HomeMy WebLinkAboutAgreement_General_02/11/2016 (3) VILLAGE OF TEQUESTA CONTRACT FOR HYDROGEN PEROXIDE 50% & RELATED SERVICES THIS CONTRACT FOR HYDROGEN PEROXIDE 50% AND RELATED SER- VICES, hereinafter "Contract ", is entered into and effective this " � day of4ftfftwy 201 by and between the VILLAGE OF TEQUESTA, a Florida municipal corporation with offices located at 345 Tequesta Drive, Tequesta, Florida 33469 -0273, organized and existing in accordance with the laws of the State of Florida, hereinafter "the Village "; and EVOQUA WATER TECHNOL- OGIES, LLC, a foreign limited liability company with offices located at 181 Thorn Hill Road, Warrendale, Pennsylvania 15086 and 2650 Tallevast Road, Sarasota, Florida 34243, hereinafter "the Contractor" and collectively with the Village, "the Parties ". WITNESSETH The Village and the Contractor, in consideration of the mutual covenants contained herein and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowl- edged by both Parties, hereby agree as follows: 1. SCOPE OF SERVICES: The Village and the Contractor both hereby agree to enter into this Contract whereby the Contractor shall provide 50% Hydrogen Peroxide, 23.5% active oxygen content at a cost of $3.61 per gallon and provide inclusive services (excluding chemicals) and equipment to set -up, configure, operate, service, maintain, control and monitor the application of chemicals at the Village's Water Treatment Facility. Service pricing shall include response to odor complaints, testing, monthly reports, chemical off - loading and emergency or after hours responses. Prices will be provided at $450.00 per month per station for Contractor to provide O &M of Contractor provided equipment without PLC control. Pursuant to the Decem- ber 11, 2015 correspondence from the Contractor to the Village, attached hereto as Exhibit A, the Village is authorized to piggyback for the goods described above from the August 12, 2015 Contract For Services between Contractor and the City of Raleigh, a North Carolina municipal corporation and the April 9, 2015 Proposal In Response To Request For Proposals Odor And Corrosion Control Services (RFP #5230- 608- FY15- ODORCONTRLv2) between the City of Raleigh and the Contractor, attached hereto as Exhibit B and Exhibit C, respectively. All ex- hibits are hereby incorporated into this Contract as if fully set forth herein. 2. COMPENSATION: In consideration for the above Scope of Services, pricing for Hydrogen Peroxide 50 %, and for Services and Equipment of Contractor Provided Equipment shall be CONTRACT FOR HYDROGEN PEROXIDE 50% & SERVICES AND EQUIPMENT OF CONTRACTOR PROVIDED EQUIPMENT pursuant to the price set -out at page 27, Appendix A — Contractor's Price Proposal of Exhibit C. 1 3. INSURANCE AND INDEMNIFICATION: The Contractor shall provide proof of work- man's compensation insurance and liability insurance in such amounts as are specified in sec- tion 10, "Insurance," at pages 3 until 4, of Exhibit B and shall name the Village as an "additional insured" on the liability portion of the insurance policy. The Contractor shall at all times in- demnify, defend and hold harmless the Village, its agents, servants, and employees, from and against any claim, demand or cause of action of whatsoever kind or nature, arising out of any error, omission, negligent act, conduct, or misconduct of the Contractor, its agents, servants, or employees in the performance of services under this Contract. 4. PUBLIC ENTITIES CRIMES ACT: As provided in sections 287.132 and 287.133, Flor- ida Statues, by entering into this Contract or performing any work in furtherance hereof, the Contractor certifies that it, its affiliates, suppliers, subcontractors and consultants who will perform hereunder, have not been placed on the convicted vendor list maintained by the State of Florida Department of Management Services within thirty -six (36) months immediately preceding the date hereof. This notice is required by section 287.133(3)(a), Florida Statutes. 5. TERMINATION; NOTICE: This Contract may be terminated by the Village or the Con- tractor upon thirty (30) days written notice to the either the Village or Contractor, in accordance with section 15, "Cancellation," at page 5, of Exhibit B. ATTORNEY'S FEES: In the event a dispute arises concerning this Contract, the prevailing party shall be awarded attorney's fees, including fees on appeal. 8. CHOICE OF LAW; VENUE: This Contract shall be governed and construed in accordance with the laws of the State of Florida, and venue shall be in Palm Beach County should any dispute arise with regard to this Contract. 