B. Law Firm Statistics:
Corbett and White, P.A. is a full service municipal law firm with five (5) attorneys
and two (2) administrative assistants. We are fully equipped with all necessary
technology in order to provide efficient and superior legal services to all of our
clients. The firm utilizes "Westlaw" as its library and research support and, through
that service, has access to the~est case law and legislation including United States
Supreme Court cases, State and Federal legislation, and Federal Appellate Cases, as
well as state court opinions at all levels and Attorney General Opinions. The firm's
administrative staff provides such services as recording documents, recording and
releasing all code enforcement liens, filing interlocal agreements and court
documents for litigation matters, obtaining copies of documents unable to be
accessed by the computer due to age or otherwise, and all other similar tasks. We
provide documents to our clients by fax, a-mail, regular mail, overnight express mail,
hand delivery and/or courier, as necessary or desired.
G Compensation:
The firm would propose a blended rate of $175.00 per hour for all general
administrative legal work and $195.00 per hour for litigation and administrative
hearings. Prosecution of code enforcement cases is treated as general work and is
billed at $175.00 per hour. Invoices are submitted monthly and are fully itemized for
ease of review. Costs (i.e. copies, faxes, long distance telephone calls) may be
charged at an agreed upon percentage of the monthly invoice for simplicity or as
separate items, whichever is preferred by the Village.

E. Significant public sector issues in which Corbett and White has been at the
forefrontwhich further qualifies us to provide legal services as the Village
Attorney:
1. Countywide School Concurrency:
Our firm played a significant role in creating a three (3) way agreement with
Palm Beach County, the School Board and all municipalities, other than those
exempted under state law, which set forth a School Concurrency program
which has become the model for the State of Florida. To date, no other
county has such a program in effect. The interlocal agreements signed by all
parties help ensure that schools will be built in a timely manner. This
required construction schedule should help municipalities in attracting
families and quality development projects to locate in their communities.
2. Countywide Fire Rescue Level of Service:
We continue to assist all the municipalities in the County in a joint effort to
delay a countywide referendum from being placed on the ballot regarding
this issue. With the assistance of several municipal leaders, the League of
Cities coordinated a consolidated effort to foreclose the County's efforts to
basically put small cities out of the fire/rescue business. We have only
bought time with this effort and will need to continue working for the
municipalities to prevent a County take-over. This issue is of utmost
importance to many municipalities, including the Village of North Palm ,-'
Beach.
3. Amendment of Local Option Gas Tax Agreements:
Our firm was instrumental in the preparation of the relevant documents for
the amendments to the Local Option Gas Tax Agreements and assisted in
making certain each municipality placed the agreements on their agendas for
approval. These amendments provide that if a new municipality is
incorporated, its share of the gas tax will come from the County's portion and
the municipal portion on a pro-rata basis. Prior to these amendments, when
Wellington was incorporated, its entire share of the money came from the
municipal portion, thus decreasing each of the other municipality's share
accordingly, with no contribution from the County. With these agreements
in place, this cannot happen again.
4. Road Reduction Interlocal Agreement:
Our firm negotiated and drafted an interlocal agreement to provide for notice
to other local governments whenever a municipality or county proposes to
reduce lane miles on the County's thoroughfare plan or to remove roads from
the plan. This agreement was drafted as an alternative to the County's

proposal to put this issue on the ballot, which would have given the County
complete control of all roads on the County's thoroughfare plan even if they
were located within municipalities. Without this alternative plan, the County
would have initiated a campaign to persuade the voters to give control to the
County, once again.
5. Countywide Dual Taxation Challenge:
As general counsel for the Palm Beach County League of Cities, and on
behalf of several of our current municipal clients who are intervening parties,
the firm has worked closely with trial counsel and continues to work with
appellate counsel for the cities of Boca Raton and Delray Beach in the lawsuit
challenging the county's attempt to mandate fire rescue dispatch on a county
wide basis. While the municipalities were successful in their challenge at the
trial level, Palm Beach County has appealed this ruling to the Fourth District
Court of Appeal. This case remains pending.
6. Dog Bite Liability
In response to a finding of liability against the City of Delray Beach for
damages caused to an individual by a dog owned by a citizen of that city, the
firm, as general counsel for the Palm Beach County League of Cities has
recently appeared as an Amicus Curiae on behalf of the City of Delray Beach.
We have prepared and filed a "friend of the court" brief, challenging the
finding of liability against the city based on statutory law, common law and
sovereign immunity principals. This matter is currently pending before the
Fourth District Court of Appeal.
F. Philosophy of litigation vs. amicable settlements:
The firm of Corbett and White, P.A. is committed to providing quality legal services
for municipalities and is convinced that many times municipal funds are drained
needlessly due to lawsuits which could be avoided through careful legal advice and
guidance. Amicable settlements generally allow the parties to move forward in a
positive manner rather than be forced to a standstill due to a lengthy and costly court
battle. Thus, generally, we believe in lawsuit avoidance through careful planning,
preparation and strict adherence to all procedural requirements. However, there are
instances that call for strong legal action to be taken in order to avoid the situation
where the municipality is viewed as an entity where rules can be bent to suit the
opposing party so long as legal threats are made. In such instances, we will
passionately defend or prosecute on behalf of the Village as we have done for our
other clients over the years.
G. Legal services provided associated with land use and zoning, code enforcement,
contract and construction law:
We successfully defended Lantana's Boat Mooring ordinance at both the trial and

