AN ORDINANCE OF THE VILLAGE COUNCII. OF THE VILLAGE OF
TEQUESTA, FLORIDA, AMENDING THE VILLAGE C�DE OF
ORDINANCES AT CHAPTER 14. BUILDINGS AND BUILDING
REGULATIONS. AT ARTICLE I. IN GENERAL. BY AMENDING SECTION
141 TO SPECIFY LEGAL HOLIDAYS ON WHICH CERTAIN WORK IS
PROHIBITED; ANU BY CREATIl�TG AN ENTIRELY NEW SECTION 144.
ENTITLED "PROTECTTON OF TREES AND OTHER VEGETATION TO BE
PRESERVED ON STTE" TO PROVIDE FOR THE PROTECTION OF TREES
AND OTHER VEGETATIDN DURING CONSTRUCTION; AND AN
E,N�RELY NEW SECTION 145 ENTITLED "BUARDIAIG OR
CONCEALING STOREFRONTS DURING CONSTRUCTION" TO PROVIDE
REGULATI4NS REGARDING TI� BOARDING UR CONCEALING OF
STOREFRONTS WITHOUT A BUILDING PERMTT; AND AT ARTICLE II
BUILDINGS. BY INSERTIl�TG REGULATIONS FtJR FLOODPLAIN
ADMIl�IISTRATTON, AS REQUIRED BY FEMA; PROVIDING THAT EACH
AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 14.
BUILDINGS AND BUILDING REGULATIONS SHALL REMAIN IN FULL
FORCE AND EFFECT AS PREVIOUSLY ADOP'TED; PROVIDING A
CONFLICTS CLAUSE, A SEVERABILITY CLAUSE AND AUTHORTTY TO
CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTI�R
PURPOSES.
WAEREAS, the Village Cot�ncil desires to specify the legal holidays upan which certa,in
conslniction work i.s prohibited throughout the Villsge; and
WHEREAS, the Village's landscaping consultant has advised the Village Council to
adopt c,aie for the protection of certain trees �d vegetation on const�n�ction sites; and
WAEREAS, the Village Council has learn� that there have been a number of ceses
where storefront windows have been boarded or covered in order to canceal from public view
certain work and construction ac�ivities being performai at the store without the P�P�' P���
and
WHERF,A.S, in order to be in compliance with ce�Rain FEMA regulations, the Village's
build'u�.g code administrative seCtion must include certain regvlations fnr floodplain
administration that intera�ct with the Village's floodplain ad.minislr�ion code at Chapter 78,
Article XII; and

W�iEREAS, the Village Council of the Village of Tequesta, Florida, desires to amend
Cl�apter 14. Buildings and Building Regulations. Article I. In General. in order to provide for the
protection of certain trees and v�etation on const�uction sites, and also to pmlribit the boarding
or covering of storefiont doors, windows or otker openings without an active permit in place for
such work and construckion activities, an�d fiuther amend Chapter 14. Buildings and Building
Re$ulations. Article II. Buildings. in order to provide regula�ions for floodplain administration
that interact with the Village's flaodplain adminishation code at Chapter 78, Article XII; and
WHEREAS, the Village Cauncil believes these amendments to its Code of Ordinances
are in the best interests of the citizens of the Village of Tequesta.
NOW, THEREFURE, BE IT ORDAINED BY THE VII.LA.GE COUNCII. OF T.HE
VILLAGE OF TEQUESTA, FLORIDA, THAT:
S�an l: Chapter 14. Buildings and Buildin� Regulations. of the Co@e of
Ordinances of the Village of Tequesta is hereby amend,ed at Article L In General. by amending
Section 14-1 to specify legal holidays on which certain work is prohibited; and by creating an
entirely new section 14-4 entitled "Prntection of trees and other vegetation to be preseiv� on
site" to provide for the pmt,ection of trees and other vegetati� dutin� construction; anci aa
entirely new �ction 14-5 entifled "Boarding or concealing storefronts during constauction» to
provide regulations re�rding the baarding or concealing of storefmnts witho� a build'u�
permir, providing that Chaptet 14 Article I shall herea�er read as follows:
ARTICLE I. IN GENERAL

