Subject: Warranty Service Package for Comlog Reader
PSAPs (Public Service Answering Points) are required to record all 911 calls, specific business
land lines, and all radio channels in a manner which permits immediate recall for informational
purposes when needed.
In as much as this is an electrical/mechanical piece of equipment it is subject to malfunction;
CVDS is the manufacturer of the equipment and provide the service warranty which is renewed
annually.
[ would like to make note that the warranty package increased from last year's (2015) rate of
$3,059.00 to this year's (2016) rate of $3,230.00. The overall increase is $171.00.

Enclosed is the ComLog Service Agreement Contract for the renewal of your warranty service coverage for the
ComLog Recorder. In order for the renewal to take into effect, please send back a signed copy of the contract

1-Year Warrantv A_areement:
CVDS Inc. is an IS09001:2008 company that designs and manufactures and tests all system
sofiware and hardware components in accordance with engineering specifications and safety
requirements. CVDS Inc. warrants its products for a period of twelve (12) months against defective
parts and workmanship beginning from the customer acceptance date. During the warranty period,
CVDS Inc. agrees to either repair or replace any defective equipment or part thereof at its
expense. Parts will be provided on an exchange basis, and any parts removed from equipment for
exchange are considered the property of CVDS Inc. and shall be returned to CVDS Inc.
This warranty does not cover:
• Damage due to abuse, misuse, neglect or customers modifications;
• Improper wiring, repairing, alteration, installation, or maintenance performed by an
unauthorized third-party;
• Theft, vandalism, fire, water or peril;
• Moving, relocation or alteration of equipment far which prior written approval has not
been given by CVDS Inc.
• Servicing not authorized by CVDS Inc.;
� Usage not in accordance with product instructions;
• Problems caused by use of parts and components not supplied by CVDS Inc.
Any non-warranty repairs will be charged at current CVDS rates.
CVDS Inc. makes no warranty with respect to products which have had their manufacturing serial
numbers removed or altered.
If CVDS Inc. elects the replacement option, the parts will be the same or a later version which
performs substantially the same function as the one being replaced. CVDS Inc. will make the final
determination as to the existence and cause of any defect.
In repairing or replacing any product, part of product, or software medium under this warranty,
CVDS Inc. may use new, remanufactured, reconditioned, refurbished, or functionally equivalent
products or parts.
The foregoing warranty is in lieu of all other warranties or conditions expressed or implied
including, but not limited to, the implied warranties or conditions of inerchantability and fitness for
particular purpose and those arising by a statute or from any other source.

PUBLIC RECQRDS. in accordance witfi 5ec. 119.0701, Florida Statutes,
CUNTRACTOR must keep and maintain this Agreement and any ather
reco�ds associated therewith and that are associated with the
per#ormance of the work described in the Proposal or Bid. Upon request

the Village with capies of requested records, or atlow such records to be
inspec#ed or copied, within a reasonable time in accordance with access

available for insp�ction or copying, within a reasonable time may be

associated with this Agreement or associated with the performance vf the
work described in the Proposal or 8id are not disciosed except as
autharized by taw for the duration of the Agreement term, and foilowing
cQmpletion of ths Agr�sment if the �ONTRACTDR �loQS nQt transf�r the
records ta the Village. Finally, upon campletion of the Agreement,
C�NTRACTOR shail transfer, at no cost to the Village, ali pubtic records in
passession of the CONTRACTOR, or keep and maintain public records

Molloy's Trolleys of West Palm Beach asked the Village to expedite the agreement
for Trolley Service at Tequesta Fest 2016. This will ensure a date for the Village.

The attached agenda item addresses the explred Hurncane/Disaster Debr�s Removal Reduction and D+sposal
Contract with PhNlips and lordan. The Village is piggybacking the contract Philiips & lordan has with the Palm Beach
County Solid Waste Authority.
Philfips & lordan's Contract �07-740) with the SWA expired on August 2Q, 2016. Phiflips &lordan and the Solid Waste
Authority of Palm Beach County have executed an amendment, Agreement No. 13 249 to extend the term of the
agreement for 1 additional year and provided in the agreement effective Aug�st 2i, 2016 through August 20, 2016.
Article 39 (Agreements with other Government Entities) of Agreement No. 13 249 states:
i'he CONTRACTOR agrees that this Agreement constitutes an offer to all State Agencies and
Political Subdivisions of the State of Flonda under the same terms and conditions, for the same
prices and for the same effective period as speci�ed in this Agreement; shoutd the
CONTRACTOR deem it in the best interest of their business to do so.
7he Agreement in no way restricts or inte�feres with any State Agency or Politicai Subdivision of
the State of Florida from re-solicitation.

