LAND USE AND ZONING EXISTING LAND USE FUTURE LAND USE ZONING SUBJECT PROPERTY Commercial Commercial C-2 Community Commercial District III. BACKGROUND & STAFF ANALYSIS Application of N. Corcoran Enterprises, Inc. d/b/a/ Domino's for a site plan modification to open a carryout and fast food restaurant as a special exception use in the community commercial (C-2) district pursuant to section 78-177 (d)(7 & 17) of the Village of Tequesta Code of Ordinances. The application includes interior modifications which will not affect the existing storefront exterior. The plaza owner is Tamwest Realty, Inc. d/b/a County Line Plaza. Per Code Section 78-331. Division 2. Site Plan Review. Special Exception Uses require site plan review approval. The subject restaurant will be located at County Line Plaza, and the existing storefront will not be modified. Please see Statement of Use provided bv the applicant in attached application. Domino's food service complies with the following code definitions for fast food restaurant and carryout restaurant per Sec. 78-4, Retail Food Establishment: Fast food restaurant means any establishment whose principal business is sale of foods, frozen desserts, or beverages to the customer in a ready-to-consume state for consumption either within the restaurant building or adjacent outdoor table dining area, or for carryout with consumption off the premises, and whose design or principal method of operation includes any of the following characteristics: a. Food and beverages are ordered from a limited menu posted in sign form within the primary food service building or on the premises. b. Foods, frozen desserts, or beverages are usually served in edible containers or in paper, plastic, or other disposable containers. c. The consumption of foods, frozen desserts, or beverages within a motor vehicle parked upon the premises is posted as being prohibited and such prohibition is strictly enforced by the restaurateur. d. The kitchen is in excess of 50 percent of the total floor area Carryout restaurant means any establishment whose principal business is the sale of foods, frozen desserts, or beverages to the customer in a ready-to-consume state, and whose design or method of operation includes any of the following characteristics: a. The kitchen is in excess of 50 percent of the total floor area The applicant was heard previously by Village Council at their April 14, 2016 meeting, requesting to open a Dominos restaurant in Fashion Mall Plaza, a Special Exception Use in the Mixed Use district. While this application was approved by Council, the applicant was unable to open Domino's in that particular location. The applicant found a new location in the C-2 zoning district to open a Domino's restaurant, and submitted the current application. The applicant provided the proposed interior floorplan, a statement of use, as well as photos of the proposed interior aesthetics for the restaurant in the attached application. IV. FINAL REMARKS This development application met the requirements set on Section 78-334 notice of hearing. The notice of hearing was advertised on October 2, 2016. The subject application was heard at the September 15, 2016 Planning & Zoning Board meeting, and approved by a 6-0 vote. US Hwy 2 in Tequesta was chosen to potentiaily develop a new Damino's location for a variety af reasons. Extensive market research was conducted 6y Domino's and myself to determine that this location would be an optimai location for a Domino`s. Domino's provides an in depth market analysis, with all demographic information, competitive infio�mation, projected sales information, school and hote! information, and much more to all franchisees who are interested in devetoping an area. Unfortunately, this is prop�ietary informatian that cannot be sha�ed with anyone except the intended recipient. Out of this repart, I have determined that Tequesta would be a viabte location to bui(d a Domina's. I have compared demo�raphic and competitive information from my current locatians, to fihe information far Tequesta and surrounding areas that would be serviced by this locatian, and f am very canfider�t that this wil! be a successful venture. After reviewing several properties in and around Tequesta, this specific location was chosen because it affers everything to build the ideai Domino's pizza theater. lt has adequate parking, great access and egress, and it is in a plaza with multip(e anchars. There wi{t be na exterior modifications. The impact this business wilt create in the vitlage af Tequesta will be very minimaL There wiq be na naise pollutioR from the business, na smoke, and any odor wilf be very minimat due to the fact that atl af our food is cooked in one oven with adequate ventifation. There wiif not be alcohal served in the restaurant. The hours of operation will be 10am-12am, Sunday-Thursday, and l0am-1am, Friday and Saturday. I am expecting to have 4-6 delivery drivers working during peak hours. { a{so have ties to the surrounding areas of Hobe Saund and Stuart (whe�e 1 currently reside}, and i feef 1 can help the community with a lat of outreach programs.l currentfy participate in a lot of fundraising efforts, and donate a lot af pizzas ta churches and schools at my two locations in Deerfield Beach, but I #hink there would be a!ot more that 1 wouid be able to do with this Iocation being right in my backyard.
