BACKGROUND Tequesta Oaks, a Mixed-Use development, was approved in July, 1996. The 13.6-acre site includes 158 residences and a restaurant. The residences are fee simple townhomes on 26 ft x 80 ft platted lots. The restaurant was designed as a 5,900 sf free-standing building that was originally the McCarthy's restaurant. The streets were organized into a series of blocks with a main entrance road toward Tequesta Drive. To further reinforce the character of the community, special attention was given to landscaping and the planting of Live Oaks. Even though a variety of palm trees were also provided, the emphasis in the development was on large canopy trees. The original approved site plan (July 1996) was modified in November 1996 and luly 1997. The site modifications included changes in the landscape plan and other site plan features (lighting fixtures, pavers, etc.j. Please see attached development and landscape plans which include the last approved 1997 revisions. The subject minor site plan modification includes the removal of one (1) Oak tree and replacement with three (3) Sable Palms located at 44 Live Oak Circle. The justification statement provided by the applicant states the following "The homeowner Association would like to remove the one (1J tree immediately as it is deemed a safety issue as a tripping hazard. The Homeowners Association has a future goal to provide a revised overall landscape plan with a clear process and vision for the removal and replacement of future trees requiring replacement." Please see attached applicant lustification Statement. IV. STAFF ANALYSIS The subject application proposed to remove one (1) Oak tree and replace it with three (3) 12' clear trunk Sable Palms. Also, the Justification Statement indicates "The Homeowners Association has intention to keep the Oak tree and had an arborist come out to root prune the tree. The arborist recommended the removal of this tree since the roots that would need pruning are shallow structural roots close to trunk of the tree. Cutting the structural roots of a tree creates an even bigger safety issue for the community since it may result in inadequate root anchoring which increase the likelihood that the tree may fall over with a strong wind." Per the Village's Code Sec. 78-404, "If palm trees are planted in lieu of canopy trees, the palm trees may be clustered in groups of three and three palm trees shall be required for each canopy tree required under this section." The application complies with this requirement. The minor site plan application was reviewed by Mr. Steve Parker, ASLA, the Village's Consultant Landscape Architect. Please see attached review and recommendation letter. Mr. Parker agrees that the tree should be removed and replaced due to the shallow root system and the related health safety factor. The subject Live Oak tree is located on 44 Live Oak Circle, and not on Tequesta Oak Drive. Introducing Sable Palms to this particular area does not negatively impact the existing landscape pattern. Palm trees are consistent with the character of the landscaping in the Live Oak Circle area (See Site Photos). On the other hand, the Live Oak trees located on Tequesta Oak Drive provide a green and lush corridor that enhances the character and strengthens the identity of this community. However, as was pointed out by the Community Development Department on various meetings with the applicant, since Tequesta Oaks was approved as a master site plan development, no further piece- meal minor site plan applications will be processed. The Department recommends the preparation of 2 Department of Community Development—Staff Report —Tequesta Oaks — Planning & Zoning Board 11-19-15 a master site plan modification that will identify all trees for potential removal and replacement. This would allow a comprehensive review and approval, so that any time a tree needs to be replaced, it shall be replaced in accordance with the approved master site plan. The proposed recommendation will provide the following long-term benefits: 1. Protect the community's character. The original site plan approval for Tequesta Oaks emphasized a community with large canopy trees. Numerous studies have shown the direct relationship between home value, public health, and street trees. In her article "City Trees and Property Values," Kathleen L. Wolf writes that there is a home price increase between 6-9 percent when there is good tree cover in a neighborhood, and a 10-15 percent increase when there are mature trees in a high income neighborhood. 2. Streamline approval process. As the community ages, it is possible that additional trees will need to be replaced. Since there will be an approved Master Site Plan Modification, each removal and replacement can be approved and permitted without applying for a development application that would need to be heard by the Planning and Zoning Board. According to applicant Justification Statement "The Tequesta Oaks Homeowners Association acknowledges the need for a long-term tree replacement plan that incorporates a streamlined approval process. The community would like to take the time they need to coordinate both budgets and resident input. The residents are proud of their community and take great care in rts maintenance. They will take the time they need to receive input from its residents to create a unified vision for the landscape plan." V. FINAL REMARKS This development application met the requirements set forth in Section 78-334, Notice of Hearing. The notice of public hearing was advertised in the Palm Beach Post on November 9, 2015. Once the application has been reviewed and approved by the Planning & Zoning Board, the applicant is required to apply for a building permit, prior to commencement of tree removal and installation. As was indicated in the analysis, no further piecemeal minor site plan applications will be processed. The address of the affected area of the site plan modification is at 44 Live Oak Circle in the Tequesta Oaks Subdivision. No other requests are associated with this amendment. The development plan and landscape plan are to remain as approved except the one replacement of