- The Special - Magistrate appointed - by the - Village Council hear code compliance cases
for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard
testimony at the Code Compliance Special Magistrate Hearing held on February 25, 2016 and
based on the evidence and testimony presented, entered an Order Assessing Fine. The following
Findings of Fact, Conclusions of Law and Order are hereby entered:
FINDINGS OF FACT
1. The - Respondent is the owner of the above - described property.
2. The Respondent was not present at the hearing; however, there was a finding of proper
notice.
3. In the "Order Finding Violation," dated February 10, 2016, the Special Magistrate
ordered the Respondent to comply with Section 14 -152 of the Code of Ordinances of the
Village of Tequesta by February 24, 2016.
4. As ofFebruary 25, 2016, the property was still violation of 14_152;78-6_1_2,
22 -53, and 30 -33 of the Code of Ordinances of the Village of Tequesta.
5. Based upon the evidence, pictures and testimony presented at the hearing on February 25,
2016, the Special Magistrate found that the property remained in violation of Section 14-
152, Village Code of Ordinances.
CONCLUSIONS OF LAW
The above - stated facts constitute a continuing violation of - Section 14 -132 of the Code of
Ordinances of the Village of Tequesta.
ORDER
It is the Order of the Special Magistrate that a Fine of one hundred fifty dollars is hereby
assessed, at a rate of one hundred fifty dollars per day, for the violations which have existed on
- the - property -- beginning .February 24, 201-6 - through February- 25, 2016, . a- period -of - one -day -; -and
the fine amount shall continue to accrue a rate of one hundred fifty dollars per day until
compliance is achieved.
The Respondent also is assessed one hundred eighty -six dollars and ninety eight cents
for administrative costs incurred by the Village prior to February 25, 2016.
A zertified_ copy _of _this - Ord er -may _he recorded--in- the_P_ublic_ _Records of Palm--Reach.
County, Florida, and, once recorded, shall constitute a lien against the property upon which the
violation exits and upon any other real or personal property owned by the Respondent, pursuant
to Chapter 162, Florida Statutes.
Upon complying in any code compliance matter, it is always the responsibility of the
Respondents to contact the Code Compliance Division at (561) 768 -0506 to request a
reinspection of the property.
