HomeMy WebLinkAboutAgreement_General_05/31/2016 FDOT Florida Department of Transportation RICK SCOTT 3400 West Commercial Boulevard JIM BOXOLD GOVERNOR Fort Lauderdale, FL 33309 SECRETARY LETTER OF INTENT TO ENTER INTO A PATTERNED PAVEMENT MAINTENANCE AGREEMENT This letter is to confirm the intent of the Village of Tequesta, Florida (Maintaining Agency) to maintain the patterned pavement crosswalks furnished by the Department of Transportation (FDOT) located within the Right of Way of SR -5 (US -1) from South of Beach Road to North of County Line Road, for project FM # 428718- 1- 52 -01. The patterned pavement crosswalk maintenance is limited to the intersections of SR-5/Beach Road, SR -5 /Tequesta Drive, and SR- 5 /County Line Road. A District 4 Patterned Pavement Maintenance Agreement will be formalized between FDOT and the Village of Tequesta four months prior to the Project's Production Complete Phase, which is scheduled for April 3, 2017. For the purpose of this commitment, Patterned Pavement Maintenance, as set forth in the FDOT Plans Preparation Manual, Volume 1, Section 2.1.6.2, is defined as: 1. Periodic skid testing (60 days of project acceptance, one year following acceptance, and every two years thereafter and for the life of the patterned pavement crosswalks) by a qualified firm. 2. Sending results of friction tests to the District's Warranty Coordinator with a cover letter either certifying that the crosswalks comply with the minimum friction criteria, or stating what remedial action will be taken to restore the friction. 3. Removing deficient areas to the full extent (lane by lane) and replaced with the same product installed initially. If the Department determines that more than 50% of the lanes in the intersection require replacement, the entire intersection installation may be reconstructed with a different product on the APL or replaced with conventional pavement. www.dot.state.fl.us 4. When remedial action is required in accordance with the above requirements, the Maintaining Agency must complete all necessary repairs at its own expense within 90 days of the date when the deficiency was identified. No more than two full depth patterned pavement repairs can be made to an area without first resurfacing the underlying pavement to 1" minimum depth. 5. The Department will not be responsible for replacing the treatment following any construction activities in the vicinity of the treatment. 6. Should the local agency fail to satisfactorily perforin any required remedial work in accordance with this agreement, the Department reserves the right to replace the patterned pavement with conventional pavement (matching the adjacent pavement) and bill the local agency for this cost. Based upon the intent of the Maintaining Agency to maintain the patterned pavement crosswalks, the Department will develop roadway plans and details to include the areas described above. This Commitment of Patterned Asphalt Maintenance directed to FDOT is contingent upon review and acceptance of the Design Plans and Final Construction Documents by the Village of Tequesta, prior to Final Engineering Phase Submittal. The Plans and Documents for this effort will conform to FDOT standards and specifications. The Village of Tequesta will verify community support for the aesthetic enhancements along project.
