SPECIAL VILLAGE COUNCIL
MEETING MINUTES
NOVEMBER 18, 1997
4:30 P.M.

I. CALL TO ORDER AND ROLL CALL
The Tequesta Village Council held a meeting at the Village Hall, 357 Tequesta Drive,
Tequesta, Florida, on Tuesday, November 18, 1997. The meeting was called to order at
4:35 p.m. by Mayor Elizabeth A. Schauer. A roll call was taken by Joann Manganiello,
Village Clerk. Councilmembers present were: Mayor Elizabeth A. Schauer, Vice Mayor
Carl C. Hansen, Councilmember Alexander W. Cameron, Councilmember Joseph N.
Capretta. Also in attendance were: Village Manager Thomas G. Bradford, Attorney Scott
G. Hawkins, Village Clerk Joann Manganiello, and Court Reporter Jane Pastore.
Councilmember Ron T. Mackail arrived at 4:44 p.m.
II. APPROVAL OF AGENDA
Councilmember Cameron made a motion to approve the Agenda as submitted.Vice
Mayor Hansen seconded the motion. The vote on the motion was:
Alexander W. Cameron - for
Joseph N. Capretta - for
Carl C. Hansen - for
Elizabeth A. Schauer - for
The motion was therefore passed and adopted and the Agenda was approved as
submitted.

III. COMMUNICATIONS FROM CITIZENS
Thomas Little, 486 Dover Roac} noted that most of the people in the community are
pleased and supportive of the Village Council's efforts in appealing the ENCON lawsuit
and encouraged the Village Council to move forward and not to back down.
Peggy Verhoeven, 18996 Point Drive, commented that she and others are extremely
supportive of continuing the lawsuit against ENCON. Should the Village get an Appeal, it
would need to count on Attorney Hawkin's brilliant strategy to prevail. She also .felt that
this was no longer a sewering issue but more of a personal vendetta between ENCON
and the Village. She encouraged the Village Council to go forward and to get back into
court again with every bit of evidence we have. She stated that we cannot lose this
lawsuit because the Village cannot survive these costs and associated future costs.
• IV. VILLAGE OF TEQUESTA V. LOXAHATCHEE RIVER ENVIRONMENTAL
CONTROL DISTRICT (ENCON) CLOSED-DOOR ATTORNEY/CLIENT
SESSION:
F.S. 286.011(8) allows the Village Council and the Village Manager to meet in a
Closed-Door Attorney/Client Session for the purpose of discussing settlement
negotiations or strategy sessions related to litigation.
Mayor Elizabeth A. Schauer announced:
a) The Attorney-Client Closed/Door Session
b) The estimated time is one and one half hours
c) The names of the persons attending:
Mayor Elizabeth A. Schauer, Vice Mayor Carl C. Hansen, Councilmember
Alexander W. Cameron, Councilmember Joseph N. Capretta, Councilmember Ron
T. Mackail, Village Manager Thomas G. Bradford, Attorney Scott G. Hawkins,
and Court Reporter Jane Pastore, Ley and Marsaa Court Reporters.
d) Members of the public in attendance were asked to vacate the Village Hall Council
Chambers at 4:40 p.m.

V. RECONVENE SPECIAL VILLAGE COUNCIL MEETING
a) Call to Order
The Special Village Council Meeting reconvened in the Village Council Chambers
and was called to order at 5:58 p.m. by Mayor Elizabeth A. Schauer. A roll call
was taken by Joann Manganiello, Village Clerk. Councilmembers present were:
Mayor Elizabeth A. Schauer, Vice Mayor Carl C. Hansen, Councilmember
Alexander W. Cameron, Councilmember Joseph N. Capretta, and Councilmember
Ron T. Mackail. Also reconvening were: Village Manager Thomas G.
Bradford, Attorney Scott G. Hawkins, Village Clerk Joann Manganiello, and
Court Reporter Jane Pastore.
b) Announcement of Termination of the Attorney/Client Session
Mayor Elizabeth A. Schauer announced the termination of the Attorney/Client
• Session.
VI. ANY OTHER MATTERS
There were no other items for discussion.
VII. ADJOURNMENT
Vice Mayor Hansen moved that the meeting be adjourned. Councilmember
Mackail seconded the motion. The vote on the motion was:

Carl C. Hansen - for
Ron T. Mackail - for
Elizabeth A. Schauer - for
The motion was therefore passed and adopted and the meeting was adjourned at
6:00 p.m.
