Mayor Brennan replied that it would be fine for them to use. Vice Mayor Arena mentioned the Sea to Shore event for next year and asked for Council to keep ideas in mind for upcoming workshops. Vice Mayor Arena asked Council Member Okun to decide which dog signs should stay and which should be replaced. Vice Mayor Arena recognized Mr. Doug Chambers for his outstanding perFormance as Supervisor of Public Works for the Village of Tequesta. He asked if Mr. Chambers might consider planting impatients and marigolds at the entry ways to the Village. Council Member D'Ambra expressed concern regarding the request for the Business Forum to use Village Hall for meetings. He felt that if one group used the facility it opened up the door to other requests. He recommended taking a look at the guidelines regarding this topic. Manager Couzzo assured Council he would evaluate and come up with a policy use. Mayor Brennan reported on a potential passive park located at the Banyan Tree on the corner of Point Drive and Bay Harbor Road. She recalled speaking to a Jupiter High School student by the name of Alex Commette who wanted to do something for this location as his school project. Mayor Brennan suggested adding some landscaping benches and possible signage to make it more of a passive park. She thought his ideas were refreshing and recommended the Village assist him in his vision. Council Member Paterno proposed the Village keep Remembrance Park on Seabrook, and develop it into a passive park. Mayor Brennan mentioned that she attended a Palm Beach County Commission meeting this week and learned of a proposed sales tax increase request for county, school district and fire. She reported that all sales tax increases would have to go up for vote on the ballot. STANDING REPORTS Villaqe Attornev Attorney Davis reported on the Tequesta vs. Thomas foreclosure matter and expected the Village to receive a summary judgement hearing date in March, 2016. Attorney Davis also advised Council of the Luscavich matter set for the 9-week trial docket on February 22, 2016. Attorney Davis advised Council of the Cox appeal, noting that the 4th District Court of Appeals reversed and sent it back to the arbitrator for review. It was currently caught up in procedural issues. He also offered a legislative update on the public records bill that would give trial courts discretion on awarding attorney's fees as well as a five- day notice period for certain requests. Attorney Davis further advised Council of the expected Senate Companion Bill up for consideration regarding municipal election dates. The Palm Beach County League of Cities had sent out a"Call to Action" to all the municipalities in the area, regarding this bill. Lastly, Attorney Davis reported on a"utility and rights of way" bill which would require a municipality to pay for possible utility relocation costs. He felt that this bill could have serious budgetary implications. Minutes — Regular Council Meeting 02/11/16 Page 5 Mayor Brennan received a packet from someone with photos of numerous violations at the Budget Rental Company. Attorney Davis informed Council of a scheduled meeting with Budget Rental's representatives, to discuss the various violations, later this month. Villaae Manater Manager Couzzo commended Mr. Doug Chambers, Supervisor of Public Works, on successful completion of his probationary period and asked him to elaborate upon some upcoming projects scheduled for public works this year. Mr. Chambers updated Council of some equipment purchases, including a striping machine for maintaining roadways. He further mentioned his department planned to continue with striping the park, planting flowers, trimming oak trees as well as many other projects. He revealed that a portion of the work was being done "in house", thus saving the Village money and resources. He further mentioned crosswalk improvements in the area of Country Club Drive and Tequesta Drive. Mr. Chambers concluded that speaking with residents made a difference in developing positive feedback towards the upgrades being implemented throughout the Village. Manager Couuo informed Council of the meeting between the negotiating team and the Police Benevolent Association, which had two new representatives. He also reconfirmed the Tequesta Drive crosswalk drawings had been received earlier in the day, and noted that the estimates seemed reasonable, while much of the work would be performed by Village employees. Council Member Paterno asked if Council would be able to view the plans before the work was performed. Manager Couzzo assured Council that only routine maintenance projects would be perFormed without bringing the plans to Council first. Manager Couzzo emphasized that there was a lot going on in the Village at the moment, and cited the renewal of the concentrate discharge permit as a huge undertaking. He pointed out its' critical importance, due to very costly alternatives. He also mentioned the Consumer Confidence Report being released within the next couple of months. Lastly, Manager Couzzo announced that the Building Department would be holding an Open House in order to inform residents and contraetors, of updates regarding building permits, code enforcement, and various licenses. Minutes — Regular Council Meeting 02/11/16 Page 7 Attorney Davis read Ordinance 5-16 title into the record. Council Member D'Ambra explained that there had been several workshap meetings and a significant amount of discussion from both Village residents and Council prior to the ordinance language being modified. Council Member Paterno questioned whether the