Developers Agreement
Between

The Episcopal Church of the Good Shepherd
and
The Village of Tequesta
This agreement to be in accordance with Ordinance No. 425 of, ' the Village
Council of the Village of Tequesta for the property located at:
The South 275 teCt, measured at right angles to the South line thereof, of that part
of the Northeast 1/4 01 Southeast 1 /4, lying Fast of East right -of -way line of
Seabrook Road. as conveyed to the count, of'Palnl Reach by Teed recorded in Official
Record Book 524, Page 211, Palm Beach County records, in Section 25, Township 40
South, Range 42 East, Palm Beach County, Florida.
The Episcopal Church of the Good Shepherd, the owner of the above described property,
for the purpose of the development of the proposed Classroom Additions agrees to the
Following:
1. Locate the Classroom Addition. North of the originally proposed location, as
per the revised site plan submitted.
2. Locate the Outdoor Preschool Recreational Program Playground for the
Preschool through 'Third Grade, South of the huildin <, which was originally proposed to
be east of the building. as per the revised site plan submitted.
3. Clear the exotic vegetation which has been declared a nuisance from the east
end of the site to be in accordance with Ordinance No. 377.
4. Plant new shrubbery along the cast property line, so as to reduce the intrusion
of noise from church and school activities to neighboring properties as per revised
landscape plan submitted.
5. Construct an eight foot high masonry wall on the East side of proposed new
school building, which will create an opaque view of the landscaped courtyard, while also
minimizing any noise coming from that area which might etfcct the adjacent properties,
as per rcv1scd site plan and iandscapc flan submitted.
6. C011StrUCt the CUI - dC -sac with a fifty fOot radius as per the revised site plan
submitted.
7. Plant shrubbery along the North property line where lots 5&6 adjoin the site to
create the same effect that is mentioned in stein 4 above, as per the revised landscape plan
submitted.
S. "Tentatively agreed with Richard Carberry, the current owner of lot 4 bordering
to the North property line, to construct a stockade -style fence to be located on the
property of lot 4.

9. A Maximum of twenty (20) students will recreate for a maximum of 1 hour per
day, during school hours, in the area located south of lots 5 and 6, to the north radius of
the cul -de -sac and east of the Parish Hall, as per revised site plan submitted.
It is agreed and understood that the proper permits will be applied for and adhered to and
that the development of the proposed classroom additions are consistent with the
Comprehensive Plan and Land Development Regulations of the Village of Tequesta,
pending the approval of the Council to grant the Special Exception usage, Parking
Variance and Site Plan Approval.
It is also agreed and understood that the failure of the developer to address a particular
permit, condition, term or restriction shall not relieve the developer of the necessity of
complying with any law governing said permitting requirements, conditions, terns or
restrictions.
This agreement shall endure for a period of five years from the date of its signing, per
Section 3 of Ordinance No. 425 an Ordinance of the Village Council of the Village of
Tequesta.
This agreement shall be recorded in the records of Palm Beach County with the Clerk of
the Circuit Court.
