The Special Magistrate appointed by the Village Council to hear code compliance cases
for the Village of Tequesta, in accordance with Chapter 162, Flor•ida Statittes, has heard
testimony at the Code Compliance Special Magistrate Hearing held on June 23, 2016 and based
on the evidence and testimony presented, entered an Order Assessing Fine. The following
Findings of Fact, Conclusions of Law and Order are hereby entered:
F�NDiNGS OF FACT
1. The Respondent is the owner of the above-described property.
2. The Respondent was present at the hearing. There was a finding of proper notice.
3. In the "Order Finding Violation," fi the March 30, 2016 violation hearing, the Special
Magistrate ordered the Respondent to comply with Sections 78-402 and 78-410 of the
Code of Ordinances of the Village of Tequesta by April 27, 2016.
4. Based upon the evidence, pictures and testimony presented at the hearing on June 23,
2016, the Special Magistrate found that the properry was in violation but now is now in
compliance with Sections 78-402 and 78-410 of the Code of Ordinances of the Village of
Tequesta.
CONCLUSIONS OF LAW
The above-stated facts constitute a continuing violation of Sections 78-402 and 7$-410 of
the Code of Ordinances of the Village of Tequesta.
ORDER
It is the Order of the Special Magistrate that no fine be imposed in this case. However,
the Respondent is assessed seven hundred . fif'ty-si.x dollars and ninety cents ($756.90) for
administrative costs incurred by the Village prior to June 23, 2016.
A certified copy of this Order may be recorded in the Public Records of Palm Beach
County, Florida, and, once recorded, shall constitute a lien against the propei upon which the
violation exits and upon any other real or personal pt•operty owned by the Respondent, pursuant
to Chapter 162, Florida Statutes.
Upon complying in any code compliance rnatter, it is always the responsibility of the
Respondent to contact the Code Compliance Division at (561) 768-0506 to request a
reinspection of the property.
