of Tequesta.
2. The applicant has submitted all documents required by the Village's Code of
Ordinances for Village Council site plan modification review and final action.
3. The application and all supporting documentation and presentation materials as
reviewed by the Village Council at its June 11, 2015 meeting, and as kept on file by
the Village, are made a part hereof and are hereby incorporated by reference.
4. According to Village Code Section 78 -331, approval by the Village Council is
required.
5. The applicants have applied for Site Plan Modification approval to raise the parapet
from 17 to 23 feet, and install signage for both their unit and the neighboring Helix
Urgent Care unit, and to modify entry doors and windows for their unit only, as set

forth in the application and all supporting documentation and presentation materials.
6. Under the provisions of the Village Code of Ordinances, the Village Council has the
right, power and authority to act upon the request herein made.
IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE VILLAGE
COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS:
The application for Site Plan Modification approval, Case No. SPM 04-15 with reference to
the above described property within the Village of Tequesta, Palm Beach County, Florida, to
approve a site plan modification in accordance with the application and all supporting
documentation and presentation materials attached hereto as Exhibit"A" is hereby APPROVED.
Please Note:
■ The term applicant(s) as used here shall include all successors and assigns.
■ The applicant's site plan approval shall expire in twelve (12) months unless a building permit
has been obtained in accordance with Sec. 78-334(9). If the building permit expires or is voided,
the site plan approval also expires or becomes void.

REQUEST: Application from Pet Supermarket Inc. for a minor site plan modification of an
existing shopping center to raise the building front elevation parapet wall from
17ft to 23ft for this tenant site allowing better visibility for their signage, and to
modify entrance doors and windows. The plaza owner is Tequesta Investors, LP.

III. BACKGROUND:
Per Section 78-177 (d) (14) of the Village Code, a shopping center is permitted as a special
exception use in the C-2 zoning district upon approval by Council. At their April 9, 2015 public
hearing, Village Council approved an application from Pet Supermarket for a Special Exception
Use modification to an existing Shopping Plaza pursuant to Section 78-362 (3): "Large scale
modification - any expansion, enlargement or revision to the site of an existing special exception
use that does not qualify as either small scale interior or small scale exterior. Such expansion,

enlargement or revision is subject to the requirements of this division". The development order
issued allows "the modification of an existing shopping center to raise the front elevation wall
parapet from 17 to 23 feet for this tenant site."
On May 21, 2015, the Planning & Zoning Board heard the subject site plan modification, and
recommended approval continpent upon the following: to create consistency and aesthetic
harmony across the front elevation, the existing wall sign for the adjacent occupant, Helix
Urqent Care, must be relocated to the elevated parapet wall.
IV. STAFF ANALYSIS:
The subject application is requesting a Minor Site Plan Modification to an existing Shopping
Plaza. Village Square Shoppes is located in the C-2 zoning district. The proposed application does
not increase the square footage of the building footprint but does increase the height by raising
the building's front elevation parapet wall from 17 ft. to 23 ft. to allow better visibility for
signage (the proposed trademarked signage for Pet Supermarket has an overall area of 59.81 sf).
The C-2 zoning district allows for a building height of up to 4 stories or 50 ft. The parapet wall
would be raised only on the front elevation occupied by Pet Supermarket and by Helix Urgent
Care to create continuity. The rest of the plaza will remain as existing. The application also
proposes to remove the existing front entry swing door and side storefront windows of the Pet
Supermarket tenant space and replace with a large automatic sliding entry door.

V. FINAL REMARKS:
The Applicant has provided existing and proposed elevations, proof of logo trademark
registration and graphics for proposed signage, a statement of use and approval letters, as well
as paint color samples for the parapet wall and a manufacturer's cut sheet for the automatic
doors.
The Applicant has also provided an Adjacent Occupant Consent Agreement in which Helix
Urgent Care is the adjacent occupant. The agreement states that "in the event that the [Village]
of Tequesta requires the relocation of the adjacent occupant's front entrance sign onto the
renovated front fa�ade as a condition to issuing permits and/or approvals...Pet Supermarket
shall be responsible for relocating the adjacent occupant's signage to the renovated fa�ade at
Pet Supermarket's sole expense".
The Planning & Zoning Board heard the subject site plan modification and recommended
approval continpent upon the following: to create consistency and aesthetic harmony across
the front elevation, the existing wall sign for the adjacent occupant, Helix Urgent Care, must
be relocated to the elevated parapet wall.
This development application met the requirements set on Section 78-368 notice of hearing.
The notice of hearing was advertised on June 1, 2015.