9. AMENDMENTS & ASSIGNMENTS: This Contract, all Exhibits attached hereto, and re- quired insurance certificates constitute the entire Contract between both Parties; no modifica- tions shall be made to this Contract unless in writing, agreed to by both Parties, and attached hereto as an addendum to this Contract. The Contractor shall not transfer or assign the services and provision of goods called for in this Contract without prior written consent of the Village. 10. INSPECTOR GENERAL: Pursuant to Article XII of the Palm Beach County Charter, the Office of the Inspector General has jurisdiction to investigate municipal matters, review and audit municipal contracts and other transactions, and make reports and recommendations to municipal governing bodies based on such audits, reviews, or investigations. All parties doing business with the Village shall fully cooperate with the inspector general in the exercise of the inspector general's functions, authority, and power. The inspector general has the power to take sworn statements, require the production of records, and to audit, monitor, investigate and in- spect the activities of the Village, as well as contractors and lobbyists of the Village in order to detect, deter, prevent, and eradicate fraud, waste, mismanagement, misconduct, and abuses. 11. PUBLIC RECORDS: In accordance with section 119.070 1, Florida Statutes, the Contrac- tor must keep and maintain this Contract and any other records associated therewith and that are associated with the performance of the work described in the Scope of Services. Upon request, the Contractor must provide the public with access to such records in accordance with access and cost requirements of chapter 119, Florida Statutes. Further, the Contractor shall ensure that any exempt or confidential records associated with this Contract or associated with the performance of the work described in the Scope of Services are not disclosed except as authorized by law. Indernnitv Except to the extent caused by the sole negligence or willfitl tnisconduct ofthe City,the Con:tractor shali indemnify and hold and save the City, its offic�rs, agents and employees, harmless from liabilrty of any kind, including aIl claims,costs(including defense) and Iosses accruing or resulting to any other person,firm,or corporation furnishing or supplying work, services, materials,ar supplies in connection with the perfarmance of this Contract, and from any and alI claims,costs(including defense}and losses accruing or resulting to any persan, firm, or corporatzon that may�injured or damaged by the Conhactor in the performance Qf this Contract. This representation and wa�rrranty shall survive the termination or e�iration of this Canfiract. Force Majeure Except as otherwise provid�d in any environt�nental laws,rules,regulations or ordinances applicable to the parties and the services perfarmed under this Contract,neither party shall be deemed to be in default of its obligations hereunder if and so long as it is prevented from performing such obligations by an act of war,hostile foreign actions,nuclear explosion, earthquake,huiricane,torr�ado,or other catastrophic z�atural event or act of God. Either party to the Contract xx►ust take i�easonable measures and implement reasonable protections when a � weather event otherwise defined as a farce majeure event is foreaast to be eligible to �excused from the pet�farmance otherwise required under this Cant�act by this provision. I4. Advertisin� The Contractor shall not use the e�cistence of this Contract,or the name of the City af Raleigl�,as part of any advertising vvithout the prior written approval of the Ci#y. 15. Cancellation The City may terrninate this Cantract at any tirne by providing thirty{30)days written notice to the Cantractor. Evoqua takes no exceptions to any part of the scope of services as defined in the RFP. Scope of Services Routine Maintenance In addition to continuous hydrogen sulfide monitoring with data loggers, Evoqua shall provide routine maintenance for each dose site a minimum of once per month. Evoqua shall perform liquid phase grab sampling at each control point a minimum of once per month for the duration of the contract. The data collected shall include the following: • Dissolved sulfide • pH • Wastewater Temperature • Chemical residual. Schedule of Activities The program shall be organized into three primary phases; initiation, implementation, and optimization. Evoqua Water Technologies is the original developer of PLC based odor control dosing systems. The proposed systems as outlined in section C of this proposal offer the latest in technological advancements in odor control dosing strategies. However, it is not only the machinery that allow an odor control program to be well optimized; it is the years of experience and services that Evoqua offers that have consistently made it