April 21, 2016
1. CALL. TO ORDER AND ROLL CALL
The Village of Tequesta Planning and Zoning Board held a regularly scheduled meeting at
the Tequesta Village Hall, 345 Tequesta Drive, Tequesta, Florida, on Thursday, April 21,
2016. The meeting was called to order at 5:31 p.m. A roll call was taken by Anna Johnson,
Community Development Planner, who noted the following were present: Chair Janet Strand,
Board Member Elizabeth Schauer, Board Member Steven Eagen, and Alternate Board
Member Leslee Dasher. Vice Chair Michael Schmidt, Board Member Ashley Warren, and
Alternate Board Member Sebastian Loaiza were absent.
Also present was Village Attorney Jack Rice and Community Development Director Nilsa
Zacarias, who joined the meeting telephonically.
2. �4PPROVAL OF AGENDA
MO°TION
Board Member Elizabeth Schauer moved to approve the agenda as submitted; Board
Member Dasher seconded the motion, which carried by unanimous 4-0 vote.

MOTION '
Board Member Eagen moved to approve the minutes of the March 17, 2016 meeting as
submitted. Board Member Schauer seconded the motion, which carried by unanimous 4-0
vote.
SWEARING IN OF WITNESSES
Attorney Rice noted the item was quasi judicial and asked the Board members for ex-parte
communications. There were none. The following person's raised their hands to be sworn in,
to speak on an item: Brian Sunderhaus, Superintendent, Tequesta Country Club; Jeff Anton,
Terragone Development Services; Sasha & Matthew Melendy, property owners, 152
Gulfstream Drive; George Gentile, Gentile Glas Holloway O'Mahoney & Associates, Inc.
4. SPM 05-16: Application from Tequesta Country Club for a minor site plan modification
to remove the existing chain fence around the Golf Maintenance Facility and replace it with
950 linear feet of six (6) foot tall wooden fence. The address of the property is 201 Country
Club Drive, Tequesta, Florida 33469.
Board Member Dasher asked the applicant to clarify if this application from Tequesta Country
Club had been heard previously by the Planning and Zoning Board. Brian Sunderhaus,
Superintendent, Tequesta Country Club, responded that a similar application to replace the
existing fence around the golf maintenance facility was approved last year by the Board. He

further ciarified that the current application proposed a different fence material than the
original application.
MOTION
Board Member Schauer moved to approve SPM 05-16. Board Member Eagen seconded the
motion, which carried by unanimous 4-0 vote,
5. VAR 02-16: Application from Matthew J. and Sasha G. Melendy for a relief from Sec.
76-20 (a) (1) to allow the installation of a 122 foot waterward dock length, where the code
allows 75 feet; and for relief from Sec. 76-20 (g) to allow a 610 sq. ft. dock area, where the
code allows a maximum 500 square feet. The address of the property is 152 Gulfstream
Drive, Tequesta, Florida, 33469.
Chair, Janet Strand, reminded the Board that a variance request must be reviewed on its own
merits. She drew the Boards attention to the printed list of the criteria for issuance of a dock
variance, which was provided by the Attorney. Attorney Rice reiterated Board Member
Strand's comment that a variance is a legal decision and approval or denial must be based
on whether or not the criteria associated with a dock variance have been met. Attorney Rice
announced he would later discuss two comments he had for the applicant.
Attorney Rice asked the applicant, Jeff Anton, Terragone Development Services, if he would
like to enter the application into evidence, to which he agreed. Attorney Rice also entered the
variance criteria into the record as public comment. A copy of the variance criteria was
provided to the applicant.
Board Member Eagan requested that Board Member Dasher give a brief history of the
approval process for a dock variance, based on her experience with the Board of Adjustment,
to which she agreed.
Attorney Rice addressed two specific comments to the applicant, Mr. Anton. First, he asked
the applicant to clarify why the permit documents associated with the DEP approval were
different from the permit documents provided in the variance application.
Mr. Anton responded that his original application submittal was consistent with the DEP
documents; however, he had to modify the dimensions of the dock to be consistent with
Village code. He asserted that the application was still consistent with DEP requirements.
Attorney Rice requested that the applicant submit new documents to the DEP for approval on
the revised dock dimensions. Mr. Anton stated that he will provide updated DEP approval
documents when he applies for building permits.
Attorney Rice addressed the second comment to the applicant. He indicated that the state
code referenced in one of the applicant's responses on the application form states that
handrails should be provided on the portion of the dock that is over seagrass. Board Member
Schauer asked for clarification regarding the need for handrails. Mr. Anton responded that the

intent of the handrails is to prevent boats from docking along the length of the dock. Mr. Anton
emphasized that boats would not be docked along this portion of the dock.

Board Member Schauer moved to approve VAR 02-�6. Board Member Dasher seconded the
motion, which carried by unanimous 4-0 vote.

Upon motion by Board Member Schauer, seconded by Board Member Dasher, and
unanimously carried, the meeting was adjourned at 5:45 p.m.