word "tandem" referred to Village of Tequesta residents, exclusively. Attorney Davis explained that it was never intended to apply to only the residents for a variety of reasons. Council Member Paterno referenced a future meeting with Martin County and asked if there were any other requests coming forth regarding traffic and the Tequesta Drive Bridge. Manager Couzzo responded by informing Council that there was a possibility of Martin County asking for additional discussion on this matter. ANY OTHER MATTERS Council Member D'Ambra informed Council of a federal proposal which could eliminate the tax exemption status of municipal bonds. Ms. JoAnn Forsythe, Director of Finance, explained to Council that all of the Village loans were currently tax exempt and losing this status would automatically cause an interest rate increase for those loans. Council Member D'Ambra recommended drawing a consensus immediately as it had to be submitted by February 15, 2016. Motion: Council Member Okun moved approva/ of supporting the continuation of the tax exemption on municipal bonds and authorized the Village Manager to sign a letter expressing support; seconded by Council Member D'Ambra; motion carried unanimously 5-0. Council Member D'Ambra reported on proposed changes in the GASB Reporting requirements that would adversely affect pension liability. He suggested that Council address this topic at the next scheduled workshop. Council Member D'Ambra addressed Chief Elg and commended him on providing additional police presence along US Highway One. Council Member Paterno asked how the Village of Tequesta was conveying its' opposition to the proposed sales tax increase, to Mr. Richard Radcliffe, Executive Director of Palm Beach County League of Cities. Manager Couzzo assured Council that he had clearly conveyed verbally, the Village's position on the sales tax issue. Mayor Brennan felt concerned after attending a county commission meeting because she believed "stonewalling" might not work in the Village's favor, regarding this issue. She concluded, if the sales tax increase passed, the Village would receive funds based on a"needs" and not "wants" basis. Her suggestion was to have a list of Village "needs" ready to submit, just in case the sales tax increase was approved. Attorney Davis felt that we did not need to provide a list at this time. Minutes — Regular Council Meeting 02/11/16 Page 8 Council Member Okun urged the Village to find out who owned the parcel on Point Drive where the proposed Banyan Tree project was located. Attorney Davis informed Council that the parcel was not privately owned, according to the Palm Beach County Property Appraiser website. Vice Mayor Arena mentioned that traffic was already problematic on Dixie Highway and Tequesta Drive and added that the major road construction had not even been started. He suggested the Village contact Palm Beach County to better synchronize the traffic lights. Vice Mayor Arena addressed the Tequesta Drive Bridge lighting and suggested those lights be moved up by six to ten feet. Lastly, he recommended that any Village of Tequesta business should be permitted to print and post their own event signage. Council Member Paterno countered, citing a recent Supreme Court ruling would prohibit that type of scenario. Attorney Davis agreed that it could be problematic due to the recent Gilbert case ruling. Council Member Okun asked for an update on the propane tank located next to the railroad tracks. Mayor Brennan informed Council of the extensive search that had been performed, in hopes of relocating the propane tank. She was still working on several different angles to solve the location issue. . ADJOURNMENT: Council Member Okun moved to adjoum the meeting; seconded by Vice Mayor Arena; the motion to adjoum carried unanimously 5-0; therefore, the meeting was adjourned at 7:51 p.m. Respectfully submitted, Lori McWilliams, MMC Village Clerk Note: These summary minutes are prepared in compliance with 286.011 F.S. and are not verbatim transcripts of the meeting. Present were: Mayor Abby Brennan, Vice Mayor Vince Arena, Council Member Steve Okun, Council Member Tom Paterno and Council Member Frank D'Ambra. APPROVALOFAGENDA MOTION: Council Member D'Ambra moved approval of the agenda; seconded by Council Member Okun; motion carried unanimously 5-0. 1. Discussion on Safety Issues within the Village (signs, speed limits, curbing, etc.) Manager Couzzo suggested signage be placed strategically once language was refined, but suggested they not be overused. He also noted that standard signs had been ordered and advised strategic placement along with a rotation system to help keep the communications fresh. Manager Couzzo clarified that intended messages would be analyzed and brought back to the next workshop. Attorney Davis explained the legislation associated with signage, and that the Village desired to be compliant and clear. Austin Nuquist, 39 Yacht Club Place offered his thoughts regarding placement of signs. He also felt police presence was sufficient; although stronger enforcement of incidents such as running stop signs lacked. Council supported rotation of signs, suggested solar lighting for stop signs, police officers focus on increased ticketing, and reducing speed limits within the Village. Attorney Davis noted that State statute altowed a reduction of speed as low as 20 mph (miles per hour). Manager Couzzo noted two specific curb areas being considered for changes on Tequesta Drive: curb area at Tequesta Drive adjacent to Paradise Park and the intersection of Country Club Drive. Doug Chambers, Public