Anthony CODE COMPLIANCE ORDER VILLAGE OF TEQUESTA, FLORIDA ORDER FINDING VIOLATION VILLAGE OF TEQUESTA, Case No. 2015 -00179 Petitioner, vs. THOMAS L. ANTHONY, Respondent. RE: Violation of section 302.8 of the International Property Maintenance Code, incorporated in Appendix B of the Code of Ordinances, Village of Tequesta, Florida Address: 582 N. Dover Road Tequesta, Florida 33469 Legal Description: JUPITER IN THE PINES SEC B LOT 28 /LESS W 3.89 FT/ & W 1/2 OF LOT 29 BLK 16 PCN: 60- 42- 40- 25 -06- 016 -0281 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, heard testimony at the Code Compliance Special Magistrate Hearing held on March 30, 2016. Based on the evidence and testimony presented, the following Findings of Fact, Conclusion of Law, and Order Finding Violation are hereby entered: FINDINGS OF FACT 1. Respondent is the owner for the above - described property. 2. Respondent was not present at the hearing; however, there was a finding of proper notice. 3. Code Enforcement Officer Joe Petrick provided testimony and evidence of the violation, as contained in the Village's evidentiary case file, which was accepted into evidence. 4. As of the hearing on March 30, 2016 and based on testimony presented by Code Enforcement Officer Joe Petrick, the property was in compliance with section 302.8 of the IPMC (incorporated at Appendix B of the Code of Ordinances, Village of Tequesta, Florida), but had not achieved compliance within the time specified in the Notice of Violation. CONCLUSION OF LAW The above - stated facts constitute a violation of section 302.8 of the IPMC, which is incorporated at Appendix B of the Code of Ordinances of the Village of Tequesta. Page 1 of 2 ORDER Respondent is hereby ordered to continue to comply with section 302.8 of the IPMC and the Code of Ordinances of the Village of Tequesta. Respondent is assessed $191.98 for administrative costs incurred by the Village prior to March 30, 2016. Should you violate the same Section of the Code again, you may be subject to a fine of up to five hundred dollars ($500.00) per day for such repeat violation. Additionally, the Code Inspector is not required to give a reasonable time to correct the repeat violation and the case may be presented to the Special Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing. Upon complying in any code compliance matter, it is always the responsibility of the Respondents to contact the Code Compliance Division at (561) 768 -0506 to request a reinspection of the property.
