RE: Agenda Item — FDOT Letters of Intent to Enter Into Maintenance Agreements
The following describes in detail the above referenced agenda item:
As part of the U.S.1 redesign project, FDOT will require the Village to enter into
maintenance agreements for the following two (2) items:
1. "Landscape Maintenance" which specifically is comprised of maintenance of
pedestrian scale lighting, banners, etc. at the intersection of US1 and Tequesta
Drive.
2. "Patterned Pavement Maintenance" which specifically is comprised of patterned
pavement crosswalk maintenance at the intersections of US1 and Beach Road;
US1 and Tequesta Drive; and US1 and County Line Road.
The attached letters of intent are prerequisites to FDOT preparing the lighting plans and
roadway detail plans for the crosswalks at the above referenced intersections, as well as
the actual maintenance agreements, which would be slated for execution approximately
April, 2017. In the event that the Village ultimately decides to NOT execute the final
agreements, these features would be eliminated from the overall US1 redesign project.

LETTER OF INTENT TO ENTER INTO A
LANDSCAPE MAINTENANCE AGREEMENT
This letter is to confiirm the intent of tlle Village of Tequesta, Flot (Maintaining Agency) to
maintain all pedestrian scale lighting fuimished by the Department of Ti (FDOT)
located in the Right of Way of SR-5 (US-1) from South of Beach Road to Norlh of County Line
Road, for project FM # 4287 1 8-1-52-01. The landscape maintenance is limited to the pedestrian
scale lighting at the intersection of SR-S//US-1 and Tequesta Drive/Waterway Road.
A District 4 Landseape Maintenance Agreement will be forinalized between FDOT and t.he
Village of Tequesta four months prior to tl�e Project's Production Complete Phase, which is
seheduled for April 3, 2017.
For the puiposc of this commit�ncnt, Landscape Maintenance sl�all mean maintaining the
pedestrian scale lighting, banners, etc.
Based upon the intent of d�e Maintaining Agency to maintain the pedestrian scale lighting, tl�e
Dcpartment will dcvelop thc lighting plans for the areas described abovc.
This Commitment of Landseape Maintenance directed to F�DOT is contingent upon review
and acceptance of the Design Plans and Final Construction Documents by the Village of
Tcquesta, prior to Final Engineering Phase Submittal. The Plans and Documents for this effort
will confol�tn to FDOT standards and specifications. The Village of Tequesta will verify
community support for the pedestrian scale improvements.

LETTER OF INTENT TO ENTER INTO A
PATTERNED PAVEMENT MAINTENANCE AGREEMENT
This letler is to con�rm Che intent of the Village of Tequesta, Florida (Maintaining Agency) to
maintain the patterned pavement crosswalks fiirnished by the Department of Transportation
(FDOT) located witl�in the Right� of Way of SR-5 (US-1) fi South of Beach Road to Nortli of
County Line Road, for project FM # 428718-1-52-01. The patkerned pavement crosswalk
maintenance is limited to the intei:sections of SR-5/Beach Road, SR-5/Tequesta Drive, and SR-
5/County Line Road.
A District 4 Patterned Pavement Maintenance Agreement will be forinalized between FDOT
and the Village of Tequesta four nlonths priar to the Project's Production Complete Phase, which
is scheduled for April 3, 2017.
For the purpose of tl�is commitment, Patterned Pavement Maintenance, as set forth in the FDO"l'
Plans Preparation Manual, Volume 1, Section 2.1.6.2, is defined as:
1. Periodic skid testing (60 days of project acceptance, one year fiol(owing acceptance, and
every two ycars thercaftcr and for the life of the pltterned pavement crosswalks) by a
qualified firm.
2. Sending results of fiiction tests to the Disl� Warranty Coordinator wiCh a cover letter
e�ither certifying that� the crosswalks comply with NZe mini�nuin friction criCeria, or stating
what remedial action will be taken to T�estore the fi
3. Removin� de.ficient areas to t}�e full extent (I�ne by lane) and replaced wit�h the same
product installed initially. lf the Department deterinines that more than 50% of tlle lanes
in the intersecCion r replacement, the entire intersection installation �nay be
reconstructed with a differcnt pT•oduct on the APL or replaced with conventional
pavement.

4. When remedial action is required in accordance with the above requirements, the
Maintaining Agency rnust complete all ncccssa�y i at its own expense within 90
days of the date when the deficiency was identified. No more than two tull depth
patterned pavement repairs can be made to an area without first resurfacing the
ui�derlying pav�ment to 1" minimum depth.
5. The Department will not be responsiblc for replaci�lg the treatment following any
construction activities in the vicinity of the treat�ment.
6. ShouLd tl�e local agency fail to satisiactorily perform any required remedial worl< in
accordance with this agreement, the Department reserves the right to replace the
patterned pavernent with conventional pavement (matching the adjacent pavement) and
bill the local agency for this cost.
Based upon the intent of the Maintaining Agency to maintain the patterned pavement crosswalks,
the Department will develop roadway plans and details to include the areas described above.
This Commitment of Patterned Asphalt Maintenance directed to FDOT is contingent upon
review and acceptance of the Design Plans and Final Construction Documents by the Village of
Tequesta, prior to Final Engineering Phase Submittal. The Plans and Documents for this effort
will conform to FDOT standards and specifications. The Village of Tequesta will verify
community support for the aesthetic enhancements along project.