the leader in advanced odor control dosing strategies. Program optimization shall take place during the first full month of the program, and shall consist of a series of four(4) iterations spaced at weekly intervals, using hydrogen sulfide monitoring data remotely transmitted to the web as the basis for fine-tuning. Optimization shall be ongoing throughout the course of the program. As the City of Raleigh's collection system grows, expands, and changes; Evoqua will be there to ensure that the dosing systems adapt and change alongside the City. Evoqua shall review the current dosing rates at each location. Average daily hydrogen sulfide curves shall be generated from field data. A typical diumal flow pattern for each collection system being treated shall be generated; either with data gained directly through interFace with pump station equipment, or through historical flow information provided by the city. Using flow information, collection system data, and hydrogen sulfide graphs; Evoqua shall revise the diurnal dosing curve at each location to optimize chemical usage. Chemical Storage Tanks Storage tanks provided under the proposed program shall be designed for compatibility with Calcium Nitrate or Hydrogen Peroxide solution. The proposed tanks shall be constructed rotationally molded High-Density Cross Linked Polyethylene(HDXLPE). The proposed tanks shall have a capacity of 1,550 gallons. The tanks shall be double walled, with the outer tank possessing a volume no less than 110%the volume of the inner tank. The tanks shall be rated to hold liquids with a specific gravity no less than 1.65. The tanks shall have a diameter of 96", and shall be 83"tall. All tanks shall be equipped with a level sensor to indicate inventory volume locally, and shall interface with a website to report chemical level remotely. Calcium Nitrate StoraQe Tanks Tanks provided to store Calcium Nitrate shall be provided with a 2" schedule 80 PVC quick disconnect fill line. Inventory monitoring shall be accomplished using a pressure transducing level sensor designed to transmit information directly to the dosing unit. The enclosures shall be rated NEMA 4X and equipped with a door with a continuous hinge. The door shall have two latches and shall be capable of being locked via a padlock. The VersaDose advanced dosing controller is an automated chemical feed system that reacts intelligently to the wastewater demand for chemical by adjusting dose rates. Additionally, inventory control is enhanced through a series of diagnostic and communication features. The main attributes of the system that perform these tasks are: • 168 individual dosing setpoints-one for each hour of the week • Automatic dose changes based on wastewater temperature • Rain recognition and dose adjustment • Pump dose versus tank drop diagnostic analysis • Remote alarm notification for a variety of parameters, including: • Inventory low and fill • Dose change • Difference between pump dose rate and tank drop rate • Loss of signals • Automatic pump switchover in case of failure by either pump The sites that will benefit most from the use of VersaDose advanced dosing controllers have the following characteristics: • Chemical demand larger than 25 gallons per day Cost savings and pertormance improvements are achieved by lowering dose rates seasonally in response to variations in temperatures, lowering dose rates daily in the event of significant precipitation, and through matching the varying diurnal chemical demand of the wastewater by matching it with a variable dose curve. Evoqua has experienced 5-10% lowered chemical use rates with the VersaDose technology while matching or exceeding odor control performance. Bioxide° is primarily used in moderate detention time force mains via metering treatment solution at pump stations. The Bioxide° process prevents sulfide formation by providing a thermodynamically favorable terminal electron recipient to the sulfate ion while also oxidizing sulfides in the wastewater to elemental sulfur. Hydrogen peroxide is well suited to lines with short retention times, lines containing large amounts of additional volatile organic compounds, and lines with significantly elevated BOD concentrations. The primary reaction mechanism for Hydrogen Peroxide is to oxidize sulfide to sulfur. Additionally, Hydrogen Peroxide may oxidize the microbiology responsible for oxygen uptake and sulfate reduction, thereby lowering the BOD concentration of the wastewater. Hydrogen Peroxide, when used alone for odor control, is dosed at 1/2 gallon for each pound of sulfide treated for removal and up to one gallon per pound sulfide for prevention. Alternate Odor Control Products There are many conditions that lead to the generation and