ROGER & BETTINA FARBER, Respondents. RE. Violation of Chapter 30, Article II, Section 30 -33 of the Code of Ordinances of the Village of Tequesta. Address: 207 Fairway East Tequesta, Florida 33469 Legal Description: TEQUESTA LT 231 PCN: 60- 42- 40- 26 -01- 000 -2310 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Hearing held on August 27, 2015, and based on the evidence and testimony presented, enters an Order Finding Violation and Setting Status Hearing. The following Findings of Fact, Conclusions of Law and Order are hereby entered: FINDINGS OF FACT 1. Respondents are the owners of the above - described property. 2. Respondent, Benjamin Dorsey, was present at the hearing; there was a finding of proper notice. 3. Based upon the evidence, pictures and testimony presented at the hearing on August 27 2015, the Special Magistrate found that the property remained in violation of Section 30- 33. CONCLUSION OF LAW The above - stated facts constitute a violation of Section 30 -33 of the Code of Ordinances of the Village of Royal Palm Beach. ORDER Respondents are hereby ordered to comply with Section 30 -33 of the Code of Ordinances of the Village of Tequesta. A Status Hearing is set for September 24, 2015 at 10:00 a. m. Page 1 of 2 Respondents must bring the fencing and vegetation at the subject property into compliance with section 30 -33 by September 10, 2015 or a fine of $50 per day may be assessed for each day the fence and vegetation are not compliant beyond September 20, 2015. Respondents must bring the screen enclosure at the subject property into compliance with section 30 -33 by September 23, 2015 or a fine of $50 per day may be assessed for each day the screen enclosure is not compliant beyond September 23, 2015. Respondent is assessed $183.48 for administrative costs incurred by the Village prior to August 27, 2015. Should you violate the same Section of the Code again, you may be subject to a fine of up to $500.00 per day for such repeat violation. Additionally, the Code Inspector is not required to give a reasonable time to correct the repeat violation and the case may be presented to the Special Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing. Please take notice that you must appear at the Status Hearing which will be held on the September 24, 2015 at 10:00 a.m. at Village Hall Council Chambers, 345 Tequesta Drive, Tequesta, Florida 33469 unless the Code Enforcement Officer certifies that you have timely brought your property into compliance. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property upon which the violation exits and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes.