(a) No person shall conduct the erection (i�luding eiccavating), demolition,
altera�ion or repair of any building or struchu+e in the village an Sundays or on the
follawing recogniz�ed legal holidays, unless approval to conduct work on Sundays
or on such holida.ys has been graated in advance by the village council: New

Year's Day, NII,K Day, President's Day, Memorial Day, Independence Day,
Labor Day, Columbus Day, Veteran.'s Day, Thanksgiving Day, Christmas Day.
(b) No person shall conduct the erection (including excavating), demolition,
alteration or repair of any building on weekdays, including Saturdays, other thau
between the hours of 7:(� am. and 6:00 p.m.
(c) No person ssl�a�allll deliver building supplies or matsriats dwing the hours when
erection, d�molition, altera�ion or repair of any build'uig or struct�ue is forbidden
by this section.
(d) There sball 1� no contracted labor or services, �cludiag janitorial services,
performed on any yard or building or structure in the village on Sunday or legal
holidaqs, and on weekdays, including Sa�turdays, other thsn betwcen the howrs of
7:00 am. and 6:00 p.m., unless appmval to do so has be�n granted by the village
couacil.
(e) The cflnduct deseribed in ttus section may be carri� on in cases of urgent
necessity where health or safety is involved.
Sec.14-2. Nnmbering of bnilding�.
The building official, or other offcial designated by the village council, shall
provide for the numbering of all houses and buildings within the village, and shall
maintain a map in the o�'ice of the village showing the numbers.
5�.14-3. Control of dust and blowing sand.
(a) During the courrse of any construction or demolition work being done on any
premises, it shall be unlawfiil for any person to cause, permit or allow the
emission of particulate matter from any source whatsoever, including but not
limit� to incide�ts ca.used by vehicular movement, t�ansportation of materials,
construction, alteration, demoGtion or wrecking of buildings or structures, or the
stockpiling of sand or dirt, without taking reaisonable pr�autions to prevent such
emissions or to pre�lude such particulates that may h�espass on nei�hboring
properties during dry and windy weather. In the case of stockpiled particulate
materials, such materiats sha11 be stabilized by adequate coverings, by wettin�, by
_ appmved chemical application or by other approved means, to the satisfaction of
the building official.
(b) In addition to other remedies for violations of this Code, the violation of this
s�tion shall constitute grounds for the issuance of a stop work order by the
building official in accorda�ace with the provisions of the building code.
Sec.14-4. Protection of trees and other vegetatlon to be preserved on site.
Ti�ees and othet vegetation wluch are to be preserved on the site of a construction

with appropriate tree and vegetation pratection techniques. "Tre�s and Development: A
Te,chnical Guide to Preservatian of Trees During Land Deveiopment", by Nelda Matheny
& James R Clark, as utilized by the State Forest Service, Depa�iment of Agriculture aad
Consumer Services, sha11 provide guidance for de�termining the appropriate technic}ues to
be utilized on any given site. At a minimum, �11 vegetation areas shall lx fenced with
scre�ning to prevent damage. Any tree ar other pi� of vegetation intended to be

preserved on site but which does �t suivive the construction pmcess shall be replaced
with a� or other vegetation comparable in size and quality. Multiple trees with an
overall tnmk diameter equal in size to a de.stroyed tiree may be utilized to replace larger
trees.
Sec.14-5. Boarding or eoncealing storefronts during constraction or renovation.
Non-residential construction or renovation sites may cover storefront windaws,
including windows l�d on doorways, in order to conceal interior construction or
renovation wark only upon issuance of a germit by the Building Official. Thi,s sectioa
sha,ll not apply to the use of storm shirtters pursuant to Sec. 7&306, or to emeigency
re�ir or replacement of broken wiadows or dpors temporarily – not to elcceed ten (1Q)
days unless appmved by the Building Officia1.

Official for vaziances to the provisions of Section 1612.4 of the Florida Building Coate, Building
or, as applicable, the provis,ions of R322 of the Florida Buidding Code, Residentiiat. This section
shall aot apply to Section 3109 of the Florida .Bualdi»g Ca�e, Building.