Works Superintendent, offered modification details for curbs and crosswalks at the two intersection along with the placement of benches. Council Member Okun left the meeting from 6:48 p.m.to 6:49 p.m. Council discussed safety options, and bike lane lighting grants and the intersection at Old Dixie being County. Manager Couzzo reported that residents appeared pleased with the curb project in the Country Club. Village Council Workshop Minutes February 29, 2016 Page 2 2. Discussion Regarding Community Usage of the Council Chambers Council discussed and agreed that current procedures were best and for events to remain at the Parks and Recreation building. Attorney Davis also confirmed that the Village could not sponsor business meetings in the Chambers. Council Member Paterno suggested the Village adopt the addition of fiber optics as he felt it would be a positive improvement for bringing in new Tequesta businesses. 3. Discussion on GASB (Governmental Accounting Standards Board) Current Changes in Pension Reporting Ms. JoAnn Forsythe, Finance Director, explained new liabilities and requirements associated with pensions. She stated the changes related to reporting were much more complex than in previous years, and that report requirements, rates and discounts rela#ed with actuaries and financials had become limiting to employers. Ms. Forsythe explained that figures were now required to be broken down, making the reports extremely confusing to read and labor intensive to create. 4. Update on the Ownership of Green Area at Point Drive (Banyan Tree Property) and Park Improvements Attorney Davis explained that the particular property at Bay Harbor and Shady Lane had been platted in 1925, and noted the Village was recognized for maintaining the property. Attorney Davis stated that the Village would acquire the property as a maintenance easement, or at most a possible passive area, and that records show, no one owning, or paying taxes on the property. Council questioned possible ownership, comp plan qualification status and liabilities, and if a survey could clarify ownership. The fact was supported that the area remained a simple, low maintenance passive park area with limited parking options, and a sign placed to state such. 5. US 1 Update Mayor Brennan updated Council on the recent FDOT (Florida Department of Transportation) project. She noted that Kim Delaney was a positive presence at the meeting which was intended to bring everyone up to date. She noted that the Village of Tequesta remained debt free on the project because of the FDOT; although landscaping had not been on the FDOT plan. She advised that the FDOT would consider the Village's anticipated landscape design and offered to accommodate the Village's landscape plan in their construction scheme. Council discussed pedestrian/landscape lighting along with the need for changes on easement, crosswalks and sidewalk. It was confirmed that the FDOT would attend the May 2, 2016 Council workshop. Council Member Okun left the meeting from 8:12 p.m. — 8:13 p.m. Village Council Workshop Minutes February 29, 2016 Page 3 ANY OTHER MATTERS Attorney Davis offered an update on County Infrastructure Surtax and noted that the ten year, one cent infrastructure proposed sales tax must be approved by referendum. He explained the Statute associated, its proposed distribution dynamics and the formula associated. He believed that reality was, if the three largest municipalities' supported it, it would, most likely be granted. Attorney Davis confirmed that the proposed tax had not been endorsed, nor opposed, and that if the tax passed Tequesta's current statutory rights would be null and void. Council discussed a municipal coalition, the school boards and cultural portions and Tequesta's present opposition. Attorney Davis suggested the item be discussed and or placed on the upcoming, regular agenda. Mayor Brennan offered a brief update regarding Amerigas. ADJOURNMENT: Council Member D'Ambra moved to adjoum the meeting; seconded by Council Member Okun. The motion to adjoum carried unanimously 5-0; fher+efore, the meeting was adjoumed at 8:33 pm. Respectfully submitted, Lori McWilliams, MMC Village Clerk Note: These summary minutes are prepared in compliance with 286.011 F.S. and are not verbatim transcripts of the meeting. A verbatim audio record is available from the Office of the Village Clerk. All referenced attachments are on file in the Village Clerk's office. MINUTES VILLAGE OF TEQUESTA SPECIAL MEETING March 22, 2016 i ' CALL TO ORDER AND ROLL CALL The meeting was cailed to order at 8:00 a.m. A roll call was taken by Village Clerk McWilliams. Present were: Mayor Abby Brennan, Vice Mayor Vince Arena, Council Member Steve Okun, Council Member Paterno (via phone) Council Member Frank D'Ambra. Attorney Davis explained that a party on the prevailing side of the motion would need to make the motion to reconsider. Mayor Brennan then passed the gavel to Vice Mayor Arena. APPROVAL OF AGENDA MOTION: Mayor Brennan moved reconsideration of PNC Bank Renovation Request fo Waive Village Code; seconded by Council Member Okun; item was opened for discussion. Council Member Paterno questioned whether Council was using Roberts Rules of Order and felt the reconsideration should have happened within the time- frame of being within a day of the original decision. Attorney Davis explained The Village did not strictly follow parliamentary procedures which was normally reserved for large legislative session bodies. He further explained that it typically did not apply to standing committees or regular board