l. I am the Clerk and records custodian of the Village of Tequesta, a Flarida municipal
corparation.
2. I have reviewed exhibits A through K, which were attached and incorporated into
Plaintiff's Amended Complaint To Foreclose Lien. (Docket at 48, Oct. 29, 2015.)
3. Additionally, I have reviewed the Order Finding Violation, which was attached to
Plaintiff's Notice of Filing (Docket at 58, Apri129, 2016).

PLAINTIFF'S MOTION TO AMEND COMPLAINT TO FORECLOSE LIEN
Plaintiff Village of Tequesta moves to amend its Complaint To Foreclose Lien in accordance
with the attached proposed complaint and that the attached proposed complaint stand as the
Amended Complaint To Foreclose Lien. In support, it states the following:
1. This is an action to foreclose a code enforcement lien.
2. Plaintiff's Complaint To Foreclose Lien was filed on April 13, 2015.
3. Plaintiff seeks to amend its complaint and include an expanded legal description of the
subject property.
4. The proposed amendment will not prejudice any party.
WHEREFORE, Plaintiff moves for an order permitting amendment and any other relief the
Court deems just.

AMENDED COMPLAINT TO FORECLOSE LIEN
Plaintiff, Village of Tequesta, through its undersigned counsel, sues Defendants, Doris S.
Thomas and Mikki L. Thomas, to foreclose a lien for code enforcement violations that have
existed for three years and states the following in support:
1. This action is brought pursuant to sections 162.09(3) and 162.10, Florida Statutes, to
foreclose a code enforcement lien on real property in Palm Beach County, Florida.

2. Plaintiff, Village of Tequesta (the Village), is a Florida municipal corporation.
3. Defendants, Doris S. Thomas and Mikki L. Thomas, own real property at 414 North Cypress
Drive #D in the Village of Tequesta, Palm Beach County, Florida. The property is described
as CYPRESS VILLAS UNIT D BLDG TR 1 OF PAR A(the Subject Property) �
the Palm Beach Countv Pronertv Appraiser and as follows:

4. This Court has in rem jurisdiction under section 26.012, Florida Statutes.
5. Pursuant to section 47.011, Florida Statutes, venue is proper in Palm Beach County, where
the property in litigation is located.
6. Three years ago, the Subject Property was littered with trash along the exterior and had
broken windows and bullet holes. It was reported to be infested by rodents. For these reasons,
the Subject Property was in violation of the minimum property standards of the Village's
code of ordinances.
7. On June 27, 2012, the Village provided Defendants with notice of the violations and notice of
a July 26, 2012 hearing (provided as exhibit A).
8. Two weeks later, Defendants failed to attend the code enforcement hearing and an Order
Finding Violation was adjudged at the hearing (provided as exhibit B). Defendants were
ordered to comply with the Village's code of ordinances by August 6, 2012 or be subject to a
fine.
9. A second order (provided as exhibit C) was adjudged at the hearing and the Village was
authorized to abate the violations as threats to public health, safety, and welfare on July 30,
2012.

10. On August 6, 2012, the Subject Property was not compliant. Approximately one week later,
the Village abated the violations. An Order Assessing Fine was adjudged on August 27, 2012
and recorded in book 25454 at pages 471 and 472 in the official records of this county (pro-
vided as exhibit D).
11. On Apri125, 2013, the Subject Property was still not compliant and an Order Finding Repeat
Violation And Imposing Fine was adjudged on April 30, 2013 and recorded in book 26025 at
pages 590 and 591 in the official records of this county (provided as exhibit E).
12. On June 27, 2013, the Subject Property remained not compliant and an Order Assessing Fine
was adjudged on July 12, 2013 and recorded in book 26206 at pages 1356 and 1357 in the
official records this county (provided as exhibit F).
13. In September of 2013, the Subject Property was not compliant for new reason: the interior of
the Subject Property contained significant amounts of mold and constituted a threat to the
health and welfare of others living in the multi-family building.
14. Notice of hearing and the (new) violations were provided to Defendants (provided as exhibit
G), who again failed to appear at the hearing.
15. Defendants were ordered to remedy the mold and preexisting violations (provided as exhibit
H, Order Finding Violation). The order authorized the Village to abate the violations and
assess abatement costs against Defendants pursuant to section 162.09, Florida Statutes. Id.
16. On December 12, 2013, the Subject Property remained not compliant and an Order Assessing
Fine was adjudged on December 22, 2013 and recorded in book 26551 at pages 781 and 782
in the official records of this county (provided as exhibit I).
17. Late last year, the Subject Property was not compliant and an Order Authorizing Foreclosure
was adjudged (provided as exhibit J).
18. In March of this year, the Subject Property was still not compliant and an Order Assessing
Additional Abatement Costs was adjudged on March 6, 2015 (provided as e�chibit K).

COUNT 1 - LIEN FORECLOSURE
19. Under chapter 162, Florida Statutes, the orders described in the preceding page and para-
graphs constitute a lien on the Subject Property.
20. Section 162.09(3), Florida Statutes, allows local governments to foreclose liens after three
months of nonpayment, following the recording of a code enforcement lien.
21. Thirty—two months have passed since the Village recorded its lien.
22. Last year, the Village authorized their attorneys to foreclose the Village's lien on the Subject
Property. See Pf's exhibit J.
23. As of the date this complaint was filed, the Village's lien remained unpaid and valued at over
$11,312.76. T'he lien continues to accrue at the rate of two hundred dollars per day until the
property complies with the Village's code of ordinances or judgment is rendered in this law-
suit.
24. The Subject Property is not homestead property pursuant to section four, article four of the
Florida Constitution.
25. All conditions precedent to the filing of this action have been performed.
ATTORNEY'S FEES
26. The Village is obligated to pay their attorneys' a reasonable fee.
27. If the Village prevails, it is entitled to recover all costs, including its reasonable attorneys'
fees and title search expenses for ascertaining necessary parties that it incurs in this action.

WHEREFORE Plaintiffdemands judgment foreclosing their lien and, if the proceeds of the
sale are insufficient to pay Plaintiff's claim of lien, a deficiency judgment; its reasonable
attorneys' fees; costs incurred in bringing this action; and any other relief the court deems just.

The Respondents are hereby ordered to comply with Section 30-33 of #he Code af

abatement of these vioiations after August 6, 2012. The Order also provided that

$I87,11 are raiafieci, and $205.92 in new admirustrative costs for tlie February 2G, 2015 hearing is
