CALL TO ORDER AND ROLL CALL The Tequesta Village Council held a special meeting at the Village Hall, 357 Tequesta Drive, Tequesta, Florida, on Tuesday, July 30, 1996. The meeting was called to order at 5:37 p.m. by Mayor Ron T. Mackail. A roll call was taken by Joann Manganiello, Village Clerk. Councilmembers present were: Mayor Ron T. Mackail, Vice Mayor Elizabeth A. Schauer, Joseph N. Capretta, and Michael R. Meder. Also in attendance were: Village Manager Thomas G. Bradford, Attorney Scott G. Hawkins sitting in for Village Attorney John C. Randolph, Village Clerk Joann Manganiello, and Court Reporter Brenda Laufer. II. APPROVAL OF AGENDA Village Manager Thomas G. Bradford noted for the record that the -name of the Court Reporter, as noted on page 2 of the Agenda, is not Jane Pastore but, Brenda Laufer, from the same firm. Councilmember Meder made a motion to approve the Agenda as amended. Councilmember Schauer seconded the motion. The vote on the motion was: Joseph N. Capretta - for Ron T. Maclcail - for Michael R, Meder - for Elizabeth A. Schauer - for The motion was therefore passed and adopted and the Agenda was approved as amended. ORDINANCE - SECOND READING -RESCINDING ORDINANCE NO. 460, AS AMENDED, WHICH ORDINANCE PROVIDED FOR THE ESTABLISHMENT OF A LOCAL LAW RETIREMENT PLAN AND TRUST FOR THE FIREFIGHTERS OF THE VILLAGE OF TEQUESTA, AND HEREBY ADOPTING THE "EMPLOYEES' PENSION TRUST FUND" AND THE PLAN DOCUMENT RELATING THERETO; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. Attorney Scott G. Hawkins read the Ordinance on Second Reading by title. Mayor • Mackail asked for comments from theVillage Manager. Village Manager Bradford noted that the Memorandum of July 25, 1996, sent to the Village Council as a cover to this Agenda Item, details the four items that the Division of Retirement asked the Village to include within the Plan. The Division asked the Village to amend the Plan in response to the Village Manager's request for review of the same to determine whether the Plan complied with the provisions of Chapter 185. Village Manager Bradford noted that he had made all of the changes and that the changes were included in the Actuarial Study, a copy of which was also provided to the Village Council with their back-up materials. This was also required to be amended based upon the changes that have taken place since the opt-out actions of the Village Council on December 14, 1995. The Village Attorney had reviewed the same changes and found them to be minor in scope which would not require another reading. Village Manager Bradford concluded saying that everything seems to be in order and finally, after seven months, the Village can bring this issue to an end. The Village Manager recommended that the Village Council adopt the Ordinance on Second Reading. There was no further discussion by the Village Council. Councilmember Schauer made a motion to approve the Ordinance on Second Reading. Councilmember Meder seconded the motion. Schauer - for The motion was therefore passed and adopted and the Ordinance was approved on Second Reading. V. VILLAGE OF TEQUESTA V. TOWN OF JUPITER (WATER RATE DISPUTE) CLOSED-DOOR ATTORNEY-CLIENT SESSION: F.S. 286.011(8) allows the Village Council and the Village Manager to meet in a Closed-Door Attorney-Client Session for the purpose of discussing settlement negotiations or strategy sessions related to litigation expenditures. • Mayor Ron T. Mackail, Councilmember Michael R. Meder, and Vice Mayor Elizabeth A. Schauer; Attorney Scott G. Hawkins, Thomas G. Bradford, Village Manager; and Brenda Laufer, Court Reporter. d) Attendees retired to the Conference Room at 5:44 p.m. VI. RECONVENE SPECIAL VILLAGE COUNCIL MEETING a) Call to Order The Special Village Council Meeting reconvened in the Village Council Chambers and was called to order at 6:45 p.m. by Mayor Ron T. Mackail. Mackail announced the termination of the Attorney-Client Session at 6:45 p.m.and noted, for the record, that the Special Village Council Meeting has reconvened. VII. ANY OTHER MATTERS There were no items for discussion. • VIII. ADJOURNMENT Councilmember Meder moved that the meeting be adjourned. Councilmember Schauer seconded the motion.