release of hydrogen sulfide in collection systems. Often times the unique factors leading to odors and corrosion may be better treated with a chemical that specifically addresses the primary cause of sulfide related odors and corrosion. Evoqua offers a broad spectrum of liquid phase chemical solutions for the full range of hydrogen sulfide challenges. The following list summarizes additional tools that are available to be used within the program. Odophos�—aqueous solution of ferrous sulfate that is widely used to treat dissolved hydrogen sulfide in force mains and gravity interceptors. Application is done using metering systems at established dosage rates into key pump station locations. The soluble iron ions in ferrous chloride react with sulfide and bisulfide present in the wastewater to form an iron-sulfide Page 13 of 30 Odor and Corrosion Control Services Evoqua Water Technologies Proposal April 9,2015 RFP#5230-608 precipitate. Ferrous based treatment is optimum for high flow short retention time applications due to the quick precipitation reaction and offers long-term control duration. In addition, ferrous treatment can aid in clarification processes and assists in phosphorous control. The dose rate of Odophos� is 3.3 gallons of product per pound of sulfide. Bioxide� Plus 71 —combines the effectiveness of the Bioxide�process with a proprietary oxidizer. The active ingredient in this product provides point source odor control and synergistically improves the functional chemistry of nitrate induced sulfide oxidation and prevention. The chemical basis for odor control of Bioxide� Plus 71 is similar to that of Bioxide� in that it provides a more favorable terminal electron acceptor to the facultative sulfate reducing bacteria. Additionally, the proprietary component specifically oxidizes odorous compounds. The dose rate for Bioxide° Plus 71 is typically 1.5 gallons per pound of sulfide treated. Bioxide-AQ°- combines the Bioxide� Process for dissolved sulfide removal with the patented Aquit� microbial metabolic inhibition process for a synergized dissolved sulfide prevention product. Bioxide-AQ� is primarily used in small diameter force mains with longer detention times. The additional active component in this Bioxide�blend uses the inactivation of the slime- layer on the interior walls of the forcemain as its chemical basis. Dose rates for this product are typically 10% less than that of regular Bioxide�, therefore about 0.6 to 1.9 gallons of Bioxide- AQ° are required per pound of sulfide. Odophos° Plus—aqueous solutions of ferric-ferrous sulfate which treats dissolved hydrogen sulfide in force mains and gravity interceptors via metering at established dosage rates into key pump station locations. Ferrous based treatment is optimum for high flow short retention time applications. The soluble iron ions in Odophos° Plus react with sulfide and bisulfide present in the wastewater to form an iron-sulfide precipitate. The dose rate of OdoFree is 1.1 gallons per pound of sulfide. VX 456�—a stable concentrated oxidizing solution engineered specifically to mitigate odors associated with biosolids handling processes. The product selectively oxidizes odor causing compounds rather than phenols, organic solvents, and other organic matter. Alkqen AQ° -a process that utilizes a fast dissolving alkaline source for controlling sulfide release and Aquit that helps prevent formation of dissolved sulfides downstream of the application point. Treatment solution is metered into pump stations or manholes. Biofilters— unique, modular biofiltration system. This vapor phase treatment technology uses no chemicals and provides complete or added odor control using natural biological organisms. Most applicable when space constraints are an issue. Engineered media and an enclosed design of the ZABOCS� and WhisperT"" biolfiter ensure predictable, long, reliable service life. Chemical Containment and Response Plan Evoqua Water Technologies has a variety of technology to prevent chemical releases and to contain chemical spills. Technology such as our Safe L, Containment Skids, and Tank Sensors with On/Off capabilities help prevent chemical releases from entering the environment. Evoqua Water Technologies has a Chemical Containment and Response Plan for every chemical Evoqua is involved with. The purpose of our Chemical Containment and Response plans is to ensure that the correct guidelines and information are available for handling an accidental spill or release of chemical. Evoqua's experience with PLC based dosing controllers and historical optimization efforts with advanced dosing technology has shown a first year cost savings up to 10%with a typical additional cost savings approaching 5% in the second year.
