Address: 221 U.S. Highway 1 Tequesta, Florida 33469 Legal Description: WATERWAY VILLAGE LOT A PCN: 60- 43- 40- 30 -05- 000 -0901 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Special Magistrate Hearing held July 23, 2015 and based on the evidence and testimony presented, entered an Order Assessing Fine. The following Findings of Fact, Conclusions of Law and Order are hereby entered. FINDINGS OF FACT 1. Respondent is the owner of the above - described property. 2. Respondent was represented at the hearing by Richard Aaronburg, managing general partner, the hearing; notice was proper. 3. By the April 2015 Order Finding Violation, the Special Magistrate ordered the Respondents to comply with sections 50 -213, 30 -336, 78 -410, 78 -399, 78 -700, 78 -701, 14 -152, 14 -154, 14 -153, 70 -44, 78 -177, 78 -745 of the Code of Ordinances of the Village of Tequesta on or before July 22, 2015. 4. Based upon the evidence, pictures, and testimony presented at the hearing on July 23, 2015, the Special Magistrate found that the property remained in violation of Sections 50 -213, 30 -336, 78- 410, 78 -399, 78 -700, 78 -701, 14 -152, 14 -154, 14 -153, 70 -44, 78 -177, 78 -745. CONCLUSIONS OF LAW The above - stated facts constitute a continuing violation of Sections 50 -213, 30 -336, 78 -410, 78- 399, 78 -700, 78 -701, 14 -152, 14 -154, 14 -153, 70 -44, 78 -177, and 78 -745 of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Special Magistrate that a Fine is of $150 is hereby assessed, at a rate of $150 per day, for the violations which have existed on the property beginning from July 22, 2015; and the fine amount shall continue to accrue until compliance is achieved. Respondents is also assessed $231.46 for administrative costs incurred by the Village at the July 23, 2015 hearing. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property upon which the violation exits and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes. Upon complying in any code compliance matter, it is always the responsibility of the Respondents to contact the Code Compliance Division at (561) 768 -0506 to request a reinspection of the property.
