RE: �olation of Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta. Address: 375 Evergreen Avenue Tequesta, Florida 33469 Legal Description: NPITER IN THE PINES SEC B LT 5 BLK 21 PCN: 60-42-40-25-06-021-0050 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, heard testimony at the code compliance hearing on August 25, 2016. Based on the evidence and testimony presented, the following Findings of Fact, Conclusions of Law, and Order Finding Violation are hereby entered: FINDINGS OF FACT 1. The Respondent was not present at the hearing. However; there was a finding of proper notice. The Respondent's representative, Gregory Nelson, was present at the hearing. 2. Code Compliance Officer, Joe Petrick, provided testimony and evidence of the violation, as contained in the Village's evidentiary case file which was accepted into evidence. 3. As of the hearing on August 25, 2016 and based on testimony presented by the code compliance officer, the property was in compliance with Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta but did not achieve compliance by the date in the Notice Of Violation. CONCLUSIONS OF LAW The above-stated facts constitute a violation of Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta. ORDER The Respondent is hereby ordered ro maintain compliance with Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta. Should you violate the same Section of the Code again, you may be subject to a fine of up to five hundred dollars ($500.00) per day for such repeat violation. Additionally, the code compliance officer is not required to give a reasonable time to correct the repeat violation and the case may be presented to the Special Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing. The Respondent is assessed the Village's administrative costs in the amount of $197.46. Upon complying in any code compliance matter, it is always the responsibility of the Respondent to contact the Code Compliance Division at (561) 768-0506 to request a reinspection of the property.
