MGA TEQUESTA LLC, Respondent. RE: Violation of Chapter 30, Article II, Section 30 -33, Chapter 78 Article IX Section 79- 397 of the Code of Ordinances of the Village of Tequesta. Address: 3774 County Line Road Tequesta, Florida 33469 Legal Description: 30 -40 -43 W 50 FT OF E 150 FT OF S 280 FT OF N 330 FT OF NW 1 /40F NW 1 /4 PCN: 60- 43- 40- 30 -00- 000 -3050 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Hearing held on the January 29, 2016, and based on the evidence and testimony presented, enters an Order Granting Fine Reduction. The following Findings of Fact, Conclusions of Law and Order are hereby entered: FINDINGS OF FACT 1. Based upon the December 2, 2015 hearing and "Order Assessing Fine" for above - referenced case number, the Special Magistrate assessed a fine in the amount of three thousand six hundred dollars ($3,600.00). The fine continued to run until it reached an amount of $4,200.00. 2. The Respondent requested a hearing seeking mitigation of the lien amount assessed. The Respondent was represented at the hearing by James Garland. Chris Haine was also present at the hearing. 3. As of the December 9, 2015, the property was no longer in violation of sections 30 -33, 79 -397, and 303.2 (IPMC) of the Code of Ordinances of the Village of Tequesta. Page 1 of 2 CONCLUSION OF LAW AND ORDER It is the Order of the Village of Tequesta Special Magistrate that the penalty amount previously imposed be reduced from $4,200.00 to $420.00 The Respondent is hereby ordered to pay this mitigated fine amount by February 27, 2016 (thirty days from the date of the hearing), or the original penalty amount of $4,200.00 will automatically be reinstated as a penalty. The Village's administrative costs were previously paid in full by the Respondent. DONE AND ORDERED THIS 2&' day of January, 2016.
