Attached: • Ord 6-15 • Res 87-15 RESOLUTION 87-15 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, CALLING FOR THE GENERAL MU1vICIPAL ELECTION TO BE HELD TUESDAY, MARCH 16, 2016, AND IF NECESSARY, THE MUNICIPAL RUN-OFF ELECTION TO BE HELD TUESDAY, MARCH 29, 2016, FOR THE PURPOSE OF ELECTING COUNCIL SEATS 1, 3 AND 5 FOR TWO YEAR TERMS; REQUESTING THE PALM BEACH COUNTY SUPERVISOR OF ELECTIONS CONDUCT THE ELECTION; DESIGNATING POLLING LOCATIONS; NAMING THE CANVASSING BOARD; ESTABLISHING ELECTION PROCEDURES; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, Ordinance 6-15 allows the Village to hold its election concurrently with the Presidential Preference Primary which is March 16, 2016; and designating a filing period for such office fram Noon on Monday, November 23, 2015 through and not later than Noon on Monday, December 7, 2015; and WHEREAS, Section 2.01 of the Village Charter provides that Council Members shall be elected at large to Seats 1, 3 and 5 in the even years; and WHEREAS, the Village Council of the Village of Tequesta requests the Palm Beach County Supervisor of Elections conduct the municipal election; and WHEREAS, Chapter 2, Article 5 of the Village Code of Ordinances provides that the Village Clerk, or designee, along with the Palm Beach County Supervisor of Elections, or designee, and one Council Member (which can include the Mayor) whose position is either not scheduled to be voted upon or who is unopposed at the election being canvassed, shall be appointed to serve as the Canvassing Board; and WHEREAS, Chapter 2, Article V of the Village Code of Ordinances further provides that the Village Clerk may appoint or hire as many inspectors of election, and other election workers as deemed necessary to conduct elections in the Village; and WHEREAS, the Village Council of the Village of Tequesta desires to designate polling locations, and esta.blish election procedures for the General Municipal Election on March 16, 2016; and if necessary a Municipal Run-off Election on March 29, 2016. NOW, THEREFORE, BE IT RESOLVED BY TAE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. Notice is hereby given that a General Municipal Election is scheduled to be held on Tuesday, March 16, 2016; and if necessary, a Municipal Run-off will be held on Tuesday, March 29,2016. The polling locations will be: Precinct 1078, Precinct 10$8, and Precinct 1094 Tequesta Recreation Center, 399 Seabrook Road Precinct 1112,1116,1118, and 1120 Village Ha11 Chambers, 345 Tequesta Drive The polls will be open from 7:00 a.m. to 7:00 p.m. Section 2. In accordance with the provisions of Section 3.04 of the Village Charter, the Village Clerk shall be the Clerk of Elections and shall supervise the conduct of the General Municipal Election and Run off Election in accordance with the State of Florida Election Laws and the Village of Tequesta Code of Ordinances. Section 3. The Pa1m Beach County Supervisor of Elections is hereby requested to conduct the election as set forth in the Vote Processing Equipment Use and Election Services Agreement, effective January l, 2016. Section 3. The Village Clerk shall authorize payment of the Inspectors of Election per the rates in effect by the Palm Beach County Supervisor of Elections for poll workers, inspectors, clerks, precinct advisors, and deputies. Section 4. Pursuant to Chapter 2, Article V of the Village Code of Ordinances, the Village Clerk, or designee, along with the Palm Beach County Supervisor of Elections, or designee, and one Council Member (which can include the Mayor) whose position is either not scheduled to be voted upon or who is unopposed at the election being canvassed, sha11 be appointed to and constitute the Village of Tequesta's Canvassing Board for the purpose of conducting the General Municipal Election and, if necessary, the Runoff Election. Section 5. 'The provisions of the Florida Elections Code relating to absentee ballots sha11 apply to the General Municipal Election and, if necessary, the Run off Election, allowing the Palm Beach County Supervisor of Elections to canvass the absentee ballots, and attend the Logic and Accuracy Test, for the Village of Tequesta. Section 6. The Palm Beach County Supervisor of Elections is hereby designated to ta.bulate the ballots cast at the General Municipal Election March 16, 2016, and, if necessary, the Run-off Election March 29, 2016. Section 7. The Village Clerk is hereby directed ta post this Resolution in the Village Administrative Offices immediately after passage, and provide a certified copy to the Pa1m Beach County Supervisor of Elections. 2 ORDINANCE NO. 6-15 AN ORDINANCE OF THE VII,LAGE COUNCIL OF 1'HE VII.LAGE OF TEQUESTA, FLORIDA, AMENDING T� =VILLAGE CODE OF ORDI- NANCES AT CHAPTER 2. WHEREAS, Article II, Section 2.01 of the V'illage Charter sets the date for the village election as the second Tuesday in March of each year; aad WHEREAS, Article II, Section 2.02 of the V'illage Charter and Article V, Se�ction 2-271 of the V'illage Code set the dates for qualifying for village elections as noon on the last Tue�ay in January uatil noon on the second Tuesday in February; and WHEREAS, in 20I6, the federal presidential prefere�uce primary election will fall on the third Tuesdap of March; and WHEREA3, in yeazs of statewide or countywide presidentisi preference primary elec- tians and beginning in 2016, the V'illage Council desires to move the village's el�tion date to a date concurrent with the presidential preference primmy ele�tions; and WHEREAS, holding the village's election on a date concurrent with the preside�tial preference primary election requires the village to adopt an ordinance that establishes a munici- pal election date, election qualifying period, and run off election date for years when the village holds its municipal elections concunrent with the presidential preference primary election, and WHEREAS, seGtions 100.3605, 101.75, and 166.021, Florida SY�artutes, perrmit the vil- , lage to amend its code of ordin�encss to change the date of its village election and qualifying period by ordinance and without referendum, aad WHEREAS, the �llage Cow�cil believes these amendments to the code of ordinaaces are in the best interests of the citizens of the V'illage af Tequesta. -1- NOW, THEREFORE, BE IT ORDAINED BY TSE VII,LAGE COUNCII.