meetings. Council Member Arena recalled a past meeting where there was a reconsideration which happened outside the one-day time frame. Council Member Okun referenced the police car markings as a recent scenario where an item was brought up for reconsideration a second time. Attorney Davis reiterated the fact that Council generally followed parliamentary procedure and he could not name a single local government council that strictly followed every single piece of parliamentary procedure. He reaffirmed that it would be counterproductive and very difficult to accomplish any business by strictly following that procedure. Council Member D'Ambra concluded that Council was not is session on a daily basis and therefore would never be able to correct any decisions that necessitated a reconsideration. He felt it would be illogical to operate under such a basis. Vice Mayor Arena called for the vote; motion passed 4-1 with Council Member Patemo opposed. 1. Council Reconsider of PNC Bank Renovation Request to Waive Village Code to Allow PNC Bank Contractors to Work March 23, 2016 — April 25, 2016 during the hours of 5:00 p.m. to 2:00 a.m. Minutes—Special Meeting 3/22/16 Page 2 Vice Mayor Arena met with the project manager for PNC Bank this past Friday who explained the project differently. Vice Mayor Arena noticed that the large dumpster was located in the front of the bank property, not in the back near the residences. He was told by the project manager that there would not be trash and debris emptied during the night. The project manager also informed Vice Mayor Arena of the fact that there would not be any outside work that would be performed. All of the work and remodeling was strictly interior renovations. It was also noted that the bathrooms had already been stripped and removed of tile flooring. PNC Bank had requested to be able to work on phone and computer lines during one weekend in April. Additionally, there would not be large commercial vehicles on site during this time. Vice Mayor Arena suggested that there should be a stipulation in place stating the entire after- hours project be shut down, if even one resident complaint was received. He informed Council that he did witness the security risk of customers doing banking business within three feet of construction workers at the bank. Mayor Brennan was initially concerned that a precedent would have been set by allowing a business to perform renovation work outside the preset hours the Village currently allowed. She now realized that this was a special circumstance which was made evident after visiting the bank and observing the security issues that surrounded this situation. Council Member Okun felt that the initial presentation from last week was problematic as the PNC Bank Representative came across as arrogant and condescending. He felt the poor presentation set a negative tone and adversely affected his decision that night. After much reflection and discussion with a friend, he had taken a new perspective on the request to waive the Village Code regarding working hours. He suggested allowing the bank to work on a Sunday, in order to have two consecutive days to perform the labor, instead of going into the early hours of the morning. He suggested that the police be informed of the weekend work. Council Member D'Ambra pointed out to Council that he lived directly behind the bank and had not heard any noise at all while the construction was ongoing. He felt that the bank had an unusual circumstance in that they were mandated ' b federal law to sta o en durin the week. He felt this was an im ortant detail and I Y , Y p g p negated any chance of setting a precedent for other businesses. Council Member Okun I mentioned he was concerned with security at the bank, during the construction. Council I Member Paterno responded by stating the security of the bank was PNC's responsibility. I He also countered that PNC Bank be responsible for completing the construction work, while working within the Village of Tequesta code. He noted that there were three other PNC Bank locations within the Jupiter area for customers to utilize. Council Member Paterno opined that a precedent was being set not only in relation to the bank hours but also regarding the Roberts Rules of Order. Vice Mayor Arena reiterated to Council that the requirements for the approval of extra work hours were that no trash would be emptied at night, the dumpster was to remain located by the front of the bank, work would be permitted on just one Sunday, all work was to be interior, no work was to be perFormed on the exterior, and lastly, Manager Couzzo had the authority to shut down the construction project if any complaints were received or if he felt it necessary to do so. Minutes—Special Meeting 3/22/16 Page 3 MOT/ON: Council Member D'Ambra moved for approval of PNC Bank Renovation Request to Waive Village Code Work Hours; seconded by Council Member Okun; motion carried 4-1 under the following conditions: No trash would be emptied at night Dumpster to remain in front of bank Work would be permitted on only one Sunday All work was to be interior; no work performed on the exterior of bank Manager Couzzo had the authority fo shut down the construction at his discretion ADJOURNMENT: Council Member Okun moved to adjourn the meeting; seconded by Vice Mayor Arena. The motion to adjoum carried unanimously 5-0; therefore the meeting was adjoumed at 8:26 a.m. Respectfully submitted, Lori McWilliams, MMC Village Clerk Note: These summary minutes are prepared in compliance with 286.011 F.S. and are not verbatim transcripts of the meeting.
