SPECIAL VILLAGE COUNCIL
MEETING MINUTES
APRIL 23, 1996
I. CALL TO ORDER AND ROLL CALL
The Tequesta Village Council held a meeting at the Village Hall, 357 Tequesta Drive,
Tequesta, Florida, on Tuesday, Apri123, 1996. The meeting was called to order at 7:02
P.M. by Mayor Ron T. Mackail. A roll call was taken by Joann Manganiello, Village
Clerk. Councilmembers present were: Mayor Ron T. Mackail, Vice Mayor Elizabeth A.
Schauer, Joseph N. Capretta, Carl C. Hansen, and Michael R. Meder. Also in attendance
were: Village Manager Thomas G. Bradford, Village Attorney John C. Randolph, and
Village Clerk Joann Manganiello.
II. APPROVAL OF AGENDA
Vice Mayor Schauer made a motion to approve the Agenda as submitted. Councilmember
Meder seconded the motion. The vote on the motion was:

Elizabeth A. Schauer - for
Joseph N. Capretta - for
Carl C. Hansen - for
Michael RMeder - for
The motion was therefore passed and adopted and the Agenda was approved as
submitted.
III. COMMUNICATIONS FROM CITIZENS
There were no communications from citizens.

IV. VILLAGE OF TEQUESTA V. TOWN OF JUPITER (WATER RATE DISPUTE)
CLOSED-DOOR ATTORNEY-CLIENT SESSION:
F.S. 286.011(8) allows the Village Council and the Village Manager to meet in a
Closed-Door Attorney-Client Session for the purpose of discussing settlement
negotiations or strategy sessions related to litigation expenditures.
Mayor Mackail requested Village Attorney Randolph to explain, for the benefit of the
public and the Village Council, the specific reason and purpose for calling this meeting, as
well as, to advise the Village Council accordingly in regard to the procedures that are to
be followed.
Attorney Randolph stated that the reason this meeting was scheduled is because of the
announcement of the Village Council at a previous meeting of its intent to hold an
Attorney-Client Session, which pursuant to 286.011 F.S., is exempt from becoming a
public meeting under certain specific standards that are set forth in the Statute. The
Statute requires that such a meeting commence at a regularly called public meeting, such
as that which we are having here. The Statute provides that the subject matter of the
meeting shall be confined to settlement negotiations or strategy sessions relating to
litigation expenditures. The litigation that the Village Council announced that they wished
to discuss is the Village of Tequesta v. Town of Jupiter Case. He also advised that the
entire session will be recorded by a certified Court Reporter who will record the time of
commencement and termination of the Session and all discussions and proceedings, the
names of all persons present, and the names of all persons speaking. No portion of this
Session will be "offthe record." The Court Reporter's notes shall be fully transcribed and
filed with the entity's (Village of Tequesta) Clerk within a reasonable time after the
Meeting. That transcript shall be made a part of the public record upon conclusion of the
litigation, so that the public will, ultimately, have an opportunity to be able to see what
was transacted at that Meeting.
Attorney Randolph noted that the Village has already given Public Notice of the time and
date of this Attorney-Client Session and the names of the persons who will be attending.
He advised Mayor Mackail that the next order of business would be for the Mayor, as
chairperson, to announce the commencement and estimated length of the Attorney-Client
Session and the names of the persons attending. In conclusion, Attorney Randolph stated
that this is really the sole purpose for which the Meeting has been called this evening, and
anticipated that this would be the sole item for discussion.

Mayor Ron T. Mackail announced:
a) The Attorney-Client Closed-Door Session
b) The estimated time is one-hour and thirty minutes
c) The names of the persons attending:
Councilmember Joseph N. Capretta, Councilmember Carl C. Hansen, Mayor Ron
T. Mackail, Councilmember Michael R. Meder, and Vice Mayor Elizabeth A.
Schauer; John C. Randolph, Village Attorney; Thomas G. Bradford, Village
Manager; and Mary Lesson, Court Reporter.
d) Attendees retired to the Conference Room at 7:07 P.M.
V. RECONVENE SPECIAL VILLAGE COUNCIL MEETING
a) Call to Order
The Special Village Council Meeting reconvened in the Village Council Chambers
and was called to order at 8:54 P.M. by Mayor Ron T. Mackail. A roll call was
taken by Joann Manganiello,Village Clerk. Councilmembers present were: Mayor
Ron T. Mackail, Vice Mayor Elizabeth A. Schauer, Joseph N. Capretta, Carl C.
Hansen, and Michael R.Meder. Also present were: Village Manager Thomas G.
Bradford, Village Attorney John C. Randolph, and Village Clerk Joann
Manganiello.
b) Announcement of Termination of the Attorney-Client Session
Mayor Ron T. Mackail announced the termination of the Attorney-Client Session
and noted, for the record, that the Special Village Council Meeting has
reconvened. Attorney Randolph reiterated that the Village Council has
reconvened and announced the termination of the Attorney-Client Session and,
therefore, has met all the requirements of the Florida Statute.
VI. ANY OTHER MATTERS
There were no items for discussion.

VII. ADJOURNMENT
Vice Mayor Schauer moved that the meeting be adjourned. Councilmember Meder
seconded the motion. The vote on the motion was:

Joseph N. Capretta - for
Carl C. Hansen - for
Michael R. Meder - for
The motion was therefore passed and adopted and the meeting was adjourned at
8:56 P.M.
