Or �r r To: Mr. Couzzo From: Brad Gomberg Date: 11/23/2015 Re: Comcast Agreements The Water Plant, Public Works, and Parks and Rec have been utilizing Comcast internet services for Internet and Network connectivity for quite some time. These services were offered free to the Village since their inception as part of a franchise agreement between the Village and Comcast. As of 2007, local franchise agreements are no longer allowed by the state and Comcast has since approached us about their expiration, and the likelihood that the gratis service could be disconnected at any time. Although I has been 8 years and our connections were still technically online, they experience constant disconnects and equipment issues. The circuits are not only slow by today's standards, they are not serviced by the typical support department and the process of getting repairs is extremely time consuming and cumbersome. The new agreements replace the free circuits with standard business class service which included replacement of all lines coming into the buildings as well as all new Comcast equipment. This should ensure consistent and reliable connectivity for our remote sites that depend on it for daily business activity. This Comcast Business Service Order Agreement sets forth the terms and conditions under which Comcast Cable Communications Management, LLC and its operating affiliates ( "Comcast') will provide the Services to Customer. If there is an electrical power outage, 911 calling may be Interrupted if the battery back -up in the associated multimedia terminal adapter is not installed, fails, or is exhausted after several hours. - Voice calls, Including calls to 911, may not be completed if there is a problem with network facilities, including network congestion, network/equipment/power failure, or another technical problem. - Comcast will need several business days to update a Customer service address in the E911 system. All change requests and questions should be directed to 1- 800 - 391 -3000. USE OF VOICE AFTER DELIVERY OF THIS DOCUMENT CONSTITUTES CUSTOMER ACKNOWLEDGEMENT OF THE E911 NOTICE ABOVE. 4. To complete a Voice order, Customer must execute a Comcast Letter or Authorization ( "LOA") and submit it to Comcast, or Comcast's third party order entry integrator, as directed by Comcast. 5. New telephone numbers are subject to change prior to the install. Customers should not print their new number on stationery or cards until after the install Is complete. 6. Modifications: All modifications to the Agreement. If any, must be captured In a written Amendment, executed by an authorized Comcast Senior Vice President and the Customer. Upon request, the Contractor must provide the public with access to such records in accordance with access and cost requirements of Chapter 119, Florida Statutes. Further, the Contractor shall ensure that any exempt or confidential records associated with this Agreement or associated with the performance of the work described in the Scope of Services are not disclosed except as authorized by law. Finally, the Contractor shall retain the records described in this paragraph throughout the performance of the work described in the Scope of Services, and at the conclusion of said work, transfer to the Village, at no cost to the Village, all such records in the possession of the Contractor and destroy any duplicates thereof.
