The Special Magistrate appointed by the Village Council to hear code compliance cases
for the Village of Tequesta, in accordance with Chapter 162, Flo�°ida Statutes, heard testimony at
the Code Compliance Hearing held on June 23, 2016. Based on the evidence and testimony
presented, the following Findings of Fact, Conclusion of Law, and Order Finding Violation are
hereby entered:
FINDINGS OF FACT
l. Respondent was represented at the hearing througli Gary Grant of GRS Management
Associates. There was a finding of proper notice.
2. Code Compliance Officer Joe Petrick provided testiniony and evidence of the
violations, as contained in the Village's evidentiary case file which was accepted into
evidence.
3. As of the hearing on June 23, 2016, based on testimony presented by code
compliance officers, the property was not in cotnpliance with IPMC sections 302.7.1;
303.1; 303.13.1; per section 14-121 of the Code of Ordinances of the Village of
Tequesta.
4. As of the hearing on June 23, 2016, based on testimony presented by code
compliance officers, the property was in compliance with IPMC section 302.7.2; per
section 14-121 of the Code of Ordinances of the Village of Tequesta.
CONCLUSION OF LAW
The above-stated facts constitute a vio1ation of IPMC sections 302.7.1; 303.1; 303.13.1;
per section 14-12 I of the Code of Ordinanccs of the Village of Tequesta.
ORDER
Respondent is hereby are ordered to comply with IPMC sections 302.7.1; 303.1;
303.13.1; per section 14-121 of the Code of Ordinances of the Village of Tequesta on or bef'ore
July 27, 2416. If the Respondent fails to achieve compliance on or before July 27, 2016, a daily
fine of up to $100.00 day may be imposed for each day the violation continues to exist.
Assessment of the Village's administrative costs in the amount of $402.96 incurred at the
June 23, 2016 hearing is hereby ordered.
Please take notice that you must appear at a fine assessment hearing, which will be l�eld
on July 28, 2016 at 10:00 a.in. at Village Hall, Council Cl�atnbers, 345 Tequesta Drive,
Tequesta, Florida 33469, unless the Code Enforcement Officer certifies that you have tiinely
b��ought your property into compliance.
Should you violate the saine Section of the Code again, you may be subject to a fine of
up to five hundred dollars ($500.00) per day for such repeat violation. Additionally, the code
compliance ofticer is not required to give a reasonable time to correct the repeat violation and the
case may be presented to the Special Magistrate even if the repeat violation has been corrected
prior to the Special Magistrate hearing.
Upon complying in any code compliance matter, it is always the responsibility of the
Respondent to contact the Code Compliance Division at (561) 768-0_506 to request a
reinspection of the property.
