SPECIAL VILLAGE COUNCIL
MEETING MINUTES
DECEMBER 16, 1996
4:30 P.M.
•
I. CALL TO ORDER AND ROLL CALL
The Tequesta Village Council held a meeting at the Village Hall Council Chambers, 357
Tequesta Drive, Tequesta, Florida, on Monday, December 16, 1996. The meeting was
called to order at 4:30 p.m. by Mayor Ron T. Mackail. A roll call was taken by Joann
Manganiello, Village Clerk. Councilmembers present were: Mayor Ron T. Mackail, Vice
Mayor Elizabeth A. Schauer, Joseph N. Capretta, and Michael R. Meder. Also in
attendance were: Village Manager Thomas G. Bradford, Attorney Scott G. Hawkins,
Village Clerk Joann Manganiello, and Court Reporter Jane Pastore.
II. APPROVAL OF AGENDA
Councilmember Meder made a motion to approve the Agenda as submitted.
Councilmember Capretta seconded the motion. The vote on the motion was:
Ron T. Mackail - for
Elizabeth A. Schauer - for
Joseph N. Capretta - for
Michael R. Meder - for
The motion was therefore passed and adopted and the Agenda was approved as
submitted.

III. COMMUNICATIONS FROM CITIZENS
There were no communications from citizens.
IV. DOROTHY M. CAMPBELL OF OZ OF TEQUESTA, INC. V. VILLAGE OF
TEQUESTA CLOSED-DOOR ATTORNEY/CLIENT SESSION:
F.S. 286.011(8) allows the Village Council and the Village Manager to meet in a
Closed-Door Attorney/Client Session for the purpose of discussing settlement
negotiations or strategy sessions related to litigation expenditures.
Mayor Ron T. Mackail announced:
• a) The Attorney/Client Closed-Door Session
b) The estimated time is one hour
c) The names of the persons attending:
Mayor Ron T. Mackail, Vice Mayor Elizabeth A. Schauer, Councilmember Joseph
N. Capretta, Councilmember Michael R. Meder, Scott G. Hawkins, Esq., Thomas
G. Bradford, Village Manager, and Jane Pastore, Court Reporter, Ley and Marsaa
Court Reporters.
d) The public in attendance vacated the Village Hall Council Chambers and attendees
commenced the Attorney/Client Closed-Door Session at 4:32 p.m.
V. RECONVENE SPECIAL VILLAGE COUNCIL MEETING
a) Call to Order
The Special Village Council Meeting reconvened in the Village Council Chambers
and was called to order at 5:27 p.m. by Mayor Ron T. Mackail. A roll call was
taken by Joann Manganiello, Village Clerk. Councilmembers present were:
Mayor Ron T. Mackail, Vice Mayor Elizabeth A. Schauer, Joseph N. Capretta,
and Michael R. Meder. Also reconvening were: Village Manager Thomas G.

b) Announcement of Termination of the Attorney-Client Session
Mayor Ron T. Mackail announced the termination of the Attorney/Client Session.
VI. ANY OTHER MATTERS
A discussion ensued as to whether or not to have "ANY OTHER MATTERS" as an
agenda item on a Special Village Council Meeting Agenda. Village Manager Bradford
noted that problems would be less likely if "ANY OTHER MATTERS" was omitted.
He also noted that the Village Charter states that the Village Council can only take action
on those items that appear on the notice relative to what the Special Village Council
Meeting is about.
Vice Mayor Schauer agreed that "ANY OTHER MATTERS" should be omitted. She
• stated that having "ANY OTHER MATTERS" on a Special Village Council Meeting
Agenda may give the public the perception that something would be discussed which they
did not know about and would not be privy to. By omitting "ANY OTHER MATTERS"
from the Agenda, it would eliminate doubt in everyone's mind that they would be missing
any additional discussion. Councilmember Meder stated that "ANY OTHER MATTERS"
gives the Village Council the opportunity to discuss unforeseen items which might arise.
Mayor Mackail felt that the importance of a Closed-Door Attorney/Client Session was
such that "ANY OTHER MATTERS" would be irrelevant at the time and should not be
included on a Special Village Council Closed-Door Attorney/Client Session Agenda..
Councilmember Capretta asked if Closed-Door Attorney/Client Sessions could only be
held within a Village Council Meeting. Attorney Hawkins responded that Closed-Door
Attorney/Client Sessions must be part of an open meeting.
After further discussion, it was decided to keep "ANY OTHER MATTERS" as an agenda
item on a Special Village Council Meeting Agenda; however, it would be placed prior to
the Closed-Door Attorney/Client Session agenda item so that the public would be in
attendance for the same. The possibility of limiting the time for discussion of "ANY
OTHER MATTERS" was also considered.

VII. ADJOURNMENT
Councilmember Capretta moved that the meeting be adjourned. Councilmember
Meder seconded the motion. The vote on the motion was:
Ron T. Mackail - for
Elizabeth A. Schauer - for
Joseph N. Capretta - for
Michael R. Meder - for
The motion was therefore passed and adopted and the meeting was adjourned at
5:39 p.m.
