II. III. CALL TO ORDER AND ROLL CALL The Tequesta Village Council held a regularly scheduled meeting at the Village Hall, 357 Tequesta Drive, Tequesta, Florida, on Thursday, March 23, 1995. The meeting was called to order at 7:00 P.M. by Mayor Ron T. Mackail. A roll call was taken by Betty Laur, Recording Secretary. Councilmembers present were: Mayor Ron T. Mackail, Vice Mayor William E. Burckart, Elizabeth A. Schauer, Earl L. Collings, and Joseph N. Capretta. Also in attendance were: Village Manager Thomas G. Bradford, Village Attorney John C. Randolph, Village Clerk Joann Manganiello, and Department Heads. INVOCATION AND PLEDGE OF ALLEGIANCE. Mayor Mackail gave the Invocation and led those in attendance in the Pledge of Allegiance to the American Flag. APPROVAL OF AGENDA Vice Mayor Burckart moved that the Agenda be approved as submitted. Councilmember Schauer seconded the motion. The vote on the motion was: Ron T. Mackail - for William E. Burckart - for Elizabeth A. Schauer - for Earl L. Collings - for Joseph N. CERTIFICATION OF RESULTS ELECTION/ANNEXATION REFERENDUM 1995/CERTIFICATES OF ELECTION OF THE MUNICIPAL HELD ON MARCH 14, Village Manager distributed Certificates of Election to Elizabeth Schauer and Carl Hansen, explained that Mr. Hansen had been elected to fill Seat 2, replacing Earl Collings, who had served on the Village Council for the past eight years; and that the annexation referendum had failed to annex any of the proposed areas. Councilmember Collings moved that the certificates of results of the municipal election held on March 14, 1995 be approved. Councilmember Schauer seconded the motion. The vote on the motion was: Ron T. Mackail - for William E. Burckart - for Elizabeth A. Schauer - for Earl L. Collings - for Joseph N. Capretta - for The motion was therefore passed and adopted. V. TRIBUTE TO EARL L. COLLINGS Mayor Mackail read aloud 8 Proclamation of Appreciation to Earl L. Collings by the Village of Tequesta for his years of service to the Village. Village Manager Bradford presented Mr. Collings with a parting gift and a plaque in appreciation of his service as Mayor and Councilmember. Mr. Collings expressed his appreciation to the Village, thanked individuals who had worked on his behalf in the election, commented that he would miss working on the Council, and stated that he would be available for committee work in the future. On behalf of the Tequesta Business Association, Earl Nelson thanked Mr. Collings for his efforts on behalf of that organization as well as the citizens in general and presented Mr. Collings with a gift expressing their gratitude. The gift was a very nice briefcase filled with play money which Mr. Nelson assured Mr. Collings was all right for him to accept since he was now out of office. OATH OF OFFICE TO INCOMING COUNCII1rlE![BERS Village Manager Bradford administered the Oath of Office to Carl C. Hansen and Elizabeth Schauer. Mr. Hansen then took his seat on the Council and expressed his appreciation to those who had worked to elected him and his commitment to do all he could to serve the residents of Tequesta. VII. VILLAGE COUNCIL REORGANIZATION A) Election of Council Officers for Ensuing Year Mayor Mackail passed the gavel to Village Manager Bradford to act as Temporary Chairman during election of Council Officers. 1) Mayor William Burckart placed the name of Ron Mackail into nomination for Mayor for 1995-1996. Hearing no other nominations, Temporary Chairman Bradford closed the nominations. Motion was made by Mr. Burckart to elect Ron Mackail as Mayor for 1995-1996. Motion was seconded by Carl Hansen. The vote on the motion was: Ron T. Mackail - for William E. Burckart - for Elizabeth A. Schauer - for Carl C. Hansen - for Joseph N. Capretta - for The motion was therefore passed and adopted, and the gavel was passed to Mayor Mackail, who expressed his appreciation. 2) Vice Mayor Motion was made by Councilmember Capretta to nominate William E. Burckart as Vice Mayor for 1995-1996. Motion was seconded by Carl Hansen. There were no other nominations. B) Designation of Committee Chairman and Co-Chairman 1) Finance and Administration Committee Mayor Mackail passed the gavel to Vice Mayor Burckart and made a motion to nominate Councilman Capretta as Chair of the Finance and Administration Committee for 1995-1996. There being no further nominations, motion was seconded by Councilmember Schauer. The vote on the motion was: Ron T. Mackail - for William E. Burckart - for Elizabeth A. Schauer - for Carl C. Hansen - for Joseph N. Capretta - for The motion was therefore passed and adopted. Vice Mayor Burckart made a motion to nominate Mayor Ron Mackail as Co-Chair of the Finance and Administration Committee for 1995-1996. Hansen - for Joseph N. Capretta - for The motion was therefore passed and adopted. Capretta - for The motion was therefore passed and adopted. 4) Redevelopment Committee Councilmember Schauer made a motion to nominate Mayor Mackail as Chair of the Redevelopment Committee for 1995-1996, Councilmember Capretta as Co-Chair, and Councilmember Hanson as Committeemember. There being no further nominations, motion was seconded by Councilmember Hansen. The vote on the motion was: Ron T. Mackail - for William E. Burckart - for Elizabeth A. Schauer - for Carl C. Hansen - for Joseph N. Capretta - for The motion was therefore passed and adopted. C) Designation of Village Council Members and Representatives to Various Governmental Assemblies Councilmember Schauer requested the addition of (5) North County Education Committee. Village Manager Bradford stated that he was designated as second alternate to all of the Governmental Assemblies listed. i) Palm Beach County Municipal League Vice Mayor Burckart made a motion to designate Mayor Mackail as Village Council Representative to the Palm Beach County Municipal League, and to designate Councilmember Capretta as the Alternate Representative. Capretta - for The motion was therefore passed and adopted. 