All construction, additions, and/or alterations within the Village, except in districts R-lA and R-1, must be
reviewed by the Planning & Zoning Advisory Board. The Planning & Zoning Advisory Board meets the
third Tlaursday of every month at 5:30 p.m., as needed in the Village Hall Council Chambers, 345 Tequesta
Drive. The applicant will be informed by letter of their scheduled meeting date.
The Planning and Zoning Advisory Board shall have general authority as outlined in Sec. 22.53. Powers and
duties. After review and recommendation by the Planning & Zoning Advisory Board, applications will be
heard by the Village Council for final approval. After approval by the Village Council, a building permit can

Dear [ADJACENT OCCUPANT]:
As part of a leasing transaction with Tequesta Investors, LP ("Landlord"} for certain space
located in the Viilage Square of Tequesta (the "Shopping Center") iden�.fied as Bay 229, Iacated
adjacent to the space occupied by [A.DJACENT OCCUPANT], Pet Supermarl�et, Inc. ("Pet
Supermarket") is considering the renovation of the front farade of Bay 229, and, as part of the
permit requirements for the renovation of the front far�ade of Bay 229, the City of Tequesta lnay
require that such a renovatian nf the front farade include that portion of the building occupied by
[ADJACENT OCCUPANT] (collectively, such woric is referred to herein as the "Front Fa�ade
Renovation").
If Pet Supei7narket proceeds with the Front Fa�ade Renovation, Pet Supermaxket will bear the
cost of the canstruction work. Furthermore, if the front fa�ade of [ADJACENT OCCUPANT]'s
space is renovated by Pet Supermarket as part of the Front Fa�ade Renovation, [ADJACENT
OCCUPANT] shall have the right, but not the obligation, to relocate its front entrance signage
from its e�sting Iocation (currently lacated under the roof overhang beneath the front fa�ade) to
the renovated front farade upon its completion, at [ADJACENT OCCUPANT)'s sole cost and
expense. Hawever, in the event that the City of. Tequesta requires the reloca�ion of [ADJACENT
OCCUPANT]'s front entrance signage onto the renovated front fa�ade as a condition to issuing
pernuts and/or approvals for the Frant Fa�ade Renavation and Pet Supermarlcet elects ta proceed
with the Front Farade Renovation, Pet Supermarlcet shall be responsible for relocating ''
[ADJACENT OCCUPANT]'s signage to t��e renovated front facade, at Pet 5upermarket's sole �
cost and expense. The Front Far�ade Renovation shall be conducted in such a manner as to not
unreasanably interfere with the quiet enjoyment of ADJACENT OCCUPANT]'s buszness �
operations conducted in [AD3ACENT OCCUPANT]'s space. However, [.ADJACENT
OCCUPANT] understands and agrees that the construcYion activities may inconvenience or
intei�fere wzth its business operation, particularly during that phase of the renovation of the front
fa�ade of [ADJACENT OCCUPANT]'s space, and that Pet Supermaxlcet shall not be responsible
for any disruption that znay occur zn connection with the Fraz�t Farade Renovation.
By executing this Agreement, [A_DJACENT OCCUPANT] hereby grants to Pet Supermaxket and
its cont�actors a Temporary Construction Easement on [ADJACENT OCCUPANT]'s space fox
the purpose of performing the Front Fa�ade Re�2ovation. The following constitutes Pet
Supermarket's exclusive warranty with respect to the renovation of [ADJACENT �

other good and valuable consideration, the receipt and sufficieney of which are hereby

Supermarket has no obligation to perform the Front Fa�ade Renovation, and [.ADJACENT
