Address: 3 Chapel Circle Tequesta, Florida 33469 Legal Description: CHAPEL COURT SEC 2 AS IN PB47P196 LT29 PCN: 60-42-40-ZS-32-000-0290 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Special Magistr Hearing held on June 23, 2016 and based on the evidence and testimony presented, entered an Order Assessing Fine. The following Findings of Fact, Conclusions of Law and Order are hereby entered: FINDINGS OF FACT 1. The Respondent is the owner of the above-described property. 2. The Respondent was not present at the hearing, but was represented by Dustin Nocella. There was a finding of proper notice. 3. In the "Order Finding Violation," from the May 26, 2016 violation hearing, the Special Magistrate ordered the Respondent to comply with Section 14-152 of the Code of Ordinances of the Village of Tequesta by June 20, 2016. 4. Based upon the evidence, pictures and testimony presented at the hearing on June 23, 2016, the Special Magistrate found that the property remained in violation of Section 14- l 52 of the Code of Ordinances of the Village of Tequesta. CONCLUSIONS OF LAW The above-stated facts constitute a continuing violation of Section 14-152 of the Code of Ordinances of the Village of Tequesta. ORDER It is the Order of the Special Magistrate that a Fine of seventy five dol[ars is hereby assessed, at a rate of twenty five dollars per day, for the violations which have existed on the property beginning June 20, 2016 and through June 23, 2016, a period of three days; the continuation and accrual of this fine amount beyond June 23 shall be considered at a Status / Fine Assessment Hearing on July 27, 2016 at 10:00 a.m. at Village Hall, Council Chambers, 345 Tequesta Drive, Tequesta, Florida 33469. The Respondent also is assessed one hundred thirty-one dollars and forty eight cents for administrative costs incurred by the Village prior to June 23, 2016. A certified copy of this Order may be recorded in the Public Records of Palm Beach Counry, Florida, and, once recorded, shall constitute a lien against the property upon which the violation exits and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Floridu Statutes.
