'1'he attached agenda item (Resolution 37-16) provides the details of the Landscape
�laintenance r,greement between the State of Florida Department of Transportation
District Four and the Village of Tequesta. Per the agreement The Village of Tequesta
would be responsible for maintaining the landscaping improvements South of Beach
Road to North of County Line Rd for a duration of 25 years. The landscape
improvement will be funded by the FDO"I' in the amount of $88,157.96.
'I'he Village of Tequesta will be responsible for but not limited to maintaining planted
materials, irrigarion, concrete pavers, stamped concrete, period mowing, fertilizarion,
weeding, litter pick-up, pruning, replanting.
Please refer to the full details and responsibilities described in the agreement between
the Village of Tequesta and the State of Florida Department of Transportation

A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQiTESTA, FLORIDA, ENTERS INTO A LANDSCAPE MAINTENANCE
AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION, FOR THE PURPOSE OF MAINTAINING
LANDSCAPE IMPROVEMENT AREAS ON SR5/USl, FROM SOUTH OF
BEACH ROAD (STA. 550+00.00 P.P. 11.011) TO NORTH OF COUNTY
LINE ROAD (STA. 625+12.00 M.P. 12.434), � PROVIDING FOR
SEVERABII.ITY; PROVIDING AN EFFECTIVE DATE; AND FOR
OTHER PURPOSES.
WHEREAS, THE State of Florida Department of Transportation has jurisdiction over
State Road 5(LJS 1) as part of the State Highway System; and
WHEREAS, the State of Florida Department of Transportation seeks to install and have
maintained by the Village of Tequesta certain landscape improvements within the right of .
way of State Road 5(US 1); and
WI�REAS, as part of the continual updating of the Sta.te of Florida Highway System, the
State of Florida Department of Transportation, for the purpose of safety, protection of the
investment and other reasons, has constructed and does maintain the highway facility
within the corporate limits of the Village of Tequesta; and
WHEREAS, the Village of Tequesta is agreeable to maintaining those Landscape
Improvements within the Florida Department of Transportation's limits including plant
materials, irrigation system and/or hardscape to the medians and areas outside the
travelway to the rigb.t of way line andlor azeas within the travelway that may contain �
specialty surfacing (concrete pavers, color stamped concrete and color stamped asphalt
(also known as patterned pavement) including any other hardscape (if applicable), but
excluding standard concrete sidewalk; and agrees such improvements shall be maintained
by periodic mowing, fertilizing, weeding, litter pick-up, pruning, necessary replanting,
irrigation repair and/or repair of the median concrete replacements associated with the
_ specialty surfacing (if applicable) as needed; and
WHEREAS, it is the intent of the Village of Tequesta. and the Florida Department of
Transportation that the Village of Tequesta sha11 maintain all right of way within the
medians, outside the travelway and improvements made to the travelway that was made at
the request of the Florida Department of Transportation; and
WHEREAS, the parties hereto mutually recognize the need for entering into an Agreement
designating and setting forth the responsibilities of each party; and
WHEREAS, the term of this Agreement should remain in effect for 25 years;
NOW, THEREFORE, BE IT RESOLVED BY THE VII.,LAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS:
Section 1 Resolution No 37-16, the Village of Tequesta is entering into a Landscape
Maintenance Agreement with the Florida Department of Transportation.
Section 2 This Resolution shall become effective immediately upon passage.

3. MAfNTENANCE t?F FACILtTlES
A. The /AGENCY agrees ta, maintain fhe landscape improveixt�nts, as existing and
those to be installed, within the physicai limi#s described in �xhibifi "A" �nd as
fu�tlier descri�ed in Exhi6it "B". The n. on-standard improverrients within and outsitle

guidelines, Exhibit "E", Pat#erried Pa�ement Maintenance. The AG�NCY'S
resp�nsibility for maintenance shall incfUde all laridscaped, turfed and hardscape
areas on the sidewalk or within the rriedians and areas outside �he trayelway to the
right-of-way �nd/or areas within the tcavelway con#aining spec�afty surfacing, 1t shall
b� the responsibility vf �he AGENCY to r�store an unacceptabl� �ide condition of fhe
ra�adway caused by th� clifferentiaP character�s#i�s of non=standard travelway