appellate levels resulting in Lantana being one (1) of the few (if any) municipalities
with such an ordinance in full effect today. Thus, Lantana residents will not be faced
with a "Hong Kong Harbour" situation along its Intracoastal waterway as is the case
in the Singer Island area where Riviera Beach lost on the same issue. We also
successfully defended Royal Palm Beach on a comprehensive plan challenge and
appeal regarding a large residential development. The firm was even awarded
attorneys' fees on appeal by proving to the Court's satisfaction that the appeal was
without merit. Attorney's fees are rarely awarded under such circumstances.
Additionally, the firm has prepared extensive revisions to Comprehensive Plans for
Royal Palm Beach, Lantana and Mangonia Park, as well as general updates for our
other clients. We have re-written the entire Zoning Code for Lantana and
Manalapan, prepared major revisions to the Palm Beach Shores Zoning Ordinance,
and have drafted numerous zoning ordinances for all our clients. We actively
prosecute Code Enforcement cases before the Code Enforcement Board or Special
Magistrate, as the case may be. Both Bradley Biggs and Keith Davis have been
successful in foreclosing on code enforcement liens as directed by the client. We
have collected approximately $100,000.000 in Code Enforcement fines for Royal
Palm Beach; approximately $200,000.000 for Lantana and $140,000.00 for Atlantis
during the past two (2) years. Depending on the client's philosophy and desire, we
will pursue code enforcement as aggressively as directed. We have assisted Royal
Palm Beach, Lantana and Palm Beach Shores in bidding and construction issues
which arose regarding their cultural center, police building and community center,
respectively. Most recently, we have been involved in a contract dispute between
Riviera Beach and Palm Beach Shores and of course, have drafted and reviewed
hundreds of contracts.
H. Relevant work the firm has done which further qualifies it to provide legal
services:
We have assisted our clients as well as all other municipalities in Palm Beach County
through the League of Cities in all aspects of municipal law. We act as issuer's
counsel for bond issues, draft and review contracts, ordinances, resolutions and all
needed legal documents. We provide assistance and guidance in the preparation and
approval of Comprehensive Plans through the Department of Community Affairs and
our contacts with various state agencies and officials have benefitted our clients over
the years. Our firm has extensive experience in annexation issues and has
successfully defended Royal Palm Beach and Lantana in annexation challenges. We
have presented seminars for elected officials, taught code enforcement officers at
FAU and have provided assistance to the Municipal Clerks Association and FAOLA,
the Occupational Licensing Organization, as requested on a pro Bono basis. Three
(3) of our five (5) attorneys are also state certified mediators.

I. Statement why the firm is the best choice for providing legal services
Our firm is unique in its ability to provide legal representation for municipalities.
We have a depth of experience in this specialty that is unparalleled in this County
and, since municipalities face similar challenges, there is an economy of scale that
can benefit your community by utilizing the services of Corbett and White, P.A. We
already have completed a significant amount of research on any given issue; thus
your Village would not be in the position of expending taxpayer's dollars for us to
become familiar with your issues. We have made a conscious decision to represent
municipalities and have put all our energy toward this goal. We make it a practice
to decline all cases against municipalities unless one of our own clients gets involved
in a dispute against another municipality. John Corbett, Vice President of Corbett
and White, P.A., is a highly respected land use attorney with over twenty-five (25)
years of experience who has provided expert witness testimony in land use and
zoning cases, recently on behalf of the City of Boca Raton. While John is not one of
the attorneys listed on the proposal who would be assisting the Village on a daily
basis, his expertise is an invaluable asset. John was also a key player in drafting the
school concurrency documents, is very knowledgeable of all aspects of the County's
traffic performance standards ordinance, and is an AICP Certified Land Planner.

Thank you for your interest in our law firm. We are pleased to submit this proposal to serve
as Village Attorney for the Village of Tequesta. As you may be aware, the firm of Corbett and
White, P.A. currently serves as the municipal attorney for nine (9) municipalities in Palm Beach
County as well as General Counsel for the Palm Beach County League of Cities, Inc. (which
includes all thirty-eight (38) municipalities in Palm Beach County in its membership). We are
committed to providing municipalities with quality representation in a timely manner. We propose
to provide the Village with the full range of general counsel services, including the areas of