an oak tree above. The Homeowners Association would like to remove the one (1) tree immediately as it is deemed safety issue as a tripping hazard. The Homeowners Association has a future goal to provide a revised overall landscape plan with a clear process and vision for the removal and replacement of future trees requiring replacement. BACKGROUND Tequesta Oaks is a planned development community of fee simple duplex's consisting of 158 residences (See Exhibit A: Location Map). Typical of urban style communities 10- 20 years old with lush canopy trees, the residences of Tequesta Oaks have had continual repair costs from the maturing of 211 oak trees that were originally installed when the community was built. The oak trees are located in the common areas of the Homeowners Association, the privately owned lots and within the public right-of-way of Tequesta Oaks Drive. Now as the trees are maturing many or the roots are extending out of the allotted space or they have suffered disease or damage. The approved landscape plans are dated 1997. The approved landscape plans contain 87% of plants indigenous to South Florida. This request replaces one (1) native oak tree with three (3) native sable palm trees further exceeding the native species landscape requirement of code. RECOMMENDATION FOR OAK REMOVAL This request is to take out one (1) oak tree, which is of immediate concern, and then replace it with three (3) sable palms. The existing oak tree has been lifting up the sidewalk and it is Tequesta Oaks - Justification Statement I September 15,2015 considered a trip hazard. The Homeowners Association has intention to keep the oak tree and had an arborist come out to root prune the tree. The arborist instead recommended the removal of this tree since the roots that would need pruning are shallow structural roots close to truck of the tree. Cutting the structural roots of a tree creates an even bigger safety issue for the community since it may result inadequate root anchoring which increases the likelihood that the tree may fall over with a strong wind(See attached Exhibit B: Existing Condition) The roots on the tree of immediate concern are large in diameter, close to the truck and shallow. According to the University of Florida the roots that are one (1) inch to three (3) inches are considered major structural roots. When root pruning is necessary, the general guideline is to preserve the roots within about five times the trunk diameter. For example if the truck is 24" diameter at breast height (dbh), than do not prune roots within ten (10) feet of the truck. In addition, the shallow roots are an indicator of soil conditions below that may be unsuitable for the tree and the tree may currently have inadequate root anchoring system. Due to the indicators above it is recommended for the oak tree to be removed and replaced with three (3) sable palms. The tree recommended for removal is sixteen (16) inches diameter at breast height (dbh). It is not a specimen tree, historic tree or endangered tree. The replacement of the oak tree will not affect the overall design of the community since it is located on a side street (See Exhibit C: Oak Locations) RECOMMENDATION FOR REPLACEMENT The replacement trees recommended are three (3) Sable Palms. (See Exhibit D) The Palms adhere to the principles of Florida-friendly landscape design, conform to the existing landscape design and meet the Village of Tequesta code. • The species selection of Sable Palm Sable palmetto is consistent with the intent of the landscape code (Sec. 78-394 (a) (1)) of the Village of Tequesta. The species chosen is a native species and conforms to Principle #1 of the Florida-friendly landscape design. The Sable Palm is the right plant of the right place. It will tolerate the small soil area provided. It will provide a physical delineation between the road and the entry to the home at 44 Live Oak Circle, it is low maintenance, and matches the existing plants watering needs. • The replacement of the Oak Tree with Sable Palms conforms to the theme of the existing landscape design. The Sable Palms will match the current existing sable palms planted on the northwest corner of Live Oak Circle. The replacement palms will be at a 12' Clear Truck (CT) which will blend with the existing landscape. 2�CH No. 15-0808 Tequesta Oaks — Justification Statement I September 15,2015 • The three Sable Palms will meet the standards of the Village Tequesta Landscape Code (Sec. 78-404) by meeting the 12' Clear Truck (CT) requirement and by providing three palms in lieu of the one (1) canopy tree. SUCCESSIVE TREE REMOVAL AND REPLACEMENT The Tequesta Oaks Homeowners Association acknowledges the need for a long-term tree replacement plan that incorporates a streamlined approval process. The community would like to take the time they need to coordinate both budgets and resident input. The residents are proud of their community and take great care in its maintenance. They will take the time they need to receive input from its residents to create a unified vision for the landscape plan. The Homeowners Association budget is adopted on an annual basis and may be able to phase the costs for adjusting the overall site plan, obtaining approvals from the Village and the actual tree replacement. The homeowners association understands that an overall landscape plan will reduce future costs for replacements by allowing the approval to go straight to permit. CONCLUSION The Applicant is requesting is requesting approval of a minor landscape plan modification to allow the removal of one (1) oak tree to be replaced with three (3) sable palm trees. Tequesta Oaks currently has 211 oak trees and the one requested for removal is deemed is a safety hazard to the community due to its trip hazard and shallow root system. Keeping aligned with Florida-friendly standards and the Village of Tequesta code, the oak tree will be replaced with 3 Sable Palm trees that meet the design intent of the location. The community will work toward an overall design solution that will maintain their urban forest while keeping in mind wind resistance and soil requirements for trees based on maturity.
