AMENDED FINAL ORDER GRANTING MINOR SITE PLAN MODIFICATION
This cause came was heard upon the above application and the Tequesta Planning and Zoning
Board considered the evidence presented by the applicant and other interested persons at a hearing
called and properly noticed. The Planning and Zoning Board being otherwise duly advised,
THEREUPON, THE TEQUESTA PLANNING AND ZONING BOARD F[NDS AS
FOLLOWS:
l. The subject property is located in the mixed-use (MU) zoning district in the Village of
Tequesta.
2. The applicant submitted all documents required by the Village's Code of Ordinances for
Planning and Zoning Board review and final action.
3. The application, all supporting documents, and presentation materials were reviewed by
the Planning and Zoning Board at a meeting on November 19, 2015, and as kept on file
by the Village, are made a part of this order and are hereby incorporated by reference.
4. According to section 22-53, approval by the Village Planning and Zoning Board is re-
quired because the modification does not exceed ten thousand dollars in estimated costs
and does not change the footprint, height, number of stories or square footage of any
building.
5. The applicant has applied for approval to remove one oak tree and replace it with three
(clustered) sable palms.
6. Under the Village Code of Ordinances, the Planning and Zoning Board has the right,
power and a�ithority to act upon the Applicant's request.
IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE
PLANNING AND ZONING BOARD OF THE V[LLAGE OF TEQUESTA,
FLORIDA, AS FOLLOWS:
The application for minor modification of an existing site plan, Case No. SPM 1 1-15, regarding the
above-referenced property in the Village of Tequesta, Palm Beach County, Florida, attached to this
order as Exhibit A to remove one live oak tree and replace it with three (clustered) sable palms is
hereby APPROVED.
It is noted that any future site plan modifications may require a inaster site �lan modification.
Any future replacement of multiple trees and landscaping at this site �4 Ynav r quire a master site
plan modification, which identifies all trees suitable for potential removal and replacement. These
steps will ensure more comprehensive review and approval by the Planning and Zoning Board.
Please note:
■ The term czppliccznt(s) as used here shall include all successors and assigns.
■ The applicant's site plan approval shall expire in twelve (12) months unless a building permit
has been obtained in accordance with Sec. 78-334(9). If the building permit expires or is voided,
the site plan approval also expires or becomes void.
