MEETING MINUTES
May 21, 2015
CALL TO ORDER AND ROLL CALL
The Village of Tequesta Planning & Zoning Advisory Board Sitting as the Local Planning
Agency held a regularly scheduled meeting at the Tequesta Village Hall, 345 Tequesta
Drive, Tequesta, Florida, on Thursday, May 21, 2015. The meeting was called to order
at 5:44 p.m. A roll call was taken by Denise Pennell, who noted the following were
present: Chair Janet Strand, Vice Chair Michael Schmidt, Board Member Elizabeth
Schauer, Board Member Steven Eagen, and Alternate Sebastain Loaiza. Also present
were Alternate Leslee Dasher, Village Attorney Jack Rice, and Director of Community
Development Nilsa Zacarias.
APPROVAL OF AGENDA
MOTION
Board Member Schauer moved to approve the agenda as submitted. Board Member
Eagen seconded the motion, which carried by unanimous 5-0 vote.

MOTION
Board Member Schauer moved to approve the minutes of the April 96, 2015 meeting as
submitted. Board Member Eagen seconded the motion, which carried by unanimous 5-
0 vote.
2. ORDINANCE NO. 7-15:
An Ordinance of the Village Council of the Village of Tequesta, Florida, amending
Chapter 22, Community Development, Article II, Divisions 2 and 3, by placing final
authority to hear requests for certain zoning variances and certain administrative
appeals with the Planning and Zoning Advisory Board, and clarifying other duties of the
Board; and renaming the Board to be referred to as the "Planning and Zoning Board";
providing that each and every other provision of Chapter 22, Community Development,
shall remain in full force and effect as previously adopted; providing a Conflicts clause,
a Severability clause, and Authority to Codify; providing an Effective Date, and for Other
Purposes.
Director of Community Development Zacarias explained that after 2012 code
amendments there have been less residential variance requests each year, and the
Planning and Zoning Board would now hear residential variances. Ordinance 7-15, 8-15

and 9-15 on tonight's agenda would effectively dissolve the Board of Adjustment. A
short training session would be held in the near future to go over variance review
procedures and the Sunshine Law.
MOTION
Board Member Schauer made a motion to approve Ordinance No. 7-95; seconded ,by
Board Member Eagen. Motion carried by unanimous 5-0 vote.
2. ORDINANCE NO. 8
An Ordinance of the Village Council of the Viflage of Tequesta, Florida, amending
Chapter 76, Waterway Control, by amending Section 76-7, Variances, by removing all
reference to the Board of Adjustment and substituting in its place the Planning and
Zoning Board, providing that each and every other provision ofi Chapter 76, Waterway
Control, shall remain in full force and effect as previousfy adopted; providing a Conflicts
clause, a Severability clause, and Authority to Codifiy; providing an Effective Date, and
for Other Purposes.

Board Member Schauer made a motion to approve Ordinance No, 8-15; seconded by
Board Member Eagen. Motion carried by unanimous 5-0 vote.
3, ORDINANCE NO. 9-15:
An Ordinance of the Village Council of the Village ofi Tequesta, Florida, amending
Chapter 78, Zoning, by removing all reference to the Board of Adjustment and
substituting in its place the Planning and Zoning Board, further clarifying that the
Building Board of Adjustment handles requests for variances from fihe Village's
Floodplain Ordinance; providing that each and every other provision ofi Chapter 78,
Zoning, shall remain in full force and effect as previously adopted; providing a Conflicts
clause, a Severability clause, and Authority to Codify; providing an Effective Date, and
for Other Purposes.
MOTION
Board Merrtber Eagen made a motion to approve Ordinance No. 9-95; seconded by
Board Member Loaiza. Motion carried by unanimous 5-0 vote.

ADJOURNMENT
There being no further business to come before the Board, upon motion by Board
Member Schauer seconded by Board Member Eagen and carried by unanimous 5-0
vote, the meeting was adjourned at 5:49 p.m,
