RE: �olation of Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta. Address: 361 Saturn Avenue Tequesta, Florida 33469 Legal Description: NPITER IN THE PINES SEC D LT 16 BLK 34 PCN: 60-43-40-30-04-034-0160 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, heard testimony at the code compliance hearing on August 25, 2016. Based on the evidence and testimony presented, the following Findings of Fact, Conclusions of Law, and Order Finding Violation are hereby entered: FINDINGS OF FACT 1. The Respondent was not present at the hearing. However; there was a finding of proper notice. The Respondent's representative, William Patterson, was present at the hearing. 2. Code Compliance Officer, Joe Petrick, provided testimony and evidence of the violation, as contained in the Village's evidentiary case file which was accepted into evidence. 3. As of the hearing on August 25, 2016 and based on testimony presented by the code compliance officer, the property was in partial compliance with Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta but did not achieve full compliance by the date in the Notice Of Violation. As of this date, the weeds and overgrowth violation came into compliance; however, the pump and driveway are still in violation of this section of the Code. 4. The Village has agreed to allow Respondent 10 days to pull the permit for the driveway and return driveway to compliance within 30 days. The Village has further allowed the Respondent to discuss the irrigation pump permit issue with the Village and achieve compliance before the October 20, 2016 hearing. CONCLUSIONS OF LAW The above-stated facts constitute a violation of Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta. ORDER The Respondent is hereby ordered to maintain compliance with Chapter 30 Article II Sec- tion 30-33 of the Code of Ordinances of the Village of Tequesta regarding the weeds and over- growth. Respondent is hereby ordered to comply with Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta within 30 days, on or before September 25, 2016 regarding the driveway. Respondent is hereby ordered to comply with Chapter 30 Article II Section 30-33 of the Code of Ordinances of the Village of Tequesta on or before October 20, 2016 regard- ing the pump. If Respondent fails to achieve compliance by September 25, 2016 and October 20, 2016, respectively, a daily fine of up to two /tundre�l fifry dollars per day may be imposed for each day the violation continues to exist. Please take notice that you must appear at the Fine Assessment Hearing which will be held on the 27'" day of October, 2016, at 10:00 a.m. at Village Hall, Council Chambers, 345 Tequesta Drive, Tequesta, Florida 33469, unless the Code Enforcement Officer certifies that you have timely brought your property into compliance. Note that due to a scheduling conflict, the next hearing date was changed from October 27, 2016, as verbally provided during the August 25, 2016 hearing, to October 20, 2016. Should you violate the same Section of the Code again, you may be subject to a fine of up to five hundred dollars ($500.00) per day for such repeat violation. Additionally, the code compliance officer is not required to give a reasonable time to correct the repeat violation and the case may be presented to the Special Magistrate even if the repeat violation has been corrected prior to the Special Magistrate hearing. The Respondent is assessed the Village's administrative costs in the amount of $202.44. Upon complying in any code compliance matter, it is always the responsibility of the Re- spondent to contact the Code Compliance Division at (561) 768-0506 to request a reinspec- tion of the property.