PUBLIC RECORDS. In accordance with Sec. 119.0701, Florida
Sfatufes, CONTRACTOR must keep and maintain this Agreement
and any other records associated therewith and that are associated
with the pertormance of the work described in the Proposal or
Bid. Upon request from the Village's custodian of public records,
CONTRACTOR must provide the Village with copies of requested
records, or allow such records to be inspected or copied, within a
reasonable time in accordance with access and cost requirements of
Chapter 119, Florida Statutes. A CONTRACTOR who fails to
pravide the public records to the Village, or fails ta make them
available for inspection or copying, within a reasonable time may be
subject to attorney's fees and costs pursuant to Sec. 119.0701,
Florida Statutes, and other penalties under Sec. 119.10, Florida
Statutes. Further, CONTRACTOR shall ensure that any exempt or
confidential recards associated with this Agreement or associated
with the perfarmance of the work described in the Proposal or Bid
are not disclosed except as authorized by law for the duration of the
Agreement term, and following completion of the Agreement if the
CONTRACTOR does not transfer the records to the Village. Finally,
upon completion of the Agreement, CONTRACTOR shall transfer, at
• no cost to the Village, all public records in possession of the
CONTRACTOR, or keep and maintain public records required by the
Village. lf the CONTRACTOR transfers all public recards to the
Village upon completion of the Agreement, the CONTRACTOR sha11
destroy any duplicate pubtic records that are exempt or confidential
and exempt from public records disclosure requirements. if the
CONTRACTOR keeps and maintains public records upan
cornpletion of the Agreement, the CONTRACTOR shall meet alt
applicable requirements for retaining public records. Records that
are stored electronicaliy must be provided to the VILLAGE, upon
request from the Village's custodian of public records, in a format that
is cornpatible with the Village's lnformation technology systems.

Re: Extended Warranty for Zoll X-Series Defibrillators
The Fire Department has in its possession three {3) Zoll X-Series Defibrillators,
previously purchased. We are in need of the Extended Warranty and Preventive
Maintenance Contract in order to keep this equipment properly updated as needed, and
in proper working order. This includes loaner equipment should ours go out of service
for any length of time. This is a One (1) year Warranty of the equipment as well as
a One (1) year Preventive Maintenance Contract for the total amount of $3,953.25 and
has been budgeted for the fiscal year 16/17 out of Acct. OOi-192-546.310, Equipment
Repazr and Maintenance. It is imperative, and in the best interest of the Village,
we maintain this coverage on the equipment as it is the most cost-efficient should
a repair or an update be needed.

PUBLIC RECORDS. tn accordance with Sec. 119.Q701, Ftorida Statutes,
CtJNTRACI'QR must keep and maintain this Agreement and any other
records associated therewith and that are associated with the
performance of the work described in the Rroposal or Bid. Upon request
from the Village's custodian of public records, CONTRACTOR must provide
the Viliage with copies o# requested records, or allow sueh records to be
inspected or copied, within a reasonable time in accordance with access
and eost requirements of Chapter 519, Florida Statutes. A CONTRACTOR
who fails #o provide the public records to the Village, or fails to make them
available #or inspec#ion ar copying, wi#hin a reasonable time may be
subject to attorney's fees and costs pursuant to Sec. 119.0701, �'larida
Statutes, and other penalties under Sec. 119.10, Florida Statutes. Further,
CONTRACTOR shall ensure that any exempt or canfidentiai records
associated with this Agreement or associated with the performance of the
work described in the Proposaf or Bid are not disciosed except as
aufihorized by law for the duration of the Agreement term, and #oilawing
compietion of the Agreement if the C�NTRACTOR does not transfer the
records to the Viliage. Finally, upon completian of the Agreerr+ent,
CONTRACTOR shaA transfer, at no cost to the Village, al1 public recards in
possession of the CONTRACT�R, or keep and maintain public records
required by the Village. If the CONTRACTOR transfers a!I public records ta
the Viliage upon completion of the Agreement, the CONTRACTC7R shal)
destroy any duplicate public records that are exempt or confidentiai and
exempt from public records disclosure requirements. ff the CONTRACTOR
keeps and maintains public records upon cornpletion o# the Agreement,
the CONTRACTOR shall meet all appiicabie requirements for retaining
pub{ic records. Records that are stored electronically must be prauided to
the VILLAGE, upon requesk from the Village's custodian of public records,
in a format that is compatible with the Village's information technology
systems.
