Hawkins Date: November 27, 2007 This memorandum briefly reviews legal services furnished by Jones, Foster, Johnston & Stubbs, P.A. in November 2007. The following matters were generally addressed during this period: Arena /Tequesta Litigation. a. Communications with Village Manager re litigation and negotiations; b. Prepare for executive session regarding proposed settlement. c. Attend and present at executive session. d. Follow-up with manager and opposition re settlement, Council mtg. e. Prepare documentation to delineate approved settlement. 2. JMZ v Village of Tequesta. a. Limited review relative to re-scheduled deposition of Village of Tequesta corporate representative; b. JMZ set a deposition of a representative of the Village with the "most knowledge" concerning the alleged facts at issue. Mayor Humpage is the Village's representative because the dispute concerns matters which arose several years ago. Such deposition was scheduled for October 31, 2007 but was rescheduled due to a conflict with opposing counsel's schedule. 3. Charter Review. John Randolph has participated in multiple meetings relative to the Charter Review undertaken by the Council. Limited activity in this regard has been conducted. Mr. Randolph attended a meeting in this regard at Village Hall on November 7, 2007. 4. Ongoing matters. Various ongoing matters including: a. Preparation for and attendance at November Village Council meeting and follow-up review; b. Review proposed revisions to new ordinance relative to front and side yard treatment and preparation of ordinance for Council review; c. Review and follow-up on code issues involving Preserve and outstanding site items; d. Review of agreement with Jupiter Inlet Colony regarding police dispatch services furnished by Tequesta and negotiation of proposed indemnification language; e. Review agreement with Jupiter Inlet Colony re: review of building plans and inspections of structures and termination thereof; f. Preparation of correspondence to Mayor of Jupiter Inlet Colony re termination of interlocal agreement providing for building plan and inspection services by Tequesta; g. Follow-up re Village Hall construction resolution and final payment: h. Miscellaneous communications regarding above matters; i. Follow-up regarding preparation of FEMA ordinance per directions of Manager and Community Development Director. 2