2) Loxahatchee Council of Governments Councilmember Capretta made a motion to designate Vice Mayor Burckart as Village Council Representative to the Loxahatchee Council of Governments, and to designate Councilmember Hansen as the Alternate Representative. Motion was seconded by Councilmember Schauer. The vote on the motion was: Ron T. Mackail - for William E. Burckart - for Elizabeth A. Schauer - for Carl C. Hansen - for Joseph N. Capretta - for The motion was therefore passed and adopted. 3) Palm Beach Countywide Beaches and Shores Council Councilmember Schauer made a motion to designate Tequesta resident Bill Griffin as Village Council Representative to the Palm Beach Countywide Beaches and Shores Council, and to request the Beach Road Association to appoint an Alternate Representative. Motion was seconded by Vice Mayor Burckart. The vote on the motion was: Ron T. Mackail - for William E. Burckart - for Elizabeth A. Schauer - for Carl C. Hansen - for Joseph N. Capretta - for The motion was therefore passed and adopted. Village Council Meeting Minutes March 23, 1995 Page 8 --------------------------- 4) Loxahatchee River Management Coordinating Council Councilmember Schauer made a motion to designate Vice Mayor Burckart as Village Council Representative to the Loxahatchee River Management Coordinating Council and to designate Councilmember Capretta as the Alternate Representative. Motion was seconded by Councilmember Hansen. The vote on the motion was: Ron T. Mackail - for William E. Burckart - for Elizabeth A. Schauer - for Carl C. Hansen - for Joseph N. Capretta - for The motion was therefore passed and adopted. 5) North County Education Committee Vice Mayor Burckart made a motion to designate Councilmember Schauer as Village Council Representative to the North County Education Committee and to designate Councilmember Hansen as the Alternate Representative. Motion was seconded by Councilmember Capretta. The vote on the motion was: Ron T. Mackail - for William E. Burckart - for Elizabeth A. Schauer - for Carl C. Hansen - for Joseph N. Capretta - far The motion was therefore passed and adopted. Councilmember Schauer commented that Beverly Jones was the Tequesta resident representative on the committee. VIII. APPOINTMENT OF VILLAGE OFFICERS A) Consideration of Thomas G. Bradford as Village Manager Councilmember Schauer made a motion to appoint Thomas Village Council ,,,~~ Meeting Minutes March 23, 1995 Page 9 -----------------------=------- G. Bradford as Village Manager for 1995-1996. Motion was seconded by Vice Mayor Burckart. The vote on the motion was: Ron T. Mackail - for William E. Burckart - for Elizabeth A. Schauer - for Carl C. Hansen - for Joseph N. Capretta - for The motion was therefore passed and adopted. B) Consideration of Joann Manganiello as Village Clerk Councilmember Hansen made a motion to appoint Joann Manganiello as Village Clerk for 1995-1996. Motion was seconded by Councilmember Schauer. The vote on the motion was: Ron T. Mackail - for William E. Burckart - for Elizabeth A. Schauer - for Carl C. Hansen - for Joseph N. Capretta - for The motion was therefore passed and adopted. IX. ANY OTHER MATTERS Village Manager Bradford stated that the Village Council would need to meet soon to set goals and objectives for the coming year. Mayor Mackail requested that the Council review the established priorities to determine progress that had been made. Councilmember Capretta suggested that each Councilmember submit to the Village Manager their top five priorities for coordination. Councilmember Hansen suggested that those priorities be weighted to equal a total of 100, and that each Department Head also contribute weighted priorities for their particular area. Village Manager Bradford commented that the current process worked similarly, and that it would begin immediately. X. COMMUNICATION FROM CITIZENS Dr. Stan Jacobs, River Road, informed the Village Council that a rumor had been circulating that the Turtle Creek gate Village Council ~~~, Meeting Minutes March 23, 1995 Page 10 was to be closed to traffic, and that a meeting of residents was being held to discuss the matter. Dr. Jacobs requested that the Council put the rumors to rest, and was informed by Mayor Mackail that even if the rumors could be put to rest that it would not be appropriate at this time since Tequesta was currently involved in a series of meetings with Martin County, Jupiter, and Palm Beach County Commissioner Marcus to address future growth problems of Sections 28 and 33, and to determine the responsibilities of the municipalities to solve those problems. Councilmembers assured Dr. Jacobs that the Council had no plans to close either Country Club Road or Turtle Creek gates, and that Turtle Creek was not a gated community and had illegally placed a gate and guardhouse at their entrance. Mayor Mackail stated that the instigators of the rumors needed to go the Village administrative offices to obtain answers to their concerns. William Treacy, Country Club Drive, stated that Martin County Commissioner Gettig had called him and suggested closing the Turtle Creek gate and that he had responded with the concern that those residents would only have one exit in case of a hurricane, and that traffic would only be rerouted back onto Country Club Drive. Mr. Treacy stated that Country Club Drive residents had lost 25~ of the value of their homes because of the traffic from Martin County, that Martin County had done nothing to ease the traffic on Country Club Drive, that Tequesta should consider their own needs as future traffic was generated from Section 28, called for cooperation from Martin County, and commented that Martin County residents were given priority over Tequesta residents in Village Council meetings. Mayor Mackail explained that the issue was much larger than one road, and assured Mr. Treacy that he and Martin County Commissioner Gettig would meet with Mr. Treacy to discuss the problem, and stated that no intentional priority was given to Martin County residents during the public comments section of the Village Council meetings. IX. ADJOURNMENT Councilmember Schauer moved that the meeting be adjourned. Councilmember Hansen seconded the motion. The vote on the motion was: Ron T. Mackail - for William E.